Lawsuit Against Rummy Dismissed. Take That!

Good to read that there are some judges in this country who aren't complete moonbats

WASHINGTON (AP) – Former Defense Secretary Donald H. Rumsfeld cannot be tried on allegations of torture in overseas military prisons, a federal judge said Tuesday.

U.S. District Judge Thomas F. Hogan threw out a lawsuit brought on behalf of nine former prisoners in Iraq and Afghanistan. He said Rumsfeld cannot be held personally responsible for actions taken in connection with his government job.

The lawsuit contends the prisoners were beaten, suspended upside down from the ceiling by chains, urinated on, shocked, sexually humiliated, burned, locked inside boxes and subjected to mock executions.

Lawyers for the American Civil Liberties Union and Human Rights First had argued that Rumsfeld and top military officials disregarded warnings about the abuse and authorized the use of illegal interrogation tactics that violated the constitutional and human rights of prisoners.

"Despite the horrifying torture allegations," Hogan wrote, he could find no case law supporting the lawsuit, which he previously had described as unprecedented.

I wonder when the ACLU and Human Rights First will bring lawsuits against Osama Bin Laden, Al Qaeda, and the Taliban. How about against the PLO, Hamas, and Hezbollah? Yeah, right, that'll happen.

Allowing the case to go forward, Hogan said in December, might subject government officials to all sorts of political lawsuits. Even Osama bin Laden could sue, Hogan said, claiming two American presidents threatened to have him murdered.

"There is no getting around the fact that authorizing monetary damages remedies against military officials engaged in an active war would invite enemies to use our own federal courts to obstruct the Armed Forces' ability to act decisively and without hesitation," Hogan wrote Tuesday.

I have to tell you, after dumpster diving all these years at places like Kos, the DU, the Huff Post, etc, there is nothing more that they would like, other then a Constitutional Amendment which is pro abortion on demand, then to allow terrorists and enemies to sue our military and political leaders in our courts. I mean, all neocons are Nazi's, right?

  • "US Court", as if that term still has credibility. Let's see that weasel take a vacation to Europe and see what happens.
  • No surprise here, only time in history any war criminals are ever brought too any form of justice is when caught off their native soil, or if the regime/government they acted with is defeated in a war, or if the country of their origin declines too the point they cannot protect them, and not likely any of these things will happen before Rumsfield meets his true justice before his maker {god} and great irony there is no amount of money, political clout, friends in high places can affect that judgment and it is a eternal punishment and like all "biblical goats" Rumsfield and his ilk see no wrong or evil in their sins, they see themselves as saintly god like characters above the law of man, but gods law is one they cannot evade forever..!
  • We need to set up something like a "Simon Wiesenthal Institute" in this country like was set up in Europe after WWII for the purpose of advocating for the prosecution of Nazi leaders involved in human rights violations. Such an organization would advocate for the prosecution of people like Rumsfeld and track fugitives who been involved in similar activities while in the Bush Administration.

I think I can stop on that last comment. Lefties do not want to go after leaders like Chavez and Ahmadinejad (easier to just call him Sneezy), who viruently have the United States, and are threats, but, Americans? Kill them.
