California says Trump’s deployment of National Guard violates state sovereignty
California is suing to reverse President Donald Trump’s deployment of the National Guard to Los Angeles, arguing that the use of the military to suppress immigration protests is an illegal and unconstitutional intrusion on state authority.
Trump’s deployment of as many as 4,000 National Guard troops has sapped the state of crucial emergency resources and came without consultation with Gov. Gavin Newsom, according to the 22-page lawsuit, filed Monday afternoon in federal court in San Francisco.
Though Trump initially declared his intent to send 2,000 troops to L.A., both the lawsuit and Newsom himself suggested he had revealed plans to double that number to 4,000. And just before the lawsuit was filed, Trump ordered 700 Marines to L.A. to support the Guard troops.
The absence of consultation, California’s attorneys say, makes Trump’s deployment unlawful. The lawsuit echoes Newsom’s comments earlier Monday in an interview with POLITICO.
“There was no communication through our office, period, full stop. So, by definition, it’s an illegal act,” Newsom, a Democrat, said, adding that the president failed to meet other key prerequisites for the deployment.
Well, you know that Gavin is going to find a friendly liberal judge to rule in his favor, then it is going to have to go through appeals and such, and, by that time, ICE will have concluded their operations. I wonder, though, where were all these sovereignty folks when Biden was jamming all sorts of restrictions on COVID down our throats? And other things?
A White House spokesperson said the California governor should thank Trump “for restoring law and order.”
“Gavin Newsom should march back to his Attorney General’s office to prosecute the anti-ICE rioters who burned property and looted businesses in Los Angeles. It’s pathetic that Newsom is more focused on saving face than protecting law enforcement and holding criminals accountable,” White House spokesperson Anna Kelly said.
The best part is that these are Democrats burning and destroying Democrat stuff in a Democrat city.
