DOJ Threatens To Pull Funds From States That Do Not Report Their Illegal Alien Residents

DOJ says states must report all undocumented immigrants — or lose federal funds

The Justice Department has adopted a sweeping new legal interpretation designed to compel states to assist the Trump administration’s immigration crackdowns.

The new opinion from the department’s Office of Legal Counsel — which provides advice to the attorney general — outlines a new path for the federal government to yank federal funding from states that don’t aid the administration’s mass deportation push.

It says any state that draws on massive federal programs to provide financial assistance to low-income residents — which every state does — must report to the Trump administration any immigrant it believes is residing in the country illegally.

Prior administrations concluded that the requirement to report known undocumented immigrants applied only to state agencies implementing those federal programs.

But the new opinion instead determined that the reporting requirement extends to the entire government of a state receiving federal funding through either the Temporary Assistance for Needy Families program or Supplemental Security Income — two enormous safety net programs for low-income families as well as elderly and disabled residents.

“Congress wrote this requirement plainly,” Assistant Attorney General T. Elliot Gaiser said in a statement. “When a state chooses to participate in TANF, it accepts the obligation to report illegal aliens in the United States. Tax dollars intended to help vulnerable Americans should not perversely encourage illegal entry into the United States, but rather should reinforce our laws and our borders.”

Oh, this is going to cause massive teeth gnashing from the moonbats, eh? Of course, yeah, some wacko liberal judge, probably one of the same old same old ones, will rule against this, be reminded they can only speak for their own district, then get reversed on appeal

I doubt they will actually do this, but, I wouldn’t be surprised if ICE agents in full ICE apparel show up around some polling places in the first days of early voting, simply to discourage illegals from showing up. That’s really what this is about.

Is Data Center Hatred Being Driven By Climate Cult Zealots?

I’m rather agnostic on the issue of data centers, but, really, the US is going to build them or China will have them all. And, certainly, there is some opposition amongst Republicans. But, among Democrats, there seems to be some serious hatred

Inside the far-left’s anti-data center push and what experts say is driving it: ‘Playbook we’ve seen before’

As the development of data centers continues to grow into one of the top hot button political issues in the United States, some experts are sounding the alarm on the various left-wing groups and climate activists who are pouring money and resources into data center opposition campaigns.

“It’s a playbook we’ve seen before,” Larry Behrens, communications director at Power The Future, told Fox News Digital in an interview.

“I think Americans saw this with the Dakota Access Pipeline. They see this with oil or natural gas production within the United States. This seemingly grassroots organization pops up, but yet they’re all wearing the same T-shirts. They’re all singing the same playbook, and they’re only carrying the same signs, and so when we see that, we see that that’s not really a grassroots organization that money is coming from somewhere, and in this case, against data centers.”

Several left-wing organizations backing data center opposition have benefited from major progressive funding networks, including Public Citizen, which has listed George Soros’ Open Society Foundations among foundations whose “generous support” makes its work possible, and the Sierra Club, which received $3.6 million from Arabella Advisors’ Sixteen Thirty Fund between 2014 and 2022.

This explanation goes on for a bit, where even wacko anti-war groups like Code Pink (which disappeared during the Obama and Biden years) are involved, where the groups pushing ICE hatred and “No Kings” (weird, because the “king” is allowing them to protest) are backing data center hatred. Even as they all use vast amounts of data, making the data centers necessary.

The main driver of left-wing groups opposing data centers, in addition to ideological disdain toward President Donald Trump, who has been a staunch supporter of American AI dominance, is the opposition to fossil fuels, Behrens says.

“It’s the same thing that they’ve always opposed, any real progress they’re going to be against, anything that strengthens America, they’re gonna be against, and when it comes to data centers, the reason they’re against them is absolutely clear because it represents American jobs, and it has to be supported by American energy,” Behrens explained.

“And those are two things that the environmental left just absolutely cannot stand. And they’re gonna use delay or distracting tactics. They’re gonna use tactics like saying it’s about the water, it’s about land use. But lo and behold, when it comes time to grow cannabis, they’re more than happy with the water use. When it comes time to plaster solar fields across farmland, they don’t care about land use. When it comes time to put their solar fields across an endangered species area, they don’t care about that endangered species. It’s never what they say it’s about, it’s always against progress and production for American energy and American workers really.”

Is that the case, or, just that these are simply fellow travelers, because most on the Left are nutballs

In a recent Fox News Digital op-ed, Consumers’ Research Executive Director Will Hild made the case that data center developers ignoring the concerns of the consumers’ has been a problem that could cost the United States victory in the AI race.

“Climate radicals who spent decades trying to kill fracking, pipelines, and American energy dominance have found their next target,” Hild told Fox News Digital. “They are hijacking legitimate consumer concerns to fuel a massive disinformation campaign aimed at frightening Americans into shutting down the technology infrastructure. The same activist machine that fought American oil and gas is now mobilizing against modern data centers, because its answer to American innovation is always to stop building begins.”

It is true that the cultists do like taking over every issue.

Yes, it is over 40 years beyond when the US should have been taking Iran to task, but, as many have pointed out, the Trump administration probably thought there would be a complete revolt in Iran if we bombed the big wigs, but, the crackdown by the Iranian regime ended that. President Donald Trump threatens in one moment to slowly asphyxiate Iran’s economy and, in the next, to quickly bomb them into submission.

Republicans who disagree which option is correct are still united on one thing: They’re over Trump’s seeming indecision. (snip)

Anonymous. I’m sure there was a plan, but, it quickly died. It may well be some sort of plan for the whiplash of intention, but, they won’t tell us because then Iran would know.

One GOP strategist likened Trump’s Iran predicament to being stuck in the “friend zone.”

“He can’t stay on message or stick to a coherent, disciplined strategy, because he feels trapped now,” said one person close to the White House. “Trump realizes the political peril but can’t figure out a face-saving way to end the conflict. The Iranians clearly know this reality, too.”

And while Trump insists politics do not play into his calculus, there is a growing “time to move on” sentiment inside the White House, according to an oil industry executive familiar with internal discussions.

So, no one is willing to go on the record? How do we analyze these statements if we do not know who they are and where they are? We can’t deliberate? Evaluate? Scrutinize? But, that’s not the point, as you surely know, it’s to simply run with TDS. The so-called Fever Swamps. Anything like the above reminds me of this old Washington Post article from 2006

New York Looking At Options After Judge Strikes Down Their Climate (scam) Super Fund Scheme

N.Y. leaders react to federal judge striking down Climate Change Superfund Act

Gov. Kathy Hochul said New York state is “looking” at its “options of appeal” after a federal judge struck down the state’s Climate Change Superfund Act saying it is preempted by the federal government’s Clean Air Act.

Hochul signed the Climate Change Superfund Act into law in 2024.

The judge’s decision means New York cannot impose strict liability on energy companies for their alleged contributions to global greenhouse gas emissions.

Democratic New York state Sen. Liz Krueger initially sponsored the bill in the state Legislature.

Krueger said she was “expecting it to go this way.”

“We feel very strongly the attorney general needs to appeal this to a higher court, and we believe that we will win,” said Krueger.

Wait, they passed the law always expecting it to be shot down by a judge because it was, among other things, un-Constitutional? The judge involved, Chief U.S. District Judge Brenda Sannes, was an Obama appointee, so, it’s not like she was an arch-Conservative. Is Krueger saying she wanted to waste a lot of money on fighting in court on a wing and a prayer that it wins on appeal?

Environmental advocates share that while this is the decision in this case, there are multiple legal challenges that still have to be decided.

“There’s another case in the Southern District of New York brought by the Trump administration,” said Jon Binder, executive director of the Model Climate Laws Initiative for Environmental Advocates NY. “This case was in the northern district of New York brought by a bunch of red states and business groups. There’s also a case in Vermont that’s pending. So, we still have to see what happens in those cases. There’s lots of additional legal steps.”

Remember, climate cultists will never give up on trying to force Other People to comply with their dogma. Even though most of the Warmists do not give up their own use of fossil fuels.

Cool: DHS Arrest Thousands Of Illegals In New York

U.S. Announces Thousands of Arrests in New York Immigration Operation

Homeland Security Secretary Markwayne Mullin announced Tuesday that immigration officials had arrested 2,197 people in New York State in about a monthlong operation, suggesting an uptick in arrests compared with recent months.

Speaking at a news conference, Mr. Mullin described the enforcement push as a response to the lack of cooperation from Gov. Kathy Hochul and Mayor Zohran Mamdani on the federal government’s crackdown on unlawful immigrants, which it has named “Operation Rotten Apple.”

“Operation Rotten Apple was an operation we decided to take on because you have a very liberal-slash-socialist mayor here in New York City,” he said. “You have a governor that refuses to work with us.” (snip)

Homeland security officials on Tuesday emphasized that the operation was “not random enforcement” and that they were catching the “worst of the worst” criminals. But as ICE arrests have climbed in recent months, the agency’s operations have increasingly swept up immigrants without criminal records. A majority of the immigrants arrested in July were accused of violating civil immigration laws but had not been charged with or convicted of a crime, a New York Times analysis of federal data found.

Well, bummer, perhaps the Biden regime and the Democrat states and cities shouldn’t have been registering illegal aliens, which makes it super easy for immigration agents to show up where they are and detain them. And if the ones without serious criminal charges and convictions are scooped up, well, bummer, federal law says they should not be here.

At the news conference, Mr. Mullin was flanked by what appeared to be large mug shots with phrases such as “rape” and “kidnapping, murder,” and a Homeland Security news release said that those arrested in the operation included “murderers, rapists, pedophiles, drug traffickers and violent assailants.” But Mr. Mullin also indicated that some of those arrested in the past month may not have had criminal records.

“Regardless if you’re a criminal or not, if you entered this country and you cheated, you didn’t come in the legal way, because there are people entering this country every single day legally,” he said.

That’s it. There should be no further article. The law is the law.

In response to a follow-up message from The Times, the department did not offer further clarity. Ms. Hochul, speaking at an unrelated news conference Tuesday, cast doubt on whether the more than 2,000 people arrested in the operation had criminal records.

“There is no way that that number constitutes people committed crimes the way we consider a crime — a crime in New York State,” Ms. Hochul said. “They consider anybody who crossed the border a criminal, so don’t fall for that. That’s what I’m calling out. Do not fall for that.”

The law considers them a criminal and the penalty is deportation.

Mr. Mamdani, appearing alongside the governor, accused ICE of terrorizing immigrants and said the agency was criminalizing “the very act of being an immigrant.”

“We are proud as New York City to be a city that has sanctuary policies,” Mr. Mamdani said. “These are policies that used to be defended by Democrats and Republicans alike. These were policies introduced to ensure every New Yorker would feel comfortable coming forward to report crimes as well.”

This is just insane.

‘Stop doing memes’: Carney urges US to drop theatrics

Prime Minister Mark Carney still sees a path to a mutually beneficial trade deal with the U.S. — once Washington stops playing games.

Carney said any deal with the U.S. “must” recognize Canadian sovereignty, which includes respecting the French language and Quebec culture.

“When the Americans stop doing memes, stop throwing shade, stop trying to be tough and start being serious about having those discussions — we can have those discussions,” Carney said to reporters on Tuesday.

“But look, it’s not constructive, but that’s their democracy,” he added.

Seriously, once you start whining down this path you’ve already lost.

Federal Judge Temporarily Blocks Virginia’s Law On ICE Cooperation

(WRIC) A new law regulating how Virginia’s local law enforcement agencies participate in immigration enforcement alongside U.S. Immigration and Customs Enforcement (ICE) has been temporarily blocked by a federal judge.

Multiple new laws regulating ICE enforcement in Virginia have faced legal challenges from the U.S. Department of Justice (DOJ) in recent months.

On Monday, Aug. 31, a federal judge granted an injunction temporarily blocking a law involved in one such lawsuit. This injunction will keep the law from being enforced as the legal process plays out.

Companion bills SB 783 and HB 1441 placed constraints on Section 287(g) agreements within the state. These agreements allow law enforcement agencies to assist ICE in immigration enforcement.

This is different from simply having a working relationship with ICE and complying with ICE investigations, which all agencies are expected to do. Instead, 287(g) agreements allow law enforcement to actively participate in immigration enforcement.

Under this new law, Virginia’s local and state agencies cannot maintain, renew or enter into any federal immigration agreement unless it meets certain conditions. Law enforcement is also barred from assisting in immigration operations unless presented with a valid judicial warrant, subpoena or detainer.

The federal judge stated that Virginia was violating the Constitution in multiple ways, and was overriding federal authority. This is just preliminary, stopping the law from taking effect, but, it sure looks like Virginia will lose. Don’t forget, a goodly chunk of the counties in Va. are Republican, it’s just the populations of liberals in small areas like northern Va near DC that make the state “Democrat”.

And, yes, there is some cooperation between law enforcement and ICE even in those heavily Democrat areas

Undocumented immigrant convicted of groping girls at Virginia high school released to ICE custody

An undocumented immigrant who was convicted of groping girls at a Northern Virginia high school has been released into the custody of ICE, according to the Fairfax County Sheriff’s Office.

What we know: In early March, Israel Flores Ortiz, 19, was accused of groping several of his classmates after officials at Fairfax High School reported multiple cases of assault. A police investigation revealed Ortiz had assaulted numerous girls at the school.

He was convicted of 9 counts of assault and battery, after coming behind females in school and “grabbing them between the legs.” He ended up serving just 140 days for these assaults on minors. He was an illegal who came into the US in 2024, and was then dropped into high school.

Oops: Judge Shoots Down New York’s Climate Superfund Law

New York cannot enforce $75 billion climate ‘superfund’ law, US judge rules

A federal judge ?ruled on Monday that New York cannot enforce a 2024 state law that sought to force fossil fuel companies to contribute $75 billion over 25 years into a fund to pay for damage caused by climate change.

Chief U.S. District Judge Brenda Sannes in Syracuse, New York sided, opens new tab with 22 Republican ?state attorneys general, as well as industry groups including the U.S. Chamber of Commerce, in finding the state ?measure preempted by federal law.

Sannes, an appointee of Democratic President Barack Obama, said the Clean Air ?Act, which gave the federal Environmental Protection Agency authority to regulate carbon-dioxide emissions, did not authorize states to adopt emissions ?compensation schemes such as New York’s.

She said enforcing New York’s Climate Change Superfund Act risked upsetting the balance between preventing global ?warming, “a project that necessarily requires national standards and global participation,” and promoting economic growth, energy production, foreign policy interests and national security.

“The Climate Act conflicts with the overriding need for a uniform rule of decision on matters influencing national energy and environmental policy, and basic interests of ?federalism,” she wrote.

There are no reports about NY appealing this, but, hey, even the speaker of the NY assembly was against it back in 2024. That said, I was actually hoping that the courts would let the law stand long enough to see Consequences happen to the citizens of NY, let them see what their own votes wrought.
