Anyone in Durham heard of the Constitution? (via WRAL)

Durham police collected more than 500 derogatory pamphlets that were distributed across the city early today.

Corporal Scott Baker with the Durham Police Department says the leaflets contained material against blacks, Jews and immigrants.

He says there didn’t appear to be any threatening material in the literature and there was no apparent connection to allegations by a black woman that she was raped by white lacrosse players.

The police were then directed to preceed with the time wasting effort of going to pick up the literature, rather then, say, stopping crime.

As distasteful as the flyers may be, aren’t they free speech? They didn’t threaten anyone. So why were they picked up? What if someone is arrested for them? Will the ACLU jump in to protect that person or persons 1st Amendment Rights?

Update: The Commissar says that we should just repeal the First.

    I’m with you here Teach. Unless there is a threat involved, or incitement, they should leave it alone.
    An interesting twist. There was a bit of uproar in Washington State about the Nazi party signing on for one of those highway cleanup signs. People were enraged. What did this say about their community!
    Well what does it say? That there is a group of intolerant people living there? Both sides are apparently intolerant. And the signs are just advertising and exercising one group’s free speech rights.

    There are certainly things I do not want to see or hear, but, yup, if there is no threat, that is their Right, even if it is wackjobs like the Nazi’s or KKK.
