But now that Donald Trump has appointed Constitutional originalists Neal Gorsuch and Brett Kavanaugh to the court we have Leftists melting down

The case for abolishing the Supreme Court

When he was arguing for the ratification of the Constitution, Alexander Hamilton wrote that the judiciary “will always be the least dangerous branch to the political rights of the Constitution,” in part because he believed the federal courts would stand above the political fray and act as a bulwark against tyranny from all directions.

But it’s hard to defend the Supreme Court on these grounds today.

As my colleague Matthew Yglesias noted last week, the Court is now a blunt political instrument, used repeatedly to undermine outcomes of democratic governance — often on behalf of corporate interests. And the recent disaster that was the Brett Kavanaughconfirmation has further delegitimized the Court in the public’s mind.

So it’s perfectly reasonable to ask if we should abolish the Supreme Court, or at the very least strip the Court of its ability to overturn laws that it rules unconstitutional. If the Court is no longer a neutral arbiter of the law, if it’s gradually shape-shifting into a partisan weapon, then maybe it’s time to rethink its role in our constitutional system.

Got that? Since the court is there to make decisions based on the Constitution rather than how some people voted, abolish it! Which is an interesting notion, considering how often liberals use the Supreme Court, and many lower courts, to overturn the will of the voters. Think, not so long ago they took it to SCOTUS to overturn many voter referendums that made gay marriage illegal in several states. Without the Court, that doesn’t happen.

Anyway, writer Sean Illing goes on to discuss this all with Mark Tushnet, a law professor at Harvard, and there’s way too much to fisk. And, really, this is all about Democrats being sore losers. Who should remember that without judicial review, many of their pet initiatives would be killed. There would be no Roe V Wade. Gay marriage would be against the law in California. And so much more.

Stop being sore losers. Stop having kneejerk sore loser reactions to everything. They won’t.

    67 senators need to approve a constitutional amendment and then 37 states need to approve amendment to abolish the supreme court. I would venture to say that the left has embarked upon a plan to fill every red state in America with Muslims, Illegals so that one day the entire country can be run by Mexico City and Mecca.

    Yes I believe in Nationalism. I believe that America is the strongest most powerful country on earth. And I don’t just mean military. I mean morally, politically and socially. We have our issues. We fall short but then I suspect every other country has their issues as well that are even more extreme than our own.

    These stupid White boys and girls all demanding Hispanics and Muslims flood our shores dont really comprehend what they are asking for. They are asking for Sharia Law to become the norm in America where those white girls lose their freedoms and gays and Lesbians and trans all get “Offed”. Sure Socialism and communism works. Sure it does. Except when its run by any human being.

    Open borders is the bane of mankinds existence. There is no star trek eutopia. There is no one world government where poverty ceases and everyone is just these peachy keen, highly educated, well behaved and enlightened individuals. There is just the haves and the have nots in any world order. No matter who is running it.

    Always has been and always will be. The problem for the political left in America these days is they are not running the show therefore there can be no civility.

    A vote for a Democrat is a vote to enslave more of the world in a web of lies ruled by the MOB.

      Democrats do not support open borders or socialism, unless one considers Social Security, Medicare and universal healthcare to be socialism.

      There is just the haves and the have nots in any world order. No matter who is running it.

      But do we have to succor the ‘haves’ at the expense of the ‘have nots’? American trade, tax, monetary, fiscal, health care, labor, patent, immigration, political donor, financial regs, union, environmental policies ALL benefit the wealthy, the powerful, the corporations off the backs of genuine American workers. In the US, the divide between the haves and have nots continues to widen. This divide is not entirely natural, but is supported by policy. The wealthy and corporations control our legislatures.

        And American policy benefits the middle class, not the Party of Welfare.

        Nothing like a complete and total denial of reality to get your point across.

        You might want to reach out to your comrades because the socialism and open borders thing is something they’ve really been stressing, or maybe you’re just not being honest about your party’s intent.

    What, they’re just now noticing that the court is a blunt political instrument? They didn’t notice it after Roe v Wade back in 1973, or Obergefell v Hodges in 2015?

    The Court overturned the abortion laws in virtually every state, something that the left had been unable to achieve through the legislatures. The Court overturned state definitions of marriage, many passed by voter initiative, to define the abnormal as being normal.

    The Court went directly against the Constitution by approving Affirmative Action, so much so that even they recognized it, stating that the temporary exception that they approved shouldn’t be needed after 2028.

      SCUS seriously undermined Roe in Casey and I’ll bet, now that the Lefties don’t run it, it will cease to be “settled law”, just like slavery or segregation.

      What about Kelo v. New London? The left side of the court basically smashed personal property rights by letting the government decide if they could use your property to get more tax money than you were chipping in; a perfectly modern democrat concept. Using eminent domain for government projects was so antiquated obviously.

    What should happen is that we go back to the original form of the appellate courts which was tell the appropriate legislature to go back and rewrite the offending bill.

    Of course, the Democrats wouldn’t like that any better.
