NY Criminalizes Firearm Ownership

3. § 265.01 Criminal possession of a weapon in the fourth degree.
A person is guilty of criminal possession of a weapon in the fourth degree when:
(1) He or she possesses any firearm, electronic dart gun, electronic stun gun, gravity knife, switchblade knife, pilum ballistic knife, metal knuckle knife, cane sword, billy, blackjack, bludgeon, plastic knuckles, metal knuckles, chuka stick, sand bag, sandclub, wrist-brace type sling- shot or slungshot, shirken or “Kung Fu star”; or

This is from page 21 of S2230 starting on line 3 (I’ve cleaned it up a bit), and makes possession of any of those weapons, including any gun, a misdemeanor. Reading through the rest, there is no clause which makes a determination for specific ownership, meaning that any ownership of a firearm, no matter what type it is, no matter who possesses it, is criminal.

And, on page 22 it states that anyone who lawfully possessed a firearm prior to passage of this bill and fails to register it is in criminal violation, which is a class E felony. I would assume this applies to guns other than handguns, which did not need to be registered beforehand. But, they can’t legally posses those in the first place, per 265.01.

If someone wants to read through the legislation and find where I’m wrong, go for it. I can’t find anything that invalidates the notion that possession of a firearm is now illegal.

They’ve also made it a misdemeanor if you have more than 7 bullets in a magazine. Which is moot, since you aren’t allowed to legally possess a firearm in the first place.

Also, notice that they took away the ability for people to carry any sort of stun gun. Sorry, ladies, if someone wants to rape you, you can’t fight back. Just submit.

Climate Astrology: National Geographic Links Snow And Cold To Globull Warming

If only there was something National Geographic could do to solve this, like not sending teams all around the world using fossil fuels to create programs

Here we go again. The weather’s going to extremes: a snowstorm in Jerusalem, wildfires in Australia, a cold snap in China, a heat wave in Brazil. Based on the first two weeks of the new year, 2013’s picking up right where 2012 left off.

They do realize that it is summer in Australia and Brazil, right? And winter in China and Jerusalem?

As much as 8 inches (20 centimeters) of snow fell on Jerusalem (map) last Thursday, closing roads across the city. It was the biggest winter storm there in 20 years. Scores of trees fell from the weight of the snow, snowball fights broke out in the parks, and Israeli President Shimon Peres was photographed building a snowman outside his residence with help from his bodyguards.

In China, the average temperature fell to 25°F (-4°C) in early January, the lowest in nearly three decades. More than a thousand ships in China’s Laizhou Bay (map) have been frozen into the ice.

National Geographic calls this “the new normal”. I call this bat guano crazy and climate astrology, whereby every weather event is linked to greenhouse gases, even cold and snow. It’s pure idiocy and completely unrelated to actual science. Even if anthropogenic global warming was real, it is not going to cause cold and snow. Only in the warped minds of dogmatic progressives hell bent on pushing their pet cult could warm cause cold.

Oh, and for those who want to discuss 2012 being the hottest since the end of the end of the Little Ice Age (well, after quite a bit of data manipulation. They haven’t deigned to release the raw data), even the Warmists at Grist notice something

Again, just to make the point: The hottest year in American history was one of the coldest worldwide this century.

Yes, yes, we’re talking about this century. And world wide temperatures are up from the end of the LIA (shocker!), because, the Earth is in the midst of a warm period. But, overall, if you want to focus on America, the raw data shows that the 1930’s, before CO2 was above 350ppm, was much warmer than this century.

If you Warmists are really concerned, you will go completely carbon neutral in your own lives. Act like it’s a crisis. You won’t.

Renee Ellmers: Obama Exploiting Tragedy For Political Gain

Nice to see an elected Republican calling it as she sees it and fighting back, instead of the typical mumbling that comes from Republicans

(Daily Caller) “President Obama is once again exploiting a tragedy for political gain and eroding our constitutional rights for the sake of an extreme liberal agenda,” Ellmers said in the statement.

“We need to have a serious discussion on how we can prevent troubled individuals from carrying out their insane intentions. But attacking our legal rights and liberties through abusive executive orders destroys the very principles that have protected our citizens from oppressive government power for over 236 years.”

This was in response to Obama’s “23 directives” and 9 legislative proposals announced Wednesday, as Obama surrounded himself with kiddie shields. And what are those 23 directives? David Weigel at Slate was nice enough to compile them from the White House website (which is replete with more human shields)

  1.  Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.
  2.  Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.
  3.  Improve incentives for states to share information with the background check system.
  4.  Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
  5.  Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.
  6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.
  7. Launch a national safe and responsible gun ownership campaign.
  8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).
  9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.
  10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.
  11.  Nominate an ATF director.
  12.  Provide law enforcement, first responders, and school officials with proper training for active shooter situations.
  13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.
  14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.
  15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies
  16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.
  17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.
  18. Provide incentives for schools to hire school resource officers.
  19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.
  20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.
  21.  Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.
  22. Commit to finalizing mental health parity regulations.
  23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

Exactly what to these accomplish? For the most part, nothing? Many are ways of strengthening ObamaCare and involving it even more in people’s lives. Number 4 would allow for restricting handgun ownership from even more Americans based on the whim of a man who’s department ran guns into Mexico which resulted in the deaths of 200 Mexicans and 2 American federal agents, and then decided to stonewall a Congressional investigation. For the most part, criminals illegally owning guns is ignored.

Then we get his 9 policy recommendations

  • Require criminal background checks for all gun sales. (a.k.a. closing the “gun show loophole.”)
  • Reinstate and strengthen the assault weapons ban.
  • Restore the 10-round limit on ammunition magazines.
  • Protect police by finishing the job of getting rid of armor-piercing bullets.
  • Give law enforcement additional tools to prevent and prosecute gun crime.
  • End the freeze on gun violence research.
  • Make our schools safer with more school resource officers and school counselors, safer climates, and better emergency response plans.
  • Help ensure that young people get the mental health treatment they need.
  • Ensure health insurance plans cover mental health benefits.

Again, none of this offers a way to go after criminals with guns (except after the fact): it puts the burden on law abiding citizens. Oh, and again attempts to strengthen ObamaCare.

Oh, and not one word on the violence emanating from the entertainment and video games industries.

Possible Illegal Alien Busted For Possession Of Scary Weapon

Well, granted, said “scary weapon”, ie, assault weapon, may have been more than legally allowed

(WRAL) Wake County deputies have charged a 19-year-old woman with possession of an assault rifle that investigators believe was used in a double homicide.

Gemby Itzamar Estrada, no address available, was arrested Sunday and charges with possession of a weapon of mass destruction and resisting a public officer. She was being held Tuesday in the Wake County jail under a $10,500 bond.

An arrest warrant states that deputies seized the weapon, a variation of an AK-47, from Estrada’s Raleigh apartment so they could determine if it was linked to “a double homicide and shooting.”

Rather a low bond for someone who possessed a “weapon of mass destruction” (it was possibly fully automatic or had a shortened barrel) and possibly committed murder, wouldn’t you say? Maybe she’s part of Obama’s amnesty program

U.S. Immigration and Customs Enforcement has placed a detainer on Estrada – under the name Itzamar Estrada Gembe – while agents try to determine if she is in the country illegally.

Want to bet there’s no follow-up by the Raleigh media when it’s determined that she is, in fact, an illegal? Oh, and most likely a gang member. Click the WRAL link to view the photo, and notice the 3 dots in a triangle at the corner of her eye. Gang members often tattoo that on themselves. It can have several meanings. One of them is “my crazy life”. Another is where a gangbanger will end up, either the hospital, prison, or the grave. And there are several Hispanic gangs in the Raleigh area, including MS-13, though, they are very weak in this area.

Abnormal frosts and snowfalls registered in the world in recent times are the result of global warming. The earth is getting warm – hence, air acquires more moisture. As a result, there appear high snowfall amounts, and we observe a below normal drop in temperature.

Frosts in California in the USA, snowfalls in the Middle East and abnormal frosts in Siberia in Russia. Although we are halfway through the winter, there are many weather surprises today. Wrapping themselves up in the warm clothes, people begin to strongly doubt whether a global warming is really an accomplished fact. Just for nothing, Head of the Greenpeace Russia energy programme Vladimir Chuprov says.

“It would be more correct to speak about global climate change, not about global warming. There have appeared colder deserts where snowfalls occur. The Gulf Stream is getting cold. That is why many people are deceived. Here one should clearly understand one thing – that winters have become colder and summers – warmer. However, on the average, the temperature is going up.”

In People’s Republik Of California, Teacher Who Appeared In Adult Videos Denied Her Job Back

Liberals are on the forefront of the “if it feels good, do it” attitude. Liberals have created an attitude where pornography is just an expression of sexuality, and should not be condemned, and that “there’s nothing wrong with it”. Yet, there are consequences for expressing that sexuality

(The Blaze) A middle-school science teacher fired after students learned she had appeared in pornographic movies had hoped not just to get her job back, but to set a precedent for people looking to escape an embarrassing personal history. News of the story first broke after the educator was dismissed of her teaching duties in April 2012.

A three-judge commission put a decisive stop to both, saying firmly and unanimously that Stacie Halas should not be in the classroom.

That’s weird. This is the highly liberal People’s Republik of California, where the pornography industry is based, yet this young woman, who only participated in making some videos for 8 months, and not while she was teaching, has lost her job for participating in a legal venture. Where’s the liberal attitude of tolerance? Was she a good teacher? Where are the liberals defending her?

Now, on one hand, she broke no laws. On the other hand, this whole attitude of women showing their bodies off can create problems out in The Real World. While I love sites like The Chive, the attitude of young women taking pictures of themselves in next to nothing isn’t the wisest of ideas. I’m still waiting for the post of “Chivettes Fired From Work”.

It’s interesting to note that in other cases, teachers are damned near impossible to fire. Ones who are abusive, drug users, incompetent, sexually harass students, failing to show up for work. Where’s the liberal teacher’s union? Halas made a mistake then reformed her life.

Sorry, all out of sympathy for her, and most everyone else. After all:

1) I’ve been deemed “an enemy to be punished” because I disagreed over immigration policy with Der Fuhrer.
2) Declared a racist because I don’t believe in borrowing trillions for political paybacks and Believe people should get what they earn
3) Believe that it’s wrong to hire govt officials to steal other people’s money just to give to me
4) Declared to want kids dead because I believe in the 2nd amendment
5) Called an “extremist” because I have principals and won’t negotiate on just anything that comes along
6) Viciously attacked because I’m straight
7) Called innumerable obscene names by the intolerant Progressive Left because I’m conservative

Note that none of what I did was ever illegal or even really immoral, just that I expressed a legitimate difference of opinion. Too bad, Tiffiny! (Halas’ screen name was “Tiffany Six”)

Further comments go on to point out that liberals have forgiven lefties like Marion Berry. Remember that they had no problem with a sitting president having adulterous sexual relations with a woman young enough to be his daughter in the Oval Office, along with credible complaints of sexual harassment and rape.

Oregon Sheriff Says Won’t Enforce Un-Constitutional Gun Laws

I hope Sheriff Tim Mueller understands how much vitriol is going to come his way from the tolerant and peaceful liberals

(Daily Caller) An Oregon sheriff has sent a letter to Vice President Joe Biden saying his department will not enforce any new gun laws it considers unconstitutional.

Linn County Sheriff Tim Mueller, in his letter dated Monday, said politicians are “attempting to exploit the deaths of innocent victims” by supporting laws that would harm law-abiding Americans. The sheriff said he took an oath to support the Constitution, and laws preventing citizens from owning certain semi-automatic firearms and ammunition magazines would violate their rights.

“We are Americans,” Mueller wrote. “We must not allow, nor shall we tolerate, the actions of criminals, no matter how heinous the crimes, to prompt politicians to enact laws that will infringe upon the liberties of responsible citizens who have broken no laws.”

He further goes on to write:

In summary, it is the position of this Sheriff that I refuse to participate, or stand idly by, while my citizens are turned into criminals due to the unconstitutional actions of misguided politicians.

It would be nice if more elected public officials would take a stand to uphold and protect the Constitution. Liberals won’t. The ACLU won’t. President Obama won’t. Democrats won’t. Some Republicans won’t.

Now it’s time to wait and see what (NMP) Obama will announce when he finally deigns to show up for his own press conference today. According to the Seattle Times (and many other outlets), what he will announce will be

According to a lobbyist briefed Tuesday, Obama will present a three-part plan focused on gun violence, education and mental health. He’ll call for:

– A focus on universal background checks. Right now some 40 percent of gun sales take place without background checks, including by private sellers at gun shows or over the Internet, according to the Brady Campaign to Prevent Gun Violence. (I think most of us can agree to this)

– A ban on assault weapons and limiting ammunition magazines to 10 rounds or fewer. (it’ll never pass Congress, and will give Obama a way to demonize Republicans)

– A federal statute to stop “straw man” purchases of guns and crack down on trafficking rings. (Now that’s funny, considering agencies within the Obama were making straw purchases during Fast and Furious)

– More anti-bullying efforts; more training for teachers, counselors and principals; and funding for schools for more counselors and resource officers. (In other words, he wants to funnel more money towards teacher’s unions)

Obama also will order federal agencies to conduct more research on gun use and crimes, the lobbyist said, something Republican congressional majorities have limited through language in budget bills.

But will any of this stop violent criminals from obtaining guns and using them? You’ll weed out a few through background checks, but, that only applies to handguns, not rifles and shotguns. Instead of buying “scary looking” rifles, people could purchase the exact same thing in non-scary looking manner. You can easily purchase rifles in .223, same as the Ar-15, that do not have a pistol grip and aren’t painted black.

I’ll be interested to see if Obama proposes anything that goes after criminals during his stern lecture that will surely demonize legal gun owners, while armed men and women look on from the background.

(Washington Examiner) Carney said that the president will be joined by Vice President Joe Biden as well as children who wrote to the president after the Newtown shootings.

“They will be joined by children around the country expressing their concerns about gun violence and school safety, along with their parents,” Carney confirmed. (See video of Carney’s remarks here.)
