Excitable Gavin Newsome Pushes 28th Amendment About Gun Grabbing

I’m sure Gavin is welcoming of disarming his own security, right? Not just taking guns from you peasants, right?

Gavin has a press release, which all the media are running with and failing to ask questions

The 28th Amendment will permanently enshrine four broadly supported gun safety principles into the U.S. Constitution:

  • Raising the federal minimum age to purchase a firearm from 18 to 21;
  • Mandating universal background checks to prevent truly dangerous people from purchasing a gun that could be used in a crime;
  • Instituting a reasonable waiting period for all gun purchases; and
  • Barring civilian purchase of assault weapons that serve no other purpose than to kill as many people as possible in a short amount of time – weapons of war our nation’s founders never foresaw.

Additionally, the 28th Amendment will affirm Congress, states, and local governments can enact additional common-sense gun safety regulations that save lives.

Let’s unpack this: first, where is the actual text of said 28th? It’s not at the press release. We already have background checks, which seem to fail at times. The 2nd would need to be repealed for minimum age. How long is the waiting period? The final part would give leftist states, cities, and a Democratic run Congress the authority to pass as many limits and bans as they want whenever they want. Any Amendment should be very, very specific, not give government the ability to run roughshod over the citizens.

This has zero chance of earning 3/4ths of the states voting for it. But, it will do a great job of splitting the nation further.

Should former drug users who lie on applications be permanently banned from owning guns?
Exactly who should be prohibited from the rights given in the 2nd Amendment

  2. Professor Hale says:

Once again, Hairy asks a rhetorical question that has already been answered multiple times.

  3. Professor Hale says:

As long as we are playing, “let’s pull constitutional amendments out of thin air”, what would you all like to see?

    Here are mine:
    1. Define a citizen as a child of one or more citizens, or naturalized person. Other residents, temporary or illegal are not counted for congressional apportionment.
    2. Congress shall make no law, raise no tax, nor allow money to be spent without a 2/3 majority roll call vote.
    3. No US military member shall be stationed in any foreign country for any purpose without a law passed by congress on a 2/3 majority vote. This shall be retroactive to include congress voting yes or no on each country, the force cap, and the purpose for all troops currently outside the USA.
    4. No Federal judge shall be appointed without a 2/3rds majority vote.
    5. Abolish the Senate. Place all of it’s required duties in the House.
    6. Provide that the position of Speaker of the House shall be elected popularly and not also be a representative in the Congress.
    7. Set congressional terms as four-year terms. Set a maximum of two terms during the lifetime of any representative.
    8. No Representative may fill a seat previously held by a blood relative.
    9. The right to self defense is the primary human right. No citizen shall be held in legal jeopardy in any jurisdiction for exercising self defense.
    10. Devolve the District of Columbia to the State of Maryland and create such voting districts are required under Maryland law. Exception for the area around the Capital Mall, US Capital building, Smithsonian buildings and the White House which shall be called a federal enclave. No persons shall live in that area and no hotels be built there. The federal enclave shall be governed by a board of directors, appointed by congress.
    11. All agreements with foreign nations are classified as defacto treaties which must have Congressional approval.
    12. No part of the Federal government shall have armed agents to enforce the laws or protect the persons of national leaders except the Capital Police, FBI, and US Marshals.
    13. No person may run for public office while currently holding another public office, including campaigning for the office they currently hold.
    14. Federal judges shall hold lifetime appointments only until the age of 65. They can be reappointed for one year terms after that in such cases where vacancies exist and a shortage of judges would deprive citizens of their right to a speedy trial.
    15. Legal residents and visitors to the USA shall enjoy fewer civil rights than citizens. Illegal aliens shall have no civil rights recognized by law.
    16. Congressional representation shall be apportioned to the states by the number of citizens residing in each and shall be elected in the states at large. No congressional districts thus no party can benefit from gerrymandering. The strength of each representative’s vote shall be based on the number of votes he/she received in the last election.
    17. No state shall have the power to regulate voting in party primary elections. The parties themselves shall determine the rules for participation and pay for all the costs to determining their candidates.
    18. Cut the internet cables off from Asia, Africa, and South America and put all access from Europe through a spam filter the size of Rhode Island. Nothing good on the internet comes from Asia and Africa.

Professor, that makes a lot of sense in today’s climate. One thing I think could be added is a uniform, consistent, and standardized ‘Age of Majority’. Whether 16, 18, 21, or 25 years of age to drive, vote, marry, enter into contract, and so forth. Thirty would probably be better except very few would join the military.

      5. Abolish the Senate. Place all of it’s required duties in the House.

No. Restore the Senate to it’s proper role by returning the appointment of senators to state governments.

      8. No Representative may fill a seat previously held by a blood relative.

Why? Unless appointed to that seat by a vacancy.

      13. No person may run for public office while currently holding another public office, including campaigning for the office they currently hold

      That’s a de facto one-term limit.

      16. Congressional representation shall be apportioned to the states by the number of citizens residing in each and shall be elected in the states at large.

That’s the way to hand the states over to urban areas. A better way would be to limit how many arbitrary (i.e non previously existing political boundaries may be used to set a voting district

      18. Cut the internet cables off from Asia, Africa, and South America

OK, ha ha. 🙂 A better move would be to take back control of the DNS servers.

As Professor Hale stated both his rhetorical questions have been answered. Plus as usual, leftists like Herr Newsome love to masticate words and spit them out with new leftist meanings.

Barring civilian purchase of assault weapons that serve no other purpose than to kill as many people as possible in a short amount of time – weapons of war our nation’s founders never foresaw.

No matter how many times they repeat “assault weapons” they can never seem to identify weapons made only for assault. ALL weapons serve no other purpose than to kill as many people as possible in a short amount of time. That’s the object of a weapon. Then the moron calls personal arms “weapons of war” because again that fits his hyperbole and his need to arouse fear. Firearms, from pistols to machine guns are personal arms whether made to look scary or not. They are all made to be handled by an individual and used in personal combat be it on the filthy streets of San Francisco or the battlefields of Europe. If he were honest he would realize weapons of war are mortars, cannon, bombs, jets, etcetera not normally used in a no war scenario.

But if you mix the two he can cause more fear and urgency.

OT. I was requested (?) to join a US Fire Aux. Group to go to Canada today. I declined. Canada has such atrocious forest management I wouldn’t lift a finger to help. Plus, Trudeau. The thing that pissed me off was the Canuks called it a “climate caused emergency”. The left jumps on anything to promote their latest lie.

  6. Dana says:

Additionally, the 28th Amendment will affirm Congress, states, and local governments can enact additional common-sense gun safety regulations that save lives.

Which means that Congress, the states, or municipalities could enact anything, up to and including total firearms confiscation, and claim that such is “common sense.”

    Mandating universal background checks to prevent truly dangerous people from purchasing a gun that could be used in a crime;

Nikolas Cruz, who turned out to be a truly dangerous person, passed his background check because law enforcement and the Broward County public schools didn’t do their jobs, just kept letting him slide, thus leaving him with a clean rap sheet.

Barring civilian purchase of assault weapons that serve no other purpose than to kill as many people as possible in a short amount of time – weapons of war our nation’s founders never foresaw.

The largest percentage of murders, by far, are committed not with AR-15s, but local gang-bangers with handguns, killing other gang-bangers, and most of them are already legally barred from possessing handguns, but, shockingly enough, they get them anyway.

  7. Aesop says:

The bigger issue is that it will immediately be ruled unconstitutional, and be declared moot.
If it ever passed and was ratified.
    https://www.thepiratescove.us/wp-content/plugins/wp-monalisa/icons/wpml_scratch.gif

You can try and repeal amendments.
You cannot enact two that are diametrically opposed to each other.

Gabbin’ Nuisance is too stupid to know this, but SCOTUS, and ten thousand federal judges, are not.

  8. James Lewis says:

    Dear H:

“Exactly who should be prohibited from the rights given in the 2nd Amendment.”

No one. We should have the right to “open carry” with mandatory training on gun safety for all children before they can get a driver’s license.

Not only would we have gene pool improvement but politeness would become the norm.
