Texas Sues Biden Over Immigration Rule That Ignores Public Burden Law

Let’s say you live in a different country, and want to move to the United States and become a citizen. Or just come over on some sort of visa, be it a work visa, school visa, or some other. You have to take care of yourself. You aren’t allowed to be on public assistance programs. But, Brandon wants every person showing up at the border demanding asylum or illegally crossing the border to get public assistance. Rather than being deported

Texas AG sues Biden admin over illegal immigration rule ‘increasing burden’ on taxpayers

illegal alien DemocratTexas Attorney General Ken Paxton is suing the Biden administration over a newly implemented rule that he says places a burden on American taxpayers as a result of illegal immigration.

Paxton filed the lawsuit on Wednesday, alleging that the Biden administration is ignoring a federal law that bars the admission of “illegal aliens from residing in the country if they are likely to rely on taxpayer-funded programs”

The new rule, adopted in December 2022, “prevents consideration of statutorily required factors when determining whether an alien is likely to become a ‘public charge,'” according to Paxton’s office.

“Aliens often provide documentation of financial support from family as proof that they won’t become a burden on taxpayers. But the Biden rule prohibits a robust and meaningful investigation into the veracity of this documentation. Attorney General Paxton’s lawsuit alleges that the December 2022 rule was adopted in violation of federal law and is arbitrary and capricious,” a press release states.

“The Biden Administration is committed to opening the borders to aliens who lack the ability to take care of themselves. Texans should not have to pay for these costly immigrants, nor should any other American,” said Attorney General Paxton. “I will continue to defend the rule of law and fight to ensure that the massive costs of illegal immigration don’t further burden taxpayers.”

It really is insane that we are going to spend huge amounts of money supporting illegal aliens when we have U.S. citizens in need of a helping hand. How many homeless are there on the streets? People who could use help with drug addictions? Mental health issues? Homeless veterans? Why do we need to take care of all these illegals?

Every day the House nuGOPhers spend posturing is a day they cannot deal with immigration. Not that the nuGOP has a plan.

    • Professor Hale says:

What good would a “plan” do when there is already existing law that is being willfully undermined by the Biden administration? If the law will not be obeyed, what is the point of Republicans in Congress trying to pass another law that will be ignored?

Funny that illegal immigration didn’t seem to be a problem when Trump was running the show.

There is an immigration plan, and law, in place. The Republican plan is to enforce that law.

    Be nice to them
    Don’t make Jesus weep !!

    • Professor Hale says:

That says nothing about permitting them to cross your borders in the first place, nor about deporting them immediately when found, nor about punishing them for violating the laws that all are subject to, nor about using the power of government to steal from the native citizens to shower the foreigner with charity.

I love it when militant atheists (is there any other kind?) pretend to care about what is in the Bible when it suits their very narrow agenda.

Oh, and that’s not what the KJV says. At least try to get your cut-paste citations right.

The Bible does not demand that the USA have open borders. No other country on the planet has such an insane policy.

  4. Dana says:

Let’s tell the truth here: people who were reasonably successful in their home countries are not the ones who are coming to America. What we’re getting are not the best of those countries, but the worst, the ones who can’t make a living in Guatemala and Mexico and Honduras. They generally have few skills beyond labor. Allowing them into the United States does not make us wealthier, but poorer, as they wind up consuming far more in benefits than they’ll ever pay in taxes.

    • Elwood P. Dowd says:

Good point, and the same one The Great Trump made. Does that also imply that the Europeans that invaded and conquered America were rejects who couldn’t cut it in Europe?

Wasn’t The Don’s gramps a draft dodger from Germany who ran whorehouses here? Not their best.

Is Mr Dana certain about his claim “they wind up consuming far more in benefits that they’ll ever pay in taxes”?

We get it. Connies like Mr Dana much prefer white, straight, conservative christians and feel that anyone not a white, straight, conservative christian does not, cannot, make America a better place. According to connies, black men and brown immigrants are killers, robbers and drug users sucking the gubmint teat! Muslims and atheists weaken our moral fabric. LGBTQs are ‘grooming’ the next generation. Libs are murdering our babies. Jews are conniving thieves.

Does Mr Dana feel that black men are genetically more violent or is it cultural?

Should we melt down the Statue of Liberty, or at least remove the poem:

      The New Collosus

Not like the brazen giant of Greek fame,
      With conquering limbs astride from land to land;
Here at our sea-washed, sunset gates shall stand
A mighty woman with a torch, whose flame
Is the imprisoned lightning, and her name
Mother of Exiles. From her beacon-hand
Glows world-wide welcome; her mild eyes command
The air-bridged harbor that twin cities frame.

“Keep, ancient lands, your storied pomp!” cries she
With silent lips. “Give me your tired, your poor,
Your huddled masses yearning to breathe free,
The wretched refuse of your teeming shore.
Send these, the homeless, tempest-tost to me,
I lift my lamp beside the golden door!”

      • Dana says:

        The distinguished Mr Dowd wrote:

Good point, and the same one The Great Trump made. Does that also imply that the Europeans that invaded and conquered America were rejects who couldn’t cut it in Europe?

        Yes, actually.

The reasons they couldn’t “cut it” in Europe were not always economic, but yeah, they left Europe because they had to. My own maternal ancestors left England because they could not accept the official Church of England, and were persecuted for it, but yes, that can be interpreted as not being able to “cut it” in 17th century English society.

Happy and secure people don’t walk away from their homes, families and friends; desperate people do. There were always a few who were secure, but were seeking greater wealth and upward mobility, but they were few.

  5. Elwood P. Dowd says:

President Brandon is forcing Americans to confront our immigration problem.

We actually DO need workers. We do need to deal with the immigrants here now.

And as the greatest, richest, most moral nation on Earth we have an obligation to the world and her peoples.

    • L.G.Brandon!, L.G.Brandon! says:

We actually DO need workers. We do need to deal with the immigrants here now.

We have 11 million available jobs or so we’re told. We have 6 million people unemployed and 7 million who have quit looking for work and would rather make $35-100k in government largess. Do the math dowd.

We DO NOT really need workers at least not the kind who sneak in illegally with no education, unable to speak and read English, diseased an/or unvaccinated, frequently criminals or gang members and often traffic in drugs, illegal arms and child sex. The democommie party supplies all the criminals and sexual perverts and traffickers we can handle.

Similarly, when and until the current crop of aliens have been successfully integrated and assimilated into American culture and society we have no need of more.

The only reason you want to bring in aliens is to destroy/corrupt the White hegemony which founded and built our country. IOW, murder my heritage and that of all White people. Your racist hate knows no bounds. You and your commie brainwashers will go to any length to destroy all White countries. I don’t see you pigs pushing for “diversity” in Japan or North Korea or other non-White nations. Only the White society is supposed to give up their heritage to your pets.

And if as you state “We do need to deal with the immigrants here now” then why/how would you call for more when the ones we have are not being dealt with by YOUR OWN ADMISSION?

And as the greatest, richest, most moral nation on Earth we have an obligation to the world and her peoples.

But we thought you want to “fundamentally change” America? How can that be if we’re most moral nation on Earth?

Since you seem to have not noticed the Great USofA has done more for mankind and other nations than any other in history in money, blood, volunteerism, inventions, medicine and just about any way you can name but we cannot SUPPORT the fucking world.

      • Elwood P. Dowd says:

We live in the USA, not North Korea or Japan.

The Venezuelans and Central Americans making their way to the US can’t walk to North Korea or Japan or Australia.

A minor correction on your screed… most Hispanics ARE Caucasians. If Canadians were fleeing abject poverty and tyranny we WOULD support their immigration too.

Did you realize the 2/3rds of illegal immigrants in the US did not sneak in through the southern border? More fly into the US legally and overstay their visa than cross the US-Mexico border.

It seems that connies don’t object to illegal immigration as much as they object to illegal immigration through Mexico. Why?

California, Texas, New York, Florida, Illinois, New Jersey, Arizona lead the nation in illegal immigrant residents.

      • American Elwood P. Dowd says:

Did I say I wanted to “fundmentally change” America? If so, I misspoke. I want to stop the nuRight/nuCon/nuGOP/tRumpist/hate/MAGA movement from “fundamentally changing” America to a hateful, white nationalist, closed, non-democratic society.

    • Dana says:

      The esteemed Mr Dowd wrote:

And as the greatest, richest, most moral nation on Earth we have an obligation to the world and her peoples.

If you are going to state that we are the “most moral nation on Earth,” then I will add that any obligation is to push that morality, and that is primarily Christian morality. Will you agree that we should be spreading Christianity across the world, and more thoroughly across the United States?

      • Not Catholic but catholic Elwood P Dowd says:

The estimable Mr Dana asks if the US should be spreading Christianity across America and indeed, the world.

Of course not. He assumes that morality is exclusive to Christians. It’s not.

And the first line of our 1st Amendment states: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;…” The nation cannot make an effort to spread Christianity.

Not even American Christians subscribe to New Testament morality. There is no evidence that American Christians lie, cheat, steal, covet or kill less than others.

Are nations that are not dominated by Christianity e.g., Israel, Japan, S Korea, Bhutan, not “moral”.

The US is some 75% Christian (and dropping fast). Most Caribbean, Central and South American nations have a higher % Christians. Are these nations “moral”? Most nations in Central Africa have a higher % of Christians than the US. Are they “moral”? Mexico is 95% Christian!

Almost every “illegal” immigrant at the southern border is Christian.

The social democracies of Europe have huge Christian majorities. Are these socialist nations “moral”? The social democracies of New Zealand and Australia have sizable Christian minorities.

Even the dogmatic Mr Dana would recognize that the influence of Christianity on national “morals” is too variable to conclude that “spreading” Christianity to nations that already have a higher percentage of Christians than the US would have a salutary effect. Perhaps we should advocate the American Christians practice Christian morals.

So, what are American morals? Independence; personal freedoms; equality of opportunity; equal rights independent of wealth, country of origin, race, religion, sex, ancestry; care for the less fortunate; hard work; fairness (don’t lie, cheat, steal); no royalty; the melting pot. What America projects to the world is our fairness, honesty, strength and compassion. No other nation does more for the rest of the globe than the USA. No other nation lives by the ideal, “Give me your tired, your poor, your huddled masses yearning to breathe free.”

Our wealth, industry, resources and people put us in the enviable position of being able to help others.

      • The theologian from the Show Me State wrote:

The estimable Mr Dana asks if the US should be spreading Christianity across America and indeed, the world.

Of course not. He assumes that morality is exclusive to Christians. It’s not.

I would point out that it was Mr Dowd himself who stated that the United States is “the greatest, richest, most moral nation on Earth”. That being the case, that we are the “most moral” nation on earth means that our morality — which is, sadly, being reduced by the trendiness of today’s left — is better than the morality of other nations, and a clearly superior choice. More moral, perhaps, than Iran, governed by Shiite Muslim clerics, which is executing those protesting against the government, or the (mostly) Sunni Muslim Palestinians shooting rockets into Israel, or the Wahhabi Muslims in Saudi Arabia, who punish women for being raped? More moral, I’d say, than the South American nations, which employ, to various extents, authoritarianism, or Russia, which invaded Ukraine, or China, which has locked up and burned alive people with the virus which (may have) escaped from their own laboratory.

If we have, as Mr Dowd stated, “we have an obligation to the world and her peoples,” shouldn’t that include our greater morality?

It is possible, however, that when Mr Dowd wrote that I assume that “morality is exclusive to Christians. It’s not,” he was denying his previous statement that we have the greatest morality on earth. It really is so difficult to know what Mr Dowd is arguing, since he at least seems to be changing his positions on a daily basis, as he did here.

        • Not Catholic but catholic Elwood P Dowd says:

          Sigh…

          Let’s recap:

I called the US “the greatest, richest, most moral nation on Earth”.

The proud Catholic Mr Dana then claimed that IF the US is the most moral nation on Earth it is a result of Christianity. He further proposed that the United States of America should promote Christianity not only in the US but around the globe.

I countered with evidence that other “Christian” nations possess varying degrees of “morality”. And that the US government is not in the business of promoting religion.

Mr Dana also let fly at fundamentalist Islam for their abuse of gays and women and protesters. I agree that fundamentalist Muslims who kill gays, protesters and women are immoral as are fundamentalists who discriminate against gays, protesters and women.

Q: Does Mr Dana disagree with me that the US “the greatest, richest, most moral nation on Earth”?

Q: Does Mr Dana feel/believe that Christianity is the only agency of morality?

Q: Does Mr Dana feel that the state recognition of same-sex marriage, abortions and drag shows makes America less moral?

Q: Does he recognize that “immoral” fundamentalist Muslims also ban same-sex marriage, abortion and drag shows? Not to mention that they discriminate (if not kill) women, gays and protesters. If he were king Mr Dana would ban same-sex marriage, abortion and drag shows.

Q: Does he feel that a non-Christian can be moral?

I suspect that the fundamentalist Catholic Mr Dana and a religious agnostic have different definitions of morality.

We suspect Mr Dana feigns confusion, although he may actually believe that all morality derives from Christianity.

  6. Jl says:

Great observation-“Biden is forcing Americans to confront our immigration problem”. Yes, the problem that he mostly created. What a guy!

    • Gun Owner Elwood P. Dowd says:

Only a true “believer” imagines that illegal immigration started with President Brandon.

      • L.G.Brandon!, L.G.Brandon! says:

Only a true “believer” imagines that illegal immigration started with President Brandon.

Where did JI or anyone else here even SUGGEST pedo joe “started” illegal immigration? We are all well aware that the problem has its roots with Ted Kennedy’ 1965 Immigration Act.

There is noting wrong or immoral about controlled immigration. There is something hugely wrong and immoral about out of control immigration with the racist idea of changing our demographics and heritage. Immigration, when used to supplement and make America great is a wonderful thing. When it’s used to steal elections and drive down American wages and benefits it’s as immoral as the people who support it.

If we bring in 2 million third worlders a year it won’t take many years to turn America into a third world nation. Look what the democommie policies have done to every single city they run then REALIZE they are trying to do the same to all of America with their fascist/racist immigration policies.

They call us White people racists when we balk at having our nation that we built taken away through demographic marginalization but it’s not racist to pick and choose only non Whites to immigrate to supply the demofascist party with the people to replace those they murder annually through their adoration of abortion. If they weren’t killing so many poor and black babies maybe they wouldn’t need to bring in people from Haiti and Columbia.

        • Gun Owner Elwood P. Dowd says:

Where and when did the pedo-right hatch this Big Lie that Brandon started illegal immigration? That’s mighty right of you.

Illegal immigration started March 27, 1790. Before then anyone from anywhere could enter the US. And did. Even after 1790 there was no bullet proof mechanism for monitoring who was here or how they got here.

What the hell is wrong with you people? I’m beginning to think “replacement” might be the answer.

Since Mr Dana pointed out that immigrants to the US weren’t the sharpest tools from their countries, I’ve come to realize we Americans derive from the dregs of England, Ireland, France, Germany, Scotland, Sweden, Greece, Italy, Finland, Poland, and the “immigrants” from today’s Senegal, Gambia, Guinea-Bissau, Mali, Angola, Congo, the Democratic Republic of Congo and Gabon.

Now Lucifer and CarolAnn claim “they” built America! LOL.

And how ironic that Lucifer accuses others of killing babies.

          • Dana says:

Sigh! The firearms-owning Mr Dowd wrote:

I had already pointed out to Mr Dowd that, though Congress did have the authority to set immigration laws, they did not do so until a relatively brief period in the 1880s, when laws were passed to restrict the immigration of Chinese laborers, and then again in 1921, when we set restrictions on immigration, period. We did bar from entry potential immigrants who could not pass health exams at Ellis Island.

How interesting that Mr Dowd separated out the (mostly) white immigrants who chose to come here, and the blacks who were captured and sold as slaves.

But, whatever disadvantages the immigrants had in the Old World, they and their descendants were able to build what even Mr Dowd called “the greatest, richest, most moral nation on Earth.”

  7. Elwood P. Dowd says:

To catch up on asylum in the US read:

    https://www.uscis.gov/humanitarian/refugees-and-asylum/asylum/obtaining-asylum-in-the-united-states

One take-away is that the US should significantly increase the resources (officers, courts, judges, attorneys, counselors, shelter) available for handling these cases.

Note too, that President Brandon has proposed new policies… that would retain Title 42

    Said Brandon:

Over the past several years, thousands of people have been fleeing from Central and South America and the Caribbean countries ruled by oppressive dictators — including Cuba, Nicaragua, and Venezuela — and escaping gang violence, which has the same impact, in Haiti.

Currently, these four countries account for most of the people traveling into Mexico to start a new life by getting at the — to the American border and trying to cross.

But instead of safe and orderly process at the border, we have a patchwork system that simply doesn’t work as it should. We don’t have enough asylum officers or personnel to determine whether people qualify for asylum.

    • CarolAnn says:

So now the pedo wants a plan to fix what he broke? That’s mighty white of him.

    • Dana says:

      President Biden said:

But instead of safe and orderly process at the border, we have a patchwork system that simply doesn’t work as it should. We don’t have enough asylum officers or personnel to determine whether people qualify for asylum.

Perhaps the real solution is not to increase the number of asylum personnel, but restrict the conditions which qualify for asylum-based entry.

We’ve done it before: we used to allow any Cuban fleeing Communist who could get here entry, but it was later changed to a “wet foot/dry foot” standard; if they were intercepted while still at sea, they were denied entry.
