Bummer: Biden’s DOJ Fighting Relief Claims For Separated Illegal Alien Families

There’s something very interesting missing from this incredibly long USA Today piece

Biden promised to end family separations. So why is DOJ fighting relief claims in court?

The question from a Phoenix immigration supervisor came in on her BlackBerry: Should a parent and child apprehended at the border be separated? The response from Michelle Lee, an administrator with Immigration and Customs Enforcement in Arizona, came back in two minutes: yes.

That is among many inside details of the most controversial of the Trump administration’s “zero tolerance” efforts that are woven through recently unsealed court documents related to nearly 40 lawsuits filed against the government.

As one of his first actions in office, President Joe Biden followed through on a campaign promise when he vowed to end the “moral and national shame” of his predecessor’s immigration policies and halt the prosecution of parents for often minor immigration violations that were used to justify the separations.

Yet today, the Department of Justice is actively defending those very policies in court. By doing so, it in effect is asking families to decide whether reliving their pain is worth a potential payout. Families and their attorneys say they shouldn’t have to make that choice.

Interesting, since kids were separated from their parents during the Obama admin, and, who was vice president during that time period? Granted, it was not really and official policy, but, it happened quite a bit, since they were also not sure if the adult were the actual parents, or, simply running those kids into the US. Remember all the photos of kids in cages and Democrats freaking out in 2018? Yeah, mostly over what they were seeing from the Obama era.

And let’s not forget that the Biden admin has also been keeping kids in cages separated from the adults, as the NY Times itself admitted.

One mother separated from her children in 2018, who spoke to USA TODAY on the condition of anonymity for fear of reprisal, said she was disappointed that the U.S. government is fighting to deny them justice.

“My children may be forced to go through daylong questioning by government lawyers and medical examiners who will try to blame me for what happened to them,” she said in Spanish. “I’m terrified that they’ll be taken away from me again and forced to relive the trauma of the separation. Families like mine have suffered enough.”

You should be reunited with them and deported. Unless her asylum claim has been accepted, of which the percentage is very low, why is she still in the US?

The conflict between policy and action comes down to protecting the powers of the presidency and reducing future payouts to the families.

“It’s ironic that while candidate Biden said that family separation was abhorrent, as a president he’s allowing his Justice Department attorneys to fight these cases,” said Stephen Yale-Loehr, a professor of immigration law practice at Cornell University. But, he said, “every administration wants to preserve its flexibility and discretion on immigration, because immigration affects our sovereignty and foreign affairs.”

Monetary settlement talks have fizzled, although some of the attorneys for the families continue to hold out hope for an agreement. Some of the lawsuits that have advanced the furthest in the legal process are under protective orders, so attorneys are not allowed to discuss the specifics of the cases or the interrogation of families. As the cases move forward, however, they are preparing to prove their claims, including by preparing their clients for depositions.

Why would we give cash settlements to people who came illegally? There’s a simple solution: immediately deport them all. If they want to apply for asylum, do it outside the US. Nowhere in the article does it delve into Obama and Biden separating kids.

    Yikes! Obama Derangement Syndrome, again?? Bush Derangement Syndrome, too?

    No, Presidents Bush and Obama did NOT separate kids from parents at the border at any level even close to the official Trump policy.

    The Obama administration DID detain families together which media called a Failed Experiment.

    More than 3,900 children were removed from their parents under Trump’s policy, officially established in April 2018 but piloted for months before that, according to Biden’s Reunification of Families Task Force. About 860 children have yet to be reunited, according to the group’s latest report.

    Do conservatives feel that the US should pay reparations to the families of separated children? I do. But the administration claims that to do so could compromise a US President’s power to enforce immigration policy.

    How about Republicans and Democrats sheath their swords and work on a fair, just, sustainable immigration policy?

      Here’s a fair, just, sustainable immigration policy:

      Anyone can submit an app to immigrate. They will have 5 years to learn acceptable English and assimilate. They must provide proof of birth, a criminal record, a health record including vaccinations and an educational background. They will be given a list of jobs they can do upon arrival. If there are no jobs available they cannot come. We don’t need more welfare.

      Follow the rules and come and stay. Don’t and you’re out!

      If they commit a crime during their parole period they are tossed out. If they stop working the same.

        With the increase in refugees over the past couple of decades it’s clear we need to increase our infrastructure at the southern border.

        What happens is that the world changes. Countries in south and central America are going to hell. Recall St. Reagan granting amnesty to millions of “illegals” in 1986. Tje Senate was controlled by Republicans, the House by Dems. In 1987, Reagan gave status of minor children of parents granted amnesty under the immigration overhaul, announcing a blanket deferral of deportation for children under 18.

        RINO Ronald Reagan could not get elected as a Republican today.
