Surprise: Qanon Shaman’s Lawyers Accuse DOJ Of Serious Misconduct

It’s quite serious prosecutorial misconduct when the prosecution withholds evidence, asked for or not

‘It’s Appalling’: QAnon Shaman’s Lawyer Says DOJ Lied, Withheld Videos Aired By Carlson

An attorney for the so-called “QAnon Shaman” Jacob Chansley asked federal prosecutors repeatedly for all videos showing his client inside the Capitol on Jan. 6, yet told The Daily Wire he never received the bombshell – and potentially exculpatory – footage aired Monday night by Tucker Carlson.

Albert Watkins, whose client Jacob Chansley pleaded guilty to felony charges in connection with the Capitol riot and was sentenced to 41 months in prison, said Department of Justice prosecutors were legally bound to turn over the footage. Clips shown on Carlson’s Fox News Channel program show Chansley walking freely and peaceably through the building, often accompanied by multiple police officers.

“We did not receive that video footage,” Watkins said. “We asked for it, and not just once or twice. Whether we asked for it or not is irrelevant because the government had an absolute, non-compromisible duty to disclose that video and they did not do so.”

“And all the while, they were actively representing to the court and the American people that Jake was a leader, leading the charge into the Capitol,” he said. “They did not disclose that footage because it ran contrary to their rote narrative.”

Watkins, an attorney for nearly 40 years, told The Daily Wire he was stunned to see the footage, which he could have used to defend Chansley.

It’s disgraceful, and grounds to file and have the charges dismissed and the federal prosecutors, at a minimum, sanctioned. They should be disbarred and terminated for such an egregious, willful act.

“It’s appalling,” he continued. “Whether you’re right-leaning, you like Tucker Carlson, you hate Tucker Carlson, is irrelevant. This is about putting a dagger in the heart of our justice system. And the person holding the dagger and thrusting it with all its might is our Department of Justice. This required collaboration from the top of the Justice Department right down to the Assistant U.S. Attorney lying to me, a fellow officer of the court, knowing I had a duty to put my client in the best position I could based on the evidence.”

The question now is, what happens? Does this get blown off by the courts? You know that the Credentialed Media will ignore it, just like they have ignored left wing Antifa and BLM loonies being left off the hook for violent felonies. The system is broken.

The doj says that the didn’t have the tapes ,so they were not withholding evidence. Take nancy and schumer to court for holding evidence.

  2. CarolAnn says:

When commies are involved it’s always someone else’ fault and they were only following orders. It was a political farce to begin with, run by all democommies in a democommie district. What outcome was possible? It was a fake election with stolen results and it was a fake “insurrection” with stolen justice. Two years later Americans are still being held without trial. Is that the American Way? Only for democommies.

It’s gotta stop or they will murder us all.

    • Elwood P. Dowd says:

I used to think you were just stupid but it’s clear it’s much deeper than that. You are mentally ill and possibly dangerous.

      • Dana says:

Here we have a gentleman who thinks that girls can be boys and boys can be girls, calling someone else “mentally ill and possibly dangerous.”

Mr Dowd has, unintentionally, just testified against the so-called “red flag” laws. He called CarolAnn “Possibly dangerous,” when there is absolutely nothing in the statement to which he responded which could be construed as a threat. Even he last sentence, “It’s gotta stop or they will murder us all,” constitutes no call to action, but is simply a declaration that the current situation has to change or sensible people will be murdered.

        • Elwood P. Dowd says:

Here we have a gentleman who thinks… nah, he reacts. Does Mr Dana agree with CarolAnn that Democrats are ready to murder dissenting citizens? Did Mr Dana agree with Glenn Beck that President Obama was planning on rounding up dissenters and place them in FEMA re-education camps?

Girls will be boys and boys will be girls,

It’s crazy enough when someone seriously believes the election was stolen. It’s the kind of delusion that could lead hundreds of deluded, violent toadies to violently attack the seat of Congress hoping to overturn the election.

But anyone who seriously believes that Democrats are ready to murder them IS an even greater danger to us all. And anyway, we didn’t advocate an action, did we? We just identified her as deranged.

Psychological projection seeps from the pores of deluded right-wingers.

Don’t do the crime if you can’t do the time!

We hope CarolAnn seeks the help she needs. She may be on the verge of killing a Salvation Army member, mistaking them for the Stalinists coming to send her and her family to the American Gulag!!

Only 4 things you need to know about this case: QAnon. Shaman. Al. Watkins.

    Al Watkins:

“A lot of these defendants—and I’m going to use this colloquial term, perhaps disrespectfully — but they’re all fucking short-bus people. These are people with brain damage, they’re fucking retarded, they’re on the goddamn spectrum.” (They’re too brain-damaged to be guilty defense??)

“My client felt he was answering the call of our President.”

“Mr. Chansley, along with many others who were similarly situated, are now compelled to reconcile a betrayal by a man (Trump) whose back they felt they had for years. In turn, they are compelled to be introspective and evaluate how they got where they are, the role of their former leader in that tragic course, and the vulnerabilities they share”.

Chansley left a threatening not for VP Pence.

Watkins has called Trump wrong for not pardoning the rioters.

Watkins emphasized his client’s mental health issues, saying he suffers from schizotypal personality disorder that went undiagnosed and mistreated for years.

Chansley (Shaman): “I was wrong for entering the Capitol. I have no excuse. The behavior is indefensible.”

For his crime of obstruction, he was sentenced to 41 mo, although he could have received 20 years. The judge averred that he thought Chansley was genuinely remorseful. Chansley has disavowed the QAnon conspiracy theory and distanced himself from Trump, after unsuccessfully petitioning for a pardon. Watkins described Chansley in court Wednesday as “a new man.” Said the judge: “There is no question his views have evolved”.

By all means, withdraw the guilty plea deal (with a list of dropped charges) and actually try the case and take your chances with a jury of your peers. Also try the prosecution.

Do periods of good behavior negate criminal acts? Does mental illness?

    • drowningpuppies says:

Of course Rimjob overlooked the most important element of the case.
The Shaman was NOT GUILTY of the charges.
But being a dumbfuck like you we understand.

Isn’t this what all totalitarian/communist legal systems do? REPENT!! The democommies have morphed into a rwligion and created a Theocracy of atheists running our institutions. Any democommie who believes that Chansley deserves 41 months let alone 20 years is incompetent and should be removed from his position. He harmed no one, was unarmed and the only thing he destroyed was the lefts ability to remain sane. As Elwood has shown.

      • Elwood P. Dowd says:

Chansley carried a spear with Old Glory zip-tied to it. He was illegally in the US Capitol as part of a mob intent on obstructing the Constitutional duties of the legislature. He harmed the nation.

Perhaps Congress can change the law and reduce the longest sentence (20 years). Some earlier Congress considered disrupting the official proceedings of the nation a serious offense.

Should the justice system NOT take intent and contrition into account in sentencing? Maybe we give judges too much leeway in reducing sentences. Not to mention early release and parole. And pardons and commutations of sentences.

        • drowningpuppies says:

Oh please spare us your legal nonsense. The guy was in solitary for 320 days.
As usual you just make up shitty excuses because you’re just a dumbfuck.

Torture a suspect long enough he will confess to anything.

          • drowningpuppies says:

            Compare and contrast, ya dumbfuck!

Thomas “Tas” Alexander Starks, 31, of Lisbon, N.D., faced a strikingly different approach by the Justice Department. The self-avowed Antifa member took an axe to the office of Sen. John Hoeven’s in Fargo on Dec. 21, 2020. Federal sentencing guidelines suggested 10–16 months in prison but he was only sentenced to probation and fined $2,784 for restitution . . . he then reportedly mocked the FBI for returning his axe. Others declared him a hero and Democratic politicians pitched in for his legal defense.

    Thank you DOJ.

  5. drowningpuppies says:

J6 Committee Chair Thompson says they NEVER had access to J6 video.

Thompson said he doesn’t think any of the Jan. 6 members themselves ever had access to the footage — they let only staff view it. “I’m actually not aware of any member of the committee who had access. We had a team of employees who kind of went through the video.”

    . . . Wow.

It must be REALLY bad for Thompson to feign ignorance …

Either he’s lying or they really did a disservice to these hearings, the American people, and this country.

Of course not. What is the point of a show trial if you have to consider the evidence?

    Bwaha! Lolgf

  6. Dana says:

The prosecution has an affirmative responsibility to present to the defense any potentially exculpatory material, and that was not done. Knowing that Congress had all of the tapes, and refused to release all of those tapes to the Department of Justice, the Department of Justice was aware that there was possibly exculpatory material they were being denied, and should never have proceeded with any prosecutions.

  7. H says:

It is quite probable that US Attorney did not actually ask for it possess the Capital video tapes
To the best if my knowledge none of those tapes has been used as evidence in any of the 900 convictions so far.
If the defense attorney wanted them he should have asked Congress for them them. Is there any reason to believe the office of the US Attorney had them in their possesion?

I don’t think that cracker H, understands how justice is supposed to work here in the USSA. He must think the “new rules” are the actual rules.

Fun fact: Elon Musk has fired more corrupt FBI agents than Christopher Wray, Bill Barr and Merrick Garland combined.

  8. drowningpuppies says:

Oh, think the demos aren’t shook by two nights of truth by Carlson and then the admission by Chairman Bennie Thompson.

    • L.G.Brandon!, L.G.Brandon! says:

The democommies have been lying about so much for so long they have no longer any concept of truth. Just read the comments by our resident pinkos to understand it matters not what the truth is, nor justice, nor fairness but only what advances their narrative. The DC gulag operates under its own rules, laws and the constitution has long been thought a relic just like God.

Haven’t seen a thing from “armed Whites” yet. Have you? In hindsight, the people who “stormed” the capitol made only one mistake. They never finished the job. The protesters went in trying a last shot at getting justice. What they got was a good old fashion dose of communist kangaroo law.

The democrat party has become illegitimate and offensive by its totalitarian nature.

  9. Thomas Moore says:

Seems to me that right leaning folks continue to make the mistake that leftist folks have rules they abide by. They do not. BAMN is the gig = By Any Means Necessary is their rule and if that includes breaking ANY law then so be it.
