Posse Comitatus Act

A cute little Demaloon meme going around regards the Posse Comitatus Act. The libs are doing everything the can to be obstructionist regarding securing the southern border. The Libs have been screaming that we need to secure the border, rather then “starting the quagmire in Iraq,” but, now that Bush is trying to do it, they are searching high and low (usually low, if you get my meaning) to stop Bush from doing exactly what they have been screaming for.

The Posse Comitatus Act is a United States federal law (18  U.S.C. § 1385) passed in 1878 after the end of Reconstruction. The Act was intended to prohibit Federal troops from supervising elections in former Confederate states. It generally prohibits Federal military personnel and units of the United States National Guard under Federal authority from acting in a law enforcement capacity within the United States, except where expressly authorized by the Constitution or Congress. The Posse Comitatus Act and the Insurrection Act substantially limit the powers of the Federal government to use the military for law enforcement.

Oh, wait a moment. The Guard can act in a law enforcement role when “expressly authorized by the Congress. Furthermore, the Governors of each State could simply deploy them, which is completely permissible under any circumstances.

And, Dems, do not even try the Insurrection Act. It permits the President to deploy federal troops to stop lawlessness, such as when foreigners are illegally entering the USA en mass.
