NC AG Josh Stein Refuses To Enforce NC Law On 20 Week Abortion Ban

If Stein doesn’t feel like enforcing a law passed by the duly elected General Assembly and signed into law by the duly elected governor, then he should resign. But, Democrat always seem to think they do not have to enforce laws they do not like

NC attorney general won’t move to enforce state’s 20-week abortion ban

North Carolina Attorney General Josh Stein said Thursday that he won’t work to enforce the state’s 20-week abortion ban, defying Republican lawmakers who have pressed him to do so as part of a long-running court case.

The state has a decades-old law banning abortions after 20 weeks of pregnancy, with exceptions for medical emergencies. But that hasn’t been enforced because of a federal court injunction barring the state from doing so.

With the U.S. Supreme Court’s decision last month to overturn the landmark Roe v. Wade abortion case, the 20-week law is widely expected to go into effect. But there’s a procedure to follow first, and it would normally include the attorney general asking the court to reconsider the injunction.

On Thursday, Stein said he wouldn’t do that. “The Department of Justice will not take action that would restrict women’s ability to make their own reproductive health care decisions,” Stein, a Democrat and expected candidate for governor in 2024, said in a news release. “Protecting that ability is more important than ever, as states across the nation are banning abortions in all instances, including rape and incest.”

Chapter 114 of NC law as passed by the General Assembly, which was given authority to create, among other things, the office of the Attorney General, requires the AG to enforce all NC laws. Huh. Might be looking at an impeachment proceeding the first time he blows off prosecution.

GOP lawmakers previously said that if Stein doesn’t act in the court case, they will. Speaker of the North Carolina House of Representatives  Tim Moore, in a statement Thursday, accused Stein of disregarding his oath to defend North Carolina laws and said Republican leaders are “exploring all options to defend the law and protect life in North Carolina.”

“Despite his faux outrage, Josh Stein knows full well that the 20-week ban on the books does not limit women’s freedom, but protects the unborn when they are capable of feeling pain in the womb,” Moore said.

Does the GA want to spend time impeaching Stein? That’s the question.

Although currently legal in North Carolina, abortions after 20 weeks of pregnancy are rare. Nearly 70% of abortions performed on North Carolina residents in 2020 came before the eighth week, according to Department of Health and Human statistics. Roughly 48 abortions, or 0.2%, came after the 20-week mark that year, the statistics show.

Hmm, if most came by 8 weeks, why are the abortion on demand supporters so worked up by the 20 week ban?

Forced-birther Teach: if most came by 8 weeks, why are the abortion on demand supporters so worked up by the 20 week ban?

If a fertilized egg is a person why is Teach accepting a 20 week ban?

Over 90% of abortions are performed by 13 weeks gestation.

48 abortions, or 0.2%, came after the 20-week mark that year

There was no breakdown regarding the reason for those abortions. Most often prompted by health of the mother, an already deceased fetus etc.

      Dear Elwood:

      The facts are simple.

An elected AG is publicly refusing to enforce a law.

      A LAW

This follows the no bail, no arrest for shop lifting, etc., etc. that we are seeing across the US.

Get yourself a weapon, Elwood, and learn how to protect yourself. Free home invasion is on the horizon.

      • Elwood P. Dowd says:

We acknowledge your paranoia, and thanks for the advice, but we possess some twenty firearms here at Chez Elwood.

Frankly, we’re more concerned with the authoritarian takeover of the US than with violent crime.

Do you sit around your home with an AR-15 handy, hoping for a “feral animal” to invade your space?

Attorneys General and prosecutors can exercise discretion. Even the US Attorney General doesn’t “enforce” every federal law.

        • James Lewis says:

          Dearest Elwood:

I am greatly relieved to read that you have an arsenal of weapons available for your defense. I can only hope that you know how to effectively use at least one of them and have the balls to pull the trigger when attacked. (Many people do not, even when faced with immediate danger.)

We see the current crime wave as an authoritarian attempt by the Far Left, and their fellow travelers, AKA RINOS. I give you the attack on the Repub candidate for NY guv being released without bail as a perfect example.

NC’s AG’s actions are not discretion but rather a “fuck you” middle finger to the citizens of NC. You know that. So don’t BS us, dearest Elwood.

I’m not as armed as you, having only a 22 caliber rifle and a 20 gauge short barrel pump at my disposal. Perhaps you can lend me a 38 revolver on a person to person “lend lease” plan? I promise to keep it in good condition and only use it if someone breaks into my home with me and family inside.

          • Elwood P. Dowd says:

No need to worry about my balls.

But honestly, my guns are for hunting and collecting.

I do have a Colt 38 Army Special, but your lower recoil 20G pump is a better home defense gun.

The NC Legislature is one of THE most gerrymandering in the whole country statewide officers are definitely going blue but tge legislature because of gerrymandering stays heavily red.
Teach Do you approve of gerrymandering districts?

    Dearest Elwood:

    Hunting and collecting?

    No self defense????

Now I do worry about your balls.

    • Elwood P. Dowd says:

Tell us about your strategy for home self-defense. We assume you don’t carry your 20G out with you. Do you keep the loaded shotgun close at all times? Do you have any children that visit?

Have you ever had someone break in? We haven’t. Decades ago I WAS carjacked at gunpoint but me having a pistol would have done no good. The carjackers were caught within minutes and pleaded guilty.

I have a Glock 19, loaded next to my bed with a wall mount. I simply have to tap a couple of touchpad keys and pull the gun from its mount. Totally safe for children to play in the room.

I carry my Sig Sauer concealed at all times including a spare magazine whenever I go anywhere near the front door of my home. Why do I do this? George Soros and DA’s he has installed around the country are inciting violence against law-abiding citizens and Democrats who actively cut the budgets of hundreds of police forces around the country making it unsafe for the general public.

Now for some bias in the news.

        Yahoo sez:
using information from the national fraternal order of police and conversations with a number of police departments, 24/7 found nearly 50 cities and towns that either considered dismantling or have indeed cut their forces.

FORBES SEZ: At least 13 U.S. cities have cut funding from police department budgets or decreased officer numbers with several more in the process amid a national reckoning over systemic racism and police brutality, according to a Forbes tally.

The GUARDIAN SEZ: · New York, Los Angeles, Chicago, Seattle, Milwaukee, Philadelphia, Baltimore and a dozen other cities have all also reduced police spending.

Is it 50 or 13 or 19? The list is actually over 1300 as police officers from around the nation have retired early, quit, or been fired and not replaced. America is less safe. Hundreds of illegals allowed into this country are actually gang members of the very dangerous Cartels and MS-13. Drugs flood our borders and a 100 thousand plus Americans die each year from drug overdoses aided directly by Democratic Policies.

Yes Home defense is a must in a world obsessed by a violent cultural revolution instigated by China and supported whole heartedly by ignorant Democrats for votes.

I doubt you were carjacked. Every person I know who has been the victim of a violent crime has home defense of some kind.
