Does Obama’s National Defense Resources Preparedness Order Allow Unfettered Control?

On March 16th, President Obama signed a new Executive Order which expands upon a prior order issued in 1950 for Disaster Preparedness, and gives the office of the President complete control over all the resources in the United States in times of war or emergency.

The National Defense Resources Preparedness order gives the Executive Branch the power to control and allocate energy, production, transportation, food, and even water resources by decree under the auspices of national defense and national security.  The order is not limited to wartime implementation, as one of the order’s functions includes the command and control of resources in peacetime determinations.

The Obama administration appears to be preparing for a long drawn out war in the Middle East, or at the very least, an expected crisis that will require the need to override Constitutional authority and claim dominion over all resources in the United States under the guise of national defense.  With the rise in Disaster Preparedness growing for both individuals and states leading up to yesterday’s Executive Order, the mood of the nation points strongly towards some event or disaster that will require massive preparations on a national as well as local scale.

Protein Wisdom says this could be nothing unusual, but, wonders about the president giving the Executive branch these powers during peacetime. Could this EO be just a routine update, or something else? It’s hard to tell, and I’d like to give Obama the benefit of the doubt: I’d hate to think that he would be that stupid, and power hungry, to implement a massive takeover of private industry (hint: oil and energy sources) during domestic peacetime in this manner. He seems to prefer other ways, like Obamacare.

There are lots of questions to be asked. Israpundit has a few, and check out the comment. Atlas Shrugs points out that it calls for a uncompensated civilian draft. I Own The World says you should read it slowly. Good advice. I read it quickly, but, I am going back through it word by word.

The big question is “does this really mean something, is it simply updated rules, or, is this an attempt to create yet another issue to deflect from Obama’s pitiful record?” Time will tell.

(ABC News) Singer Cee Lo Green just finished performing his hit song at President Obama’s campaign fundraiser at the Tyler Perry Studios in Atlanta, Ga., and he started with the uncensored version.

The Grammy-winner and Atlanta native flicked off the audience before asking, “Can I curse in here?” But he didn’t wait for the answer, belting out “f*** you!” Cee Lo ultimately switched to the censored “Forget You” lyrics.

Simply wonderful. Bet those paying $35,000 a plate enjoyed it. Don Surber puts this under “Evil” in his Daily Scoreboard. How about “misogynistic”? Hey, don’t blame: even liberal feminists think so. And here.

ANCHORAGE, Alaska (AP) – Even by Alaska standards, this winter is unusual for the hardy residents of the state’s largest city.

Near-record snowfall buried Anchorage neighborhoods, turning streets into canyons with walls of snow on each side. The snow’s weight collapsed the roofs of some buildings. Moose are fleeing into the city to get away from too-deep snow.

And the city dumps are close to overflowing with snow that may not melt entirely before next winter.

The first three months of 2012 have seen twice the normal number of tornadoes. And 36 states set daily high temperature records Thursday. The Lower 48 had its fourth warmest winter on record, while Alaska had its coldest January on record.

The cause?

Two different weather phenomenon – La Nina and its northern cousin the Arctic Oscillation – are mostly to blame, meteorologists say. Global warming could also be a factor because it is supposed to increase weather extremes, climate scientists say.

“When you start to see the extreme events become more common, that’s when you can say that it is a consequence of global warming,” University of Victoria climate scientist Andrew Weaver said.

Got that? Record snow and cold are caused by too much of a trace gas necessary for life. In the past, back when there were more sane people, this would simply be “the weather.” Now, any and every weather event is blamed on Mankind living a modern life, and the Warmists are continually beating the “extreme weather” drum, because, despite an increase in CO2, the average world temperature has been flatlined for over 15 years. And it’s still not as hot as the 1930’s.

On Contraception Mandate, HHS Runs More Rules Up The Flagpole

Far left liberal blogs, pundits, and elected lawmakers may think that the GOP opposition to the HHS contraception, sterilization, and abortifacient mandate on religious organizations is a “war on women”, but, even HHS and the Obama admin are starting to realize that the longer this debate goes on, the more the American public will come to realize that the mandate is tyrannical and violates the 1st Amendment religious clause. HHS also realizes they may have dug themselves a hole, so, they attempt to throw some ideas against the wall and see if they’ll stick

(Politico) When President Barack Obama announced his contraception compromise in February, he left the details to the Department of Health and Human Services. And on Friday, HHS tried to fill in the blanks — mostly by asking new questions.

President Obama announced in February that religiously affiliated employers — such as Catholic hospitals — will not have to cover contraception for their employees. Instead, insurers will be required to enroll their employees into the coverage free of charge.

But the final rule issued at the time did not provide any details on how this would work, leaving many questions. The document issued Friday does not fill in those blanks, but it floats ideas under consideration for implementing the policy.

And what are those ideas? They basically revolve are those institutions which self insure

– Require the companies that self-insured plans hire to manage their employee benefits, called third-party administrators, to cover the cost of these benefits out of revenues not connected with the religiously affiliated employer.

– Cover the cost of the benefit by having the new reinsurance program established by the health care reform law pay rebates to third-party administrators.

– Have a separate insurance company provide the benefit to these employees.

Must be nice living in a fantasy world, where the money just magically appears for someone else to pay the costs (first two). Or, “if you like your plan, you should still dump it to comply with the Central Planning Bureau.” Speaking of dumping plans, Politico shockingly writes a story about the real world truths of Obamacare

President Barack Obama promised over and over during the health care debate that “if you like your health care plan, you can keep your health care plan.”

It turns out that, for a lot of people, that isn’t true.

And the four reality based facts are

  • Some people won’t get to keep the coverage they like.
  • Costs aren’t going to go down.
  • It’s just a guess that the law can pay for itself.
  • “The more they know, the more they’ll like it” isn’t happening.

It’s a turd of a law, which interferes with individual liberty, will see its costs rise, and will cause more and more companies to drop their insurance offerings, pushing people into plans that health organizations will not want to accept because the government is cheap and is slow to reimburse. It’ll cause slow service and long waits. Rationing. It’ll put unelected and unresponsive central government bureaucrats in charge of our health. Hey, what’s not to love?

Rep. Don Young (R-Alaska) Terms EPA: “Employment Prevention Agency”

Hey, I like the EPA, it has a place and serves a purpose. Unfortunately, it has become entirely too political, it goes well beyond its purpose, and cares little for the people it hurts: Obama’s EPA as an Employment Prevention Agency (via Junk Science)

President Barack Obama, in his recent “energy speech,” declared that a key to lower gasoline prices “starts with the need for safe, responsible oil production here in America. We’re not going to transition out of oil anytime soon.”

It was a bold statement and should be commended. However, instead of campaign stumping to college students, perhaps the president should have given this pep talk to his own Environmental Protection Agency.

It’s clear that the EPA has lost its way. Since its inception in 1970, the agency has slowly morphed from an entity with a well-defined mission of cleaning up the environment to one that specializes in natural resource development obstructionism. The EPA is now the gatekeeper, deciding which energy projects move forward and which die in a regulatory labyrinth.

That transition has never been more apparent than under the Obama administration. For three years, the EPA has worked with fringe environmentalists to block more expansive oil production in the U.S. Under current Administrator Lisa Jackson, the EPA regularly bypasses Congress and even scuttles the work of other federal agencies. It does this to advance a radical political agenda, rather than promoting policies that create jobs and make energy more affordable.

Protecting the environment is good. Unfortunately, the environmental movement has been hijacked by extremists and those who needed something after their beloved Soviet Union and hard edged Communism died out. The EPA needs to be reigned in and get back to its core mission.

Obama DOJ Shifts ObamaCare Defense To “Necessary and Proper Clause”

Fortunately, Obama is using tons of taxpayer money to defend a law that most taxpayers hate

(The Hill) The Obama administration has shifted its legal arguments as it prepares to defend the president’s healthcare law before the Supreme Court.

Some legal experts say the shift could steer the case in a direction that would make Justice Antonin Scalia more likely to uphold the healthcare law’s mandate requiring individuals to purchase health insurance.

The shift moves the focus of Justice’s argument from the Commerce Clause of the Constitution to the Necessary and Proper Clause, which says Congress can make laws that are necessary for carrying out its other powers.

“The minimum coverage provision is … necessary to achieve Congress’s concededly valid objective of reforming the interstate market in health insurance,” the Justice Department said in its first Supreme Court brief on the merits of the mandate.

The brief argues requiring insurance companies to cover everyone and banning them from charging sick people higher prices are regulations that the Constitution clearly protects. The mandate, Justice argues, is a “necessary and proper” way to carry out those regulations without causing the cost of insurance to skyrocket.

So, they’re arguing that the mandate is necessary and proper to carry out the same law that created the mandate? It might a little bit of sense if the mandate was a follow up from a previous law. However, not the same law making the same law necessary and proper. But, there is a wee bit of a problem with this argument, which I’m sure Scalia will understand, since he surely has read the Constitution and the clause (Article I, Section 8)

The Congress shall have Power – To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.

Those powers were specifically laid out in the Constitution, especially in Article I, Section 8. The only possible way they could argue that the mandate is necessary and proper is in declaring it a tax, one that is laid upon the citizenry for simply being citizens, a tax for not purchasing a product. The clause doesn’t give Congress the power to simply invent Powers for itself, and certainly not to mandate that citizens be forced to purchase an item or be penalized. What’s to stop them from mandating that we all join a health club, or be fined/taxed? Or buy broccoli? A Chevy Fuego, er, Volt?

Oh, then there is this (Article I, Section 9)

No Tax or Duty shall be laid on Articles exported from any State.

If they are arguing that it is a tax based on regulating interstate commerce, and that it is necessary and proper, seems as if the Constitution itself, written over two hundred years ago, is calling bullsh*t on that line of reasoning.

HuffPo: DC’s Cherry Trees Blooming Early Proves Climate Change

It couldn’t possibly be due to natural variation, no, it has to be because you, dear reader, did not unplug your energy sucking DVR when you went to sleep last night

(HuffPo) Amid all the screaming signs about Global Warming’s increasingly serious impact on the world around us and on human civilizations future prospects, the ‘luxury’ symbolic canaries in the coal mine always create mixed emotions. Global Warming’s threat to skiing (and declining viable Winter Olympics locations), and to wine making and bourbon and beer and chocolate and maple syrup and … production, etc … Yes, these are tangible examples of how global warming impacts the world around us and impacts us. On the other hand, compared to increasing natural disasters, devastating storms and droughts threatening vulnerable populations andCherry Blossoms at Tidal Basin disruptions to global agricultural production systems, these are “luxury” items whose (in and of themselves) disruption does not represent a fundamental threat to human civilization (no matter how important the maple syrup for your pancakes or that bourbon for warming up after a day on the slopes). Yes, as we all know in our Madison Avenue dominated world, symbols matter and cherished symbols even more so.

The Washington Post featured, on its front page March 15, 2011, a story driven by 2012’s “early” blooming Cherry Blossoms (WT note: the 2011 is a HuffPo typo, the story is from 2012) and building on a November 11 published scientific study (full study here) from University of Washington (which has its own Cherry Blossoms) and Korean university researchers that looks to Global Warming’s likely impact on this cultural icon for the decades to come. As that study’s introduction noted, a 2001 study had already documented that

In the Washington, D.C. area, 89 of 100 plant species surveyed, including flowering cherry trees, exhibited a significant advance of 4.5 days in first-flowering over the 30 years from 1970 to 1999.

In short, their work suggests that Washington, D.C., will have to move the Cherry Blossom up by nearly a month by 2050 or risk having blossom-less trees for the parade.

Ah, the 2050 canard. Tell you what: I want you to use your computer models and tell us exatly when the trees will bloom each year over the next 10, and I’ll then buy into your cult.

In Reality Land, all this proves is that it was a mild winter. It was weather. After multiple harsh winters in a row. Which the Warmists blamed on human induced climate change (hoax). And it doesn’t prove anthropogenic causes. Just that the the Earth is currently in a warm period, which followed a cool period, which followed a period that was warmer than it is today, preceded by a cool period, and a warm period, and so on back to the last glacial period.

There is no factual evidence with proves that Mankind’s release of greenhouse gases is driving the climate, simply anecdotal fearmongering. If the Warmists really believed what they were pushing, they’d stop driving fossil fueled vehicles, taking unnecessary fossil fueled flights, charge their iPhones and iPads with solar chargers (who cares if it takes all day to charge? You’re Saving The Planet!!!!), unplug every appliance when you aren’t using it, and grow your own food. Oh, and don’t forget to install expensive solar panels on your home, live off the grid. So what if you can’t run your appliances? Again, you’re saving the planet!

But, hey, the climate alarmist models tell us exactly what will happen…..what? Their predictions were way off? Humph.
