N.Y. leaders react to federal judge striking down Climate Change Superfund Act

Gov. Kathy Hochul said New York state is “looking” at its “options of appeal” after a federal judge struck down the state’s Climate Change Superfund Act saying it is preempted by the federal government’s Clean Air Act.

Hochul signed the Climate Change Superfund Act into law in 2024.

The judge’s decision means New York cannot impose strict liability on energy companies for their alleged contributions to global greenhouse gas emissions.

Democratic New York state Sen. Liz Krueger initially sponsored the bill in the state Legislature.

Krueger said she was “expecting it to go this way.”

“We feel very strongly the attorney general needs to appeal this to a higher court, and we believe that we will win,” said Krueger.

Wait, they passed the law always expecting it to be shot down by a judge because it was, among other things, un-Constitutional? The judge involved, Chief U.S. District Judge Brenda Sannes, was an Obama appointee, so, it’s not like she was an arch-Conservative. Is Krueger saying she wanted to waste a lot of money on fighting in court on a wing and a prayer that it wins on appeal?

Environmental advocates share that while this is the decision in this case, there are multiple legal challenges that still have to be decided.

“There’s another case in the Southern District of New York brought by the Trump administration,” said Jon Binder, executive director of the Model Climate Laws Initiative for Environmental Advocates NY. “This case was in the northern district of New York brought by a bunch of red states and business groups. There’s also a case in Vermont that’s pending. So, we still have to see what happens in those cases. There’s lots of additional legal steps.”

Remember, climate cultists will never give up on trying to force Other People to comply with their dogma. Even though most of the Warmists do not give up their own use of fossil fuels.

    In February 2026, EPA Administrator Lee Zeldin, alongside President Trump, announced the elimination of the 2009 Greenhouse Gas Endangerment Finding (until January 2029).

    So they’ve gutted the Clean Air Act, but are relying on the Clean Air Act to dirty New York? Clever girls!!

    As Lord Eddard Stark would say, “Winter is coming.” The primary home heating fuel in the Empire State is natural gas, used in roughly 61% of homes. Electricity comes in second at 16 to 18 percent, followed by heating oil/kerosene at 14 to 15%. About 5% use propane, while wood makes up a small percent.

    For those using sparktricity to heat their homes, 39 to 42% of the state’s electricity generation comes from plants using natural gas as a fuel.

    Economics 101: New York trying to force fossil fuel companies to pay big bucks to the state means that the people in that cold-winter state will have to pay a lot more to heat their homes. Of course, the people running the government don’t give a f(ornicate) about the public, because they all have plenty of money, and they figure that the voters aren’t smart enough to figure that out. The majority of the state’s voters being Democrats, the politicians are probably right that the voters are too stupid to figure things out.
