E.J. Dionne Works Hard To Spin A Possible Defeat Of The Individual Mandate

As we await the decision from the Supreme Court regarding the Mandate, and perhaps even the striking down of Obamacare, liberals are searching hard for ways to show that the problem wasn’t the law, but with the people who rule on the law. I highlighted a bit of that yesterday. And here comes ultra-liberal E.J. Dionne, who attempts to paint the conservatives on the court as “activists”

Three days of Supreme Court arguments over the health-care law demonstrated for all to see that conservative justices are prepared to act as an alternative legislature, diving deeply into policy details as if they were members of the Senate Health, Education, Labor and Pensions Committee.

Senator, excuse me, Justice Samuel Alito quoted Congressional Budget Office figures on Tuesday to talk about the insurance costs of the young. On Wednesday, Chief Justice John Roberts sounded like the House whip in discussing whether parts of the law could stand if other parts fell. He noted that without various provisions, Congress “wouldn’t have been able to put together, cobble together, the votes to get it through.” Tell me again, was this a courtroom or a lobbyist’s office?

It would be a courtroom on a complicated issue, E.J. Courtrooms are a wee bit different in real life than what you see on Law and Order and other criminal shows on TV. Especially when one is arguing constitutionality.

It fell to the court’s liberals — the so-called “judicial activists,” remember? — to remind their conservative brethren that legislative power is supposed to rest in our government’s elected branches.

Justice Stephen Breyer noted that some of the issues raised by opponents of the law were about “the merits of the bill,” a proper concern of Congress, not the courts. And in arguing for restraint, Justice Sonia Sotomayor asked what was wrong with leaving as much discretion as possible “in the hands of the people who should be fixing this, not us.” It was nice to be reminded that we’re a democracy, not a judicial dictatorship.

So, it’s cool when the Liberal justices stray down the same “activist” roads. Gotcha. Anyhow, it’s good to know that one of the supposedly premier Washington Post writers doesn’t understand that we are a Republic, not a democracy. I wonder what E.J. would say about “judicial dictatorship” regarding Roe v. Wade, considered to be the worst, most unjudicial decision ever?

The conservative justices were obsessed with weird hypotheticals. If the federal government could make you buy health insurance, might it require you to buy broccoli, health club memberships, cellphones, burial services and cars? All of which have nothing to do with an uninsured person getting expensive treatment that others — often taxpayers — have to pay for.

Except, that is a central point of the argument: can the government force commerce? Has E.J. been paying attention at all to the case?

The irony is that if the court’s conservatives overthrow the mandate, they will hasten the arrival of a more government-heavy system. Justice Anthony Kennedy even hinted that it might be more “honest” if government simply used “the tax power to raise revenue and to just have a national health service, single-payer.” Remember those words.

Hmm, that sounds like liberal judicial activism. Anyhow, let’s wrap this up

This is what conservative justices will do if they strike down or cripple the health-care law. And a court that gave us Bush v. Gore and Citizens United will prove conclusively that it sees no limits on its power, no need to defer to those elected to make our laws. A Supreme Court that is supposed to give us justice will instead deliver ideology.

In my post yesterday, Bush v. Gore was mentioned. Now we have E.J. doing the same. I’ve seen references to it around the Web. It looks like Liberals are getting their talking points together, and will reference that ruling constantly.

But, the Supreme Court is not supposed to give us “justice”, at least not only: one of it’s purposes was to be a check against  the powers of the Legislative and Executive branches, to make sure they stay within the framework of the Constitution. Why do conservatives constantly have to teach liberals these things?

What Does The New Zimmerman Video Show?

Is this a smoking gun that there was no fight, that Zimmerman, and a witness, lied about a scuffle?

(ABC News) The surveillance video, which was obtained exclusively by ABC News, shows Zimmerman arriving in a police cruiser. As he exits the car, his hands are cuffed behind his back. Zimmerman is frisked and then led down a series of hallways, still cuffed.
Zimmerman, 28, is wearing a red and black fleece and his face and head are cleanly shaven. He appears well built, hardly the portly young man depicted in a 2005 mug shot that until a two days ago was the single image the media had of Zimmerman.

The initial police report noted that Zimmerman was bleeding from the back of the head and nose, and after medical attention it was decided that he was in good enough condition to travel in a police cruiser to the Sanford, Fla., police station for questioning. His lawyer later insisted that Zimmerman’s nose had been broken in his scuffle with 17-year-old Martin.

Mediaite is taking the position that this proves that Zimmerman was A-OK, that Trayvon didn’t attack him, break his nose, and slam his head into the ground. To my mind, Zimmerman sure looks fine, though his nose does look a bit swollen. One would think there would be some blood spots somewhere with a broken nose, though. As American Power points out

Again, the video changes no facts in the case. All it does is fuel speculation. The paramedics on the scene checked Zimmerman and declared him good to go in the squad car. If all the facts check out in favor of Trayvon, Zimmerman should be prosecuted. Meanwhile, due process must be afforded, despite Democrat lynch mob efforts to the contrary.

Exactly. Let the investigation continue. And, along those lines, I must say that Think Progress has an interesting article up with 5 questions that need answering. Though, none of them would really involve determination of what really happened that night.

Finally, over at Just One Minute, Tom Maguire links to a Baltimore Liberal Examiner opinion piece, and proceeds to tear it apart.

7. Much of the conservative “Blame Trayvon” noise includes the “fact” that he had been suspended three times from school over the last year. A school security camera allegedly caught Trayvon making a childish scrawl on a school locker and searched the child’s school bag looking for the marker. He also allegedly found Trayvon had a screwdriver in his possession and referred to it as a “burglary tool.” The school also says he had a bag with women’s jewelry that he denied knowing anything about.  The parents were aware of the tagging incident, but the news about the bag of jewelry came as a surprise to them.  But this raises the question, even if Trayvon Martin was the most prolific catburglar in his high school, did George Zimmerman know that, and what does any of this have to do with the shooting?  When he was killed all he had was the aforementioned candy and iced tea.

It’s not about “Blame Trayvon”: it’s about showing the facts, and about bursting the media bubble that Trayvon was a little angel. And, really, most of the information comes from media outlets, such as the Orlando Sentinal and Miami Herald, not exactly bastions of Conservatism. But, hey, if the writer is going to call the markings on the locker as “tagging”, well, that’s what gang members do.

Mandate Day 3: Perhaps Not Stricken Due To “Severability”?

An interesting point raised by SCOTUS blog

The Supreme Court spent 91 minutes Wednesday operating on the assumption that it would strike down the key feature of the new health care law, but may have convinced itself in the end not to do that because of just how hard it would be to decide what to do after that.  A common reaction, across the bench, was that the Justices themselves did not want the onerous task of going through the remainder of the entire 2,700 pages of the law and deciding what to keep and what to throw out, and most seemed to think that should be left to Congress.  They could not come together, however, on just what task they would send across the street for the lawmakers to perform.  The net effect may well have shored up support for the individual insurance mandate itself.

If so, it would look to be that the Court would not be arguing the Constitutionality of the mandate, but whether it would be hard work afterwards if it did. Which would completely miss the point of having a Supreme Court, the members of which take an oath to uphold the Constitution.

Interestingly, the typically unhinged Shakesville (which previously blocked me from commenting because I ask uncomfortable questions, but, hey, privately owned) raises an interesting point

What will Kennedy do? Once again, I am thrilled that one person has such a ridiculous amount of power in an ostensible democracy.

Me too. If only all the justices would consider American constitutionality when making a decision. But, then, the liberals on the Court would no longer be liberals. Of course, we aren’t a democracy. Republic. Book. Pick up now and then.

68% Disaprove Of How Obama Handles Rising Gas Prices

A good news/bad news poll. The good news

(Reuters) More than two-thirds of Americans disapprove of the way President Barack Obama is handling high gasoline prices, although most do not blame him for them, according to a Reuters/Ipsos online poll released on Tuesday.

Sixty-eight percent disapprove and 24 percent approve of how Obama is responding to price increases that have become one of the biggest issues in the 2012 presidential campaign.

Eighty-nine percent of Republicans said they disapproved, as did 52 percent of Democrats and 73 percent of independents.

That Independents percentage will hurt come election time, if prices stay high.

Bad news

Overall, 36 percent of respondents said “oil companies that want to make too much profit” deserve the most blame for higher energy prices. Twenty-eight percent of Republicans said so, as did 44 percent of Democrats and 32 percent of independents.

Twenty-six percent of all respondents said a range of factors was equally to blame, including oil companies, politicians, foreign countries that dominate oil reserves and environmentalists who want to limit oil exploration.

What this shows is that 36% are idiots, who have bought into the Democrat narrative that oil companies are evil and set the price. On the flip side, only 36% are buying the narrative, and only 32% of Independents.

But, yeah, it is certainly not all Obama’s fault. He does get a part of the blame for his policies, but, the problem is that Obama is handling this poorly, he is not coming out with policies to help alleviate the costs, and, remember, Democrats, including Obama, Blamed Bush for high gas prices, so, they are being hoist on their own petard.

Liberals Already Looking For Excuses If Mandate Goes Down

After a horrendous day for Obamacare’s chief council in front of the Supreme Court, one in which the far left justices had to remind him of his talking points, liberal supporters of this unconstitutional extension of the Central Government’s power are desperately reaching for any rationale to shift blame. Here’s James Carville

“I think this will be the best thing that has ever happened to the Democratic Party,” Carville said Tuesday on CNN’s “The Situation Room with Wolf Blitzer.”

Carville, who gained fame working on Bill Clinton’s 1992 presidential campaign, predicted health care costs will only increase in the future, in which case Republicans will be to blame for leading the drive to expel a federal program designed to help Americans cover those costs.

“Then the Republican Party will own the healthcare system for the foreseeable future. And I really believe that. That is not spin,” Carville said.

Except, this will give Republicans the chance to pass common sense law which will actually address the rising cost of health insurance.

But Glenn Thrush at Politico takes the cake

John Roberts is having his Bush v. Gore moment.

If the wily chief justice felt squeamish about leading the Supreme Court into an election-year political maelstrom, that was nowhere on display Tuesday, when the Roberts-led conservative majority signaled its collective skepticism, even hostility, for President Barack Obama’s health care law.

If the Affordable Care Act goes down — especially if it suffers the same schismatic 5-to-4 blow sustained by the McCain-Feingold campaign finance law in the Citizens United case — critics will accuse the Roberts Court of rigging the game and covering their power play with constitutional doublespeak.

Except, people forget, or willfully ignore, that the SCOTUS decision rightly interpreted Florida law that the Gore campaign was attempting to circumvent. Regardless, what we will see from Obamacare supporters is blame and excuses, anything to deflect from the notion that the Mandate was truly unconstitutional, and extremely unpopular. The law itself is unpopular overall, and most people understand that it will not make health insurance cheaper, and it will lead to reduced quality of care. They understand that their companies will dump their insurance offerings. And they do not want the Central Government mandating the purchase of a product simply for being an American.

You Didn’t Walk To Work, So The Climate Of The Planet Might Soon Tip Over

Today’s doom story

(Sustainable Business) Scientists keep beating the drum, hoping the world will wake up to the fact that climate change is a real, non-partisan, non-advanced vs development country issue.

Dubbing the phenomenal recent explosion in human activity, “The Great Acceleration,” leading scientists say time is running out to minimize the risk of setting in motion irreversible and long-term climate change and other dramatic changes to Earth’s life support system.

If nothing is done, the world is on track for the worst predictions with temperatures set to rise by 6 degrees Celsius by 2100.

At the Planet Under Pressure Conference, taking place in London, 2800 scientists warn the earth is dangerously close to an irreversible tipping point.

Certainly, they wouldn’t take unnecessary fossil fueled flights to attend this conference, right? Plenary Speakers and Panelists:

5 Uncomfortable Truths About Liberals

One thing I have been remiss about doing is linking John Hawkins at Right Wing News. RWN was the first blog I read, before I even knew what the heck a blog was. A few years ago, John gave me the priveledge of cross-posting over at RWN (and sometimes I post an article of interest over there that wouldn’t necessarily be of interest here at Pirate’s Cove). Probably because I do post so much over there that I forget to link up good stories from RWN (same with Stop The ACLU). Here’s a really good one from John, from his Townhall article: 5 Uncomfortable Truths About Liberals

  1. Most liberals are hateful people
  2. Liberals do more than any other group to encourage race-based hatred
  3. Most liberals are less moral than other people
  4. Most liberals don’t care if the policies they advocate work or not
  5. Most liberals are extremely intolerant

Make sure to read the entire thing.

Now, there is one more I’d like to add:

Liberals are, simply, hypocrites.

John touches on this a bit in in all five. Liberals are, for the most part, complete hypocrites. Think about what they so often advocate

  • Higher taxes
  • Fair share
  • Globull warming regulations and laws
  • Tolerance
  • Helping the poor
  • Reducing the use of fossil fuels
  • Guns are bad

The list can go on and on, but, how does it break down? It is always Someone Else who should be made to suffer for these notions. Higher taxes? “That Group should be nailed, not me.” Same with paying your fair share. And for “climate change.” They rarely change their own behavior: that guy must be made to change his. Tolerance? Oh, brother, they have little tolerance for anyone else’s opinion. Helping the poor? Well, the government will do it. Liberals are the least charitable, as study after study shows. Fossil fuels? Well, they simply can’t afford to give up their big vehicle, what with the kids and work and such. But, YOU should buy a Volt. Do your part, bub! Guns? Guns are bad for everyone else. But, they have no problem with one for themselves.

Then there are others, such as military action: most of them were cool with Obama’s war of choice in Libya. Iraq disappeared from the radar the day Obama took office. They didn’t freak out over the expansion of war in Afghanistan. Or in Northeast Africa. Most of them support abortion, but, not for their kid. Same with easy access to underage sex. They’d go ballistic if their child was taken across state lines by someone else for an abortion. They’d want to be notified if their underage child was going to have an abortion. But, they want your child to be able to do all those without a parent being involved.

Death penalty? Well, only for certain people. Support the police? Selectively, especially if they can support cop killers like Mumia.

All in all, so many of the penalties, restrictions, etc. they push should apply to Someone Else, while they get the benefits. I cover this on an almost daily basis regarding anthropogenic global warming. It applies to virtually everything Liberal.

Philly Mayor Nutter Calls Martin Killing An “Assassination”

There are certainly many folks who bring unhelpful, inflammatory, and idiotic statements to any discussion of race, such as Al Sharpton, Jesse Jackson, Chris Matthews, Hollywood nitwits who never even graduated high school, Spike Lee, The Black Panthers, Keith Olbermann, but, really, who better to “act stupidly” than Mayor Michael Nutter?

With the one-month anniversary of Trayvon Martin’s death only a day away, Mayor Michael Nutter expressed strong views regarding the incident that has garnered national attention.

Nutter referred to the shooting of the 17-year-old teen as an “assassination” during an appearance Sunday on MSNBC:

I’ve called this nothing short of an assassination. There was no reason for that individual, Zimmerman, to do what he did. Trayvon was not doing anything and was not a threat, based on all the information and evidence and 911 tapes that have been released. It was incomprehensible to me why an individual would do something like this unless he had something else either in his heart or on his mind.

Hey, he’s all yours, Philly residents. Of course, to be fair, Nutter did call out Black Philly youths running riot, and was branded an Uncle Tom.

Meanwhile, Soros monkeys Think Progress brand any facts about Trayvon as a “smear campaign.” Just One Minute wonders about the geography of the case. Salon says the memory of Trayvon is being dishonored. And a former head of the NAACP says that Sharpton and Jackson are “exploiting Martin“.

Know what we really need? For everyone to take a deep breath, cool the rhetoric, and let the facts of the story come out.
