Obligatory “Trump Indicted In Georgia” Post

The leftists and Trump haters just can’t help themselves. Are the trying to make sure that Trump is the GOP representative for the 2024 election? Most of these charges are pretty shaky, and shady, and will most likely end up being dropped or lost. They will be great at jamming up Trump’s time and money, though, which is probably the point, along with making good on Leftist promises to indict Trump

Trump Attorneys: Georgia Indictment ‘as Flawed and Unconstitutional as This Entire Process’

Lawyers for former President Donald Trump responded after midnight Tuesday morning to the late-night indictment in Fulton County, Georgia, by District Attorney Fani Willis, calling it “as flawed and unconstitutional as this entire process.”

Their full statement — issued by Drew Findling, Jennifer Little and Marissa Goldberg — follows:

The events that have unfolded today have been shocking and absurd, starting with the leak of a presumed and premature indictment before the witnesses had testified or the grand jurors had deliberated and ending with the District Attorney being unable to offer any explanation. In light of this major fumble, the Fulton County District Attorney’s Office clearly decided to force through and rush this 98-page indictment. This one-sided grand jury presentation relied on witnesses who harbor their own personal and political interests— some of whom ran campaigns touting their efforts against the accused and/or profited from book deals and employment opportunities as a result. We look forward to a detailed review of this indictment which is undoubtedly just as flawed and unconstitutional as this entire process has been.

Critics noted that the 41-count indictment (which include 13 counts against Trump) accuses the defendants of crimes for simply arguing that the 2020 presidential election was flawed. That, in turn implicates the First Amendment right to free speech and the Sixth Amendment right to counsel. The indictment also attempts to use a county court in Georgia to charge the defendants for crimes allegedly committed on a national scale and in violation of a federal election, which typically fall under federal jurisdiction.

It will be interesting to see what happens when this goes in front of a judge with it’s 1st Amendment violations. Meanwhile, Stacy Abrams has yet to be charged

The indictment, however, describes “acts” furthering the “conspiracy” that largely consist of public statements, protests, claims at hearings, and even posts on social media — the very same kinds of actions and statements Abrams and her allies made for years.

Like Trump and his associates, Abrams made her claims of a stolen election repeatedly, from public platforms (and appears to have believed them). Like Trump, Abrams enlisted the help of political allies — and, worse, other elected Democratic officials.

Like Trump, Abrams took her claims to court, where they were dismissed even by otherwise sympathetic judges. Like Trump, Abrams nevertheless persuaded the media and supporters that her election was, in fact stolen; many still believe it to this day.

When will all those who claimed the 2016 election was stolen (and the 2000 and 2004 elections) be charged? Strange that none of the Credentialed Media outlets covering this gleefully wonder about that, and you’re not seeing any of them mentioning the 1st Amendment violations.

Update: More below the fold

Here are a few things that this wackadoodle indictment features

(Breitbart) On or about the 30th day of December 2020, DONALD JOHN TRUMP caused to be tweeted from the Twitter account @RealDonaldTrump, “Hearings from Atlanta on the Georgia Election overturn now being broadcast. Check it out. @OANN @newsmax and many more. @BrianKempGA should resign from office. He is an obstructionist who refuses to admit that we won Georgia, BIG! Also won the other Swing States.” This was an overt act in furtherance of the conspiracy.

On or about the 30th day of December 2020, DONALD JOHN TRUMP caused to be tweeted from the Twitter account @RealDonaldTrump, “Hearings from Atlanta on the Georgia Election overturn now being broadcast LIVE via @RSBNetwork! https://t.co/ogBvaKfqG.” This was an overt act in furtherance of the conspiracy.

On or about the 21st day of November 2020, MARK RANDALL MEADOWS sent a text message to United States Representative Scott Perry from Pennsylvania and stated, “Can you send me the number for the speaker and the leader of PA Legislature. POTUS wants to chat with them.” This was an overt act in furtherance of the conspiracy. (snip)

Other tweets allegedly constituting “overt act[s] in furtherance of the conspiracy” include Trump’s criticism of Georgia’s elected officials, a retweet of a call for citizens to encourage a special session of the state legislature, claims about the vice president’s power to reject Electoral College votes under the Constitution, and a demand for signature verification of absentee ballots — all typically statements that fall under the category of political speech that is protected by the First Amendment.

Really? This indictment violates the 1st Amendment and Georgia’s 5th and 9th of their Bill Of Rights. Will an honest judge step in and put an end to this un-Constitutional witchhunt?

Mr Teach asks: When will all those who claimed the 2016 election was stolen (and the 2000 and 2004 elections) be charged?

Did anyone claiming the elections of 2014 or 2000 were stolen take actions to try to overturn the elections? Lawsuits and legal challenges are legal.

Don’t forget that Trump took government documents and refused to return them.

the very fact that they challenged the election is an action trying to overturn the election. What do you think they were trying to do keep the election as it was without overturning it? They did exactly what trump did they claim their election was stolen from him. They did exactly what we claimed that the election was stolen from us. Difference is that their legal claims were heard cause nobody was playing lawfare against them. Our side had to go out and have a protest at the capital in order to be heard and then instead of being heard you accused us of an insurrection because you’re filthy communist pigs.

Trump took documents that he thought he could take because of the presidential document act or whatever the hell that is. He took things that he wanted to put into his library. What do you think he took things to give to the communist China? What are you stupid? Is that what you’re accusing him of? Because unless you’re accusing him of treason your argument holds no water. Didn’t fat Biden take documents too? Didn’t he have documents stuffed in the garage in his office at you will pay as many other places? What makes him different than trump? Oh I know what makes him different than trump you like him you don’t like trump.

Basically you’re using the same lawfare you used against the people that you that now using against trump. You are turning our country into a Banana Republic. And you don’t care cause all you care about is power and winning. You’re going to force America into violence. That’s what happens when you refuse to listen to your opposition.

I believe at this point the Democrat Communist Party is trying to force a civil war in the United states. And I don’t know why. Do you hate the Americans that disagree with you so much that you wanna kill us all? Cause it sure seems like it.

First you started by pulling strings to censor us, now you’ve denied us the rights to use a non partial court for justice. Then you start threatening to take our firearms away.

freedom is never safe as long as you’re around

      L’Roy,

I do not consider you an enemy. Nor do I want to kill you or start a civil war. We clearly have different opinions on what’s best for America and her people, but politics is supposed to be the art of compromise to PREVENT constant wars.

As you may know, there are legal avenues for challenging elections. It occurs every election at various levels of gov’t. Mr Trump’s attorneys legally went to the courts several dozen times. Republican AGs from several states went to the courts legally. There were several legal recounts. Several state legislatures investigated. There was no credible evidence that the Democrats stole the election from President Trump.

Sadly, Mr Trump wasn’t satisfied with legal means to challenge and conspired with others to conduct a coup d’etat that culminated with the sacking of the US Capitol on Jan 6. Since this is America, rather than the winner having Mr Trump dragged to the gallows, we are taking him to court.

In addition, Mr Trump has weaponized public opinion, convincing most of fervent followers, that the Big Lie was true! Mr Trump is the most divisive American ever. A civil war suits him fine.

Special counsel is investigating President Biden’s possession of gov’t documents too. The difference between Mr Trump and Biden/Pence is that Biden and Pence gave the documents back, while Mr Trump ignored subpoenas and moved documents around to hide them. If Trump had returned the documents when first asked, problem solved. We don’t know why he took the documents, we just know it was intentional.

Donald Trump has destroyed the Republican Party.

Our previous civil war was over slavery and the good guys won. What would the next civil be about? Trump? “Grooming”? Abortion? Ukraine?

For the umpteenth time, say what you will about Trump’s style, his judgement, or as some think lack thereof on both counts, but what exactly was the crime or crimes committed in vocally and peacefully protesting what he and at least half the country thought (and know for a fact) was a stolen election?

I guess the First Amendment is now completely null and void – unless of course you are a Democrat, Leftist or someone whose words do not go against and bolsters the latter’s orthodoxy, shibboleths, memes and official story. Funny how there were no indictments slammed on Al Gore, John Kerry, Hillary Clinton or, more to the point the Georgian gas giant Stacey “Tank” Abrams from Willis for literally usurping the title of governor of the state, claiming Brian Kemp was illegitimate and fomenting the same kind of doubt about that election that supposedly Trump did in the wake of 2020. She gets treated like a heroine/freedom fighter and Trump a pariah/insurrectionist.
