WTW: Silky Now Ant-Frivolous Lawsuit

Morning, y’all, Jebediah Murphy here with a dose of the truth. And the truth is, I really cannot laugh any harder. John Edwards, one of the original big boys in the frivolous lawsuit business prior to his political career, is now calling for their end (h/t doubleplusundead)

Democratic presidential candidate John Edwards, who made his fortune as a trial lawyer, says attorneys should have to show their medical malpractice cases have merit before filing them.

He also said attorneys with a history of frivolous suits should be barred from filing new cases.

Yes, now that he is no longer in the business of defrauding North Carolina OBGYNs out of hundreds of millions of dollars by convincing juries that the doctors caused the babies to be born with cerebal palsy because a cesarean was not done, he wants to put an end to this practice. A little too late for the women in NC who have a tough time find a baby birthing doctor in NC nowadays, due to the sky high malpractice premiums. Perhaps Silky is channeling an honest lawyer(?)

"I do want to push back some on what I think is mostly insurance company-driven hysteria because I think the reality is that the cost associated with legal cases is well under 1 percent of our legal system," the former North Carolina senator said.

Tell that to those who have suffered because of your own frivolous, non-scientific lawsuits, John.

"I think that the bulk of the problem is created when cases are filed in the legal system that should never be filed, and the results are years of litigation and costs that are incurred by the health care provider that should not have been incurred," Edwards said. "A lot of that responsibility goes to the lawyers."

"A lot?" How about most? How about you being a primary cause for high health costs in the baby birthing business, particularly in NC? How about that you have increased the danger to the mother by causing doctors to perform cesareans when not necessary? How about that you have reduced the number of people entering the baby birthing business, particularly in NC? How about that they can take care of less patients, because they want to make sure there are plenty of witnesses during the treatment and birth, so less people are available, being doubled up and all?

I wonder if The Fact Checker will check out Silky’s claims. Doubt it.
