Could A Newer Lawsuit Sink Obamacare?

The longer this turd of a government program sticks around the hard it will be to dismantle it, and it would require a GOP congress and president to repeal it. The soonest would be 2017

(Washington Times) “Obamacare” looks increasingly inevitable, but one lawsuit making its way through the court system could pull the plug on the sweeping federal health care law.

A challenge filed by the Pacific Legal Foundation contends that the Affordable Care Act is unconstitutional because the bill originated in the Senate, not the House. Under the Origination Clause of the Constitution, all bills raising revenue must begin in the House.

The Supreme Court upheld most provisions of the act in June, but Chief Justice John G. Roberts Jr. took pains in the majority opinion to define Obamacare as a federal tax, not a mandate. That was when the Sacramento, Calif.-based foundation’s attorneys had their “aha” moment.

“The court there quite explicitly says, ‘This is not a law passed under the Commerce Clause; this is just a tax,’” foundation attorney Timothy Sandefur said at a Cato Institute forum on legal challenges to the health care act. “Well, then the Origination Clause ought to apply. The courts should not be out there carving in new exceptions to the Origination Clause.”

The government argues that it originated with HR 3590, as in originating in the House, but, that was a shell bill, and had nothing to do with raising revenue, ie, taxes.

The suit is currently working its way through the courts. The next big chance won’t be till people are nailed by the Mandate. Unfortunately, citizens and groups can’t sue the government for the bald faced lies they told while passing the piece of crap.

Surprise: Warmists Find Another Reason To Not Walk The Talk

Local schmocal: Why small-scale solutions won’t save the world

I have a confession: I’m a cynic when it comes to living small. I like to garden and ride bikes; I buy local whenever I can. But I don’t think my personal lifestyle choices are going to save the world — and neither will yours.

I’m not alone. Just ask Greg Sharzer, a frustrated Marxist activist with a Ph.D. in Political Science from York University who also enjoys cycling and Fair Trade coffee. Sharzer’s book No Local: Why Small-Scale Alternatives Won’t Change the World is a bucket of ice water on fresh-faced progressive localism, and an affront to the concept of micro solutions altogether. Localism is a survival strategy, Sharzer writes, not a movement, and not a solution. (big snip)

Sharzer relies on Marxist class analysis to make his arguments that localism fails to bring about systemic change. I will spare you the Marxism (you’re welcome!) but not the class war. He basically argues that if localists “understood” capitalism (scare quotes necessary), they’d be in the streets with torches and pitchforks, not out scavenging used veggie oil to power their Jettas. He is lobbying for us to think and act collectively, globally, instead of just focusing on ourselves.

So, a 2 for 1 bonus: Warmists shouldn’t really bother making changes in their own lives (like any do other than token changes in the first place) and the need to do away with capitalism and replace it with Marxism (actually, what they are attempting to do is replace it with Progressivism, ie, nice fascism. Marxism is not that far off).

I should note that the Grist writer, Susie Cagle, does end the piece by recommending that people engage in these micro-solutions. Alas, they won’t. And that, as someone in the comments points out, if Sharzer isn’t giving his book away, he’s not really a Marxist. He’s not: it’s $19.95.

Warmist Suggests Hotcoldwetdry Will Cause More Tsunamis

While Warmists call people who do not believe in “climate change” (a wholly unscientific term) anti-science, this is what Warmists call “science”

Unsurprisingly, David Robert Grimes takes the Warmist line that massive cold and snow is caused by heat, because it surely couldn’t be caused by cold (sic). According to their meth addled hypothesis, the last glacial period was caused by it getting really hot.

While it may seem paradoxical that Arctic warming can freeze us so much, it is exactly what climate scientists have long predicted. And it will get worse.

Actually, none of them predicted this. This is Warmists trying to manufacture a way to keep pushing their cult (while refusing to practice what they preach). And, it doesn’t seem paradoxical: it just seems stupid and drug addled.

…ancient ice cores yield a record of temperature and atmosphere over hundreds of millennia, and shows our current rate of warming is hundreds of times beyond anything that has gone before, coinciding with the dawn of industrialisation.

Except for all those pauses in warming that have occurred since this warm period started. You have roughly 3 big warm trends (1850-1900, 1920-1947, 1978-1997) since 1850, with pauses and, in the case of the late 40’s-late 70’s, a dip. Anyway, here’s the fun part

..Two years on, it bears repeating that the Fukushima accident of 2011 has killed nobody and likely never will. The 2004 Indian Ocean tsunami, by contrast, killed more than 18,000. If nothing substantial is done, such disasters will increase in both frequency and intensity

And there you go, this Climate Astrologer is actually pushing that the 2004 tsunami was caused by “climate change”. Sadly, most warmists are probably thinking “yes, it was”. And you call climate realists “anti-science”? You Warmists would probably burn Galileo at the stake.

Is “Universal Background Checks” Legislation Dying Out?

One of the things about this debate about “universal background checks” is that no one within the elected “representative” community is saying that this is about handguns: it seems to be aimed at all gun purchases and transfers. And, to be honest, I personally have no problem with a quick background check on all gun purchases. Why are handguns different from a rifle that could fire accurately up to several hundred yards away? Anyhow, what Senators, mostly Democrats, are pushing may be dying out

(Washington Times) Senators from both parties signaled Sunday that universal background checks could be the next gun measure to get shoved toward the legislative scrap heap or significantly watered down.

Sen. Charles E. Schumer, whose bill to expand background checks to cover virtually all gun transactions, including private sales, has cleared the Judiciary Committee, said he is nevertheless hunting for a compromise on the issue.

If he’s hunting for a compromise it means his legislation is too extreme. Wasn’t this legislation supposed to be the easy one? Simply expand background checks to all guns. What is ChuckE putting in his bill that could make it so difficult?

Sen. Lindsey Graham of South Carolina said that out of about 80,000 people who failed background checks last year, just 66 were prosecuted.

“Why in the world would you expand that system if you’re not enforcing the law that exists today to include private transfers?” Mr. Graham said on CNN’s “State of the Union.” “So I think that legislation is going nowhere. But I would like to have a robust debate about improving the system to make sure that people who are mentally ill do not get a gun to begin with. And there’s a lot we could do in a bipartisan fashion.”

Wait, the government is not following the law yet is complaining about bad people getting guns? Raise your hands if you’re surprised by governmental incompetence.

Lawmakers are looking for a way to extend checks to almost all transactions without creating a record-keeping system that gun rights supporters fear could turn into a gun registry.

Well, what of the way records are kept for handguns? There has been no muss or fuss about that system. Why not expand it? Certainly because Democrats (and some Republicans) want a massive data base on Americans with guns. They aren’t concerned with all the issues involved with targeting people with mental health issues, violating their privacy, stigmatizing them, and denying them their Constitutional Right to own a gun while also violating their 4th and 5th Amendment rights.

Watcha Reading?

Finished The Greatest Domestic Threat, was actually a damned good book, but the ending left you hanging just a tiny bit.

Made it most of the way through Zombie Bay (Death On The Beach), but just couldn’t finish it. Truly bogged down and became boring.

Also gave How To Save The World: An Alien Comedy a try. Kinda interesting, but couldn’t hold my attention too long. Nor could The Rebellion for Democracy, which forgot to include detail, things just skipped like you’re supposed to know what is going on.

Getting into The Last Roman (The Praetorian Series: Book I). So far, damned good!

BTW, someone emailed and wrote that my book reviews suck. Well, this post isn’t about reviewing books. It’s simply about what I’m reading and asking what you, dear reader, are reading yourself. What interests you. If I run across a spectacular book, I might drop a bit of a review. Otherwise, nope.

Is Your Easter “Sustainable” And “Ethical”?

Happy Easter! Don’t forget to buy ethical chocolate. When you’re biting the head off a chocolate bunny this weekend, the last thing you want to be thinking about is whether your sweet treat was the product of child slave labor. But, this is going to be a bummer, it probably is. Well, I mean, it’s definitely possible. Have you checked where your chocolate is from? You should!

How sustainable is your Easter egg?

Easter egg fans can check the sustainability of the chocolate eggs this year following a campaign to rate the UK’s top brands on their use of sustainable palm oil.

Palm oil is used in a surprisingly large number of products from soap to margarine. Rainforests are often cleared in countries such as Indonesia and in the Congo Basin in Africa to make space for large palm oil plantations.

These crazies are always trying to ruin every holiday, especially the religious ones…..hey, wait a minute, these are issues I agree with! And not to be too preachy, you should too. I’ve written many times about the use of palm oil and how forests are cleared and wildlife, including orangutans, are intentionally killed to create palm oil farms, mostly in terms of how palm oil is used as a biofuel. I haven’t touched on the use of child slave labor for chocolate production, but these are all real issues, one of environmentalism and one of human rights.

Meanwhile, how does Google celebrate Easter?

On Easter Sunday, Google is honoring the birthday of the late labor organizer Cesar Chavez by placing a Chavez portrait within the middle “o” of the Google logo that appears on the homepage of the popular search engine.
