Federal judge finds male-only military draft unconstitutional

More than 45 years after the military draft ended, a federal judge has ruled that a law requiring men but not women to register for it is unconstitutional.

In a ruling issued late Friday in Houston, U.S. District Judge Gray Miller denied the government’s motion to stay a lawsuit originally brought by the National Coalition for Men, a nonprofit “men’s rights” advocacy group, which is seeking an injunction ordering the Selective Service System to require women to register for the draft.

The draft, itself, ended during the final stages of the Vietnam War in 1973, but all American men ages 18 to 26 are still required to register with the Selective Service System so the military could move quickly if it ever needed to reinstate conscription.

Miller, who was appointed to the court by President George W. Bush in 2006, noted that the Supreme Court upheld excluding women from the draft in 1981 because women were excluded from combat duty. Because that prohibition was lifted in 2015, he wrote, excluding them from registering for the draft made no constitutional sense.

While I’ve certainly found some low hanging fruit whining about women having to register for Selective Service if the suit wins, NBC News just had to add this in

The Southern Poverty Law Center, a nonprofit civil rights monitor, has likened the National Coalition for Men, which is based in San Diego, to male supremacist groups seeking to roll back protections for women.

In a statement Saturday, the coalition said the male-only draft “is an aspect of socially institutionalized male disposability and helps reinforce the stereotypes that support discrimination against men in other areas such as child custody, divorce, criminal sentencing, paternity fraud, education, public benefits, domestic violence services, due process rights, genital autonomy, and more.”

Obviously, men aren’t allowed to have rights in today’s diverse and equal culture. sic/

    The SPLC needs to be prosecuted under RICO. They are a racketeering organization from top to bottom.

      Kye, Maybe Trump’s rebuilt DOJ will go after groups like ACLU and SPLC.

      Wouldn’t it be great to eliminate all those progressive organizations that stand in the way or right-wing dominance? Why not charge news organizations like NBC, NYT, WaPo etc with racketeering?

      BTW, here’s the list of crimes under RICO.

      The meaning of racketeering activity is set out at 18 U.S.C. § 1961. As currently amended it includes:

      Any violation of state statutes against gambling, murder, kidnapping, extortion, arson, robbery, bribery, dealing in obscene matter, or dealing in a controlled substance or listed chemical (as defined in the Controlled Substances Act);

      Any act of bribery, counterfeiting, theft, embezzlement, fraud, dealing in obscene matter, obstruction of justice, slavery, racketeering, gambling, money laundering, commission of murder-for-hire, and many other offenses covered under the Federal criminal code (Title 18);

      Embezzlement of union funds;
      Bankruptcy fraud or securities fraud;
      Drug trafficking; long-term and elaborate drug networks can also be prosecuted using the Continuing Criminal Enterprise Statute;
      Criminal copyright infringement;
      Money laundering and related offenses;
      Bringing in, aiding or assisting aliens in illegally entering the country (if the action was for financial gain);
      Acts of terrorism.

      What crimes do you think the SPLC has committed? Would you recommend that donors also be charged with a crime?

        First, let’s define progressive. If we mean trying to move something forward, they’re not. If we mean Leftist, they are.

        Better, just sue them into oblivion like the kids from CovCath are doing.

    All of those, especially theft, fraud, obstruction of justice racketeering and money laundering.

    Why am I not surprised you would give to an anti American, pro communist racist organization like the SPLC?

    I remember back when the SPLC and ACLU used to defend draft dodgers on the basis that the Draft was unfair. What changed to make them stooges of the institution?

    And seeking an injunction to enslave women? Those guys are just stupid. They should have used their shot at glory to get an injunction against the draft mechanism entirely and end registration. Freedom is best and everyone should be equally free. You get there by breaking slave chains, not by demanding half the population joins you in chains.

    I would have liked to see this ruling in the 60’s when I was worried about being forced to go to Vietnam and dying. It would have ended that conflict real fast. I wonder what the little snowflakes would do if they had to go to school and get real grades, currently they get a C for showing up. And if they knew that if they fluked out or dropped college they went to Nam. Would they be so easy to “trigger”.
