California says Trump’s deployment of National Guard violates state sovereignty
California is suing to reverse President Donald Trump’s deployment of the National Guard to Los Angeles, arguing that the use of the military to suppress immigration protests is an illegal and unconstitutional intrusion on state authority.
Trump’s deployment of as many as 4,000 National Guard troops has sapped the state of crucial emergency resources and came without consultation with Gov. Gavin Newsom, according to the 22-page lawsuit, filed Monday afternoon in federal court in San Francisco.
Though Trump initially declared his intent to send 2,000 troops to L.A., both the lawsuit and Newsom himself suggested he had revealed plans to double that number to 4,000. And just before the lawsuit was filed, Trump ordered 700 Marines to L.A. to support the Guard troops.
The absence of consultation, California’s attorneys say, makes Trump’s deployment unlawful. The lawsuit echoes Newsom’s comments earlier Monday in an interview with POLITICO.
“There was no communication through our office, period, full stop. So, by definition, it’s an illegal act,” Newsom, a Democrat, said, adding that the president failed to meet other key prerequisites for the deployment.
Well, you know that Gavin is going to find a friendly liberal judge to rule in his favor, then it is going to have to go through appeals and such, and, by that time, ICE will have concluded their operations. I wonder, though, where were all these sovereignty folks when Biden was jamming all sorts of restrictions on COVID down our throats? And other things?
A White House spokesperson said the California governor should thank Trump “for restoring law and order.”
“Gavin Newsom should march back to his Attorney General’s office to prosecute the anti-ICE rioters who burned property and looted businesses in Los Angeles. It’s pathetic that Newsom is more focused on saving face than protecting law enforcement and holding criminals accountable,” White House spokesperson Anna Kelly said.
The best part is that these are Democrats burning and destroying Democrat stuff in a Democrat city.

The Guard wouldn’t have needed to be mobilized if Newsom (D) and Bass (D) had done their jobs.
Isn’t it interesting how protesting a coup de publique, i.e. J6, is seditious conspiracy, while violently protesting immigration laws – which Trump was elected to enforce – is somehow brave and noble?

Of course, that was to protect the civil rights of black Americans – a cause oppposed by MAGAts to this day. The peaceful march from Selma to Montgomery was opposed by the segregationist Gov George Wallace who refused to protect the marchers from the white mob and the state and local police. President Johnson acted. And legally. Violence, including murders, against peaceful black protesters was widespread in the South at the time. The Alabama State Police had previously attacked peaceful marchers and beaten them with clubs. Mr Dana is old enough to remember that “Bloody Sunday”.

The First Amendment guarantees the right of the people to peaceably assemble to protest, and I absolutely support that. That is a bit disingenuous since the guard and Marines aren’t doing that. Their mission is to protect federal government buildings, not restore order.
This part is actually true, though since LA Mayor claims the situation is under control, I don’t know why they need those resources. There is a little known fact that a large number of LAPD officers (>30%) are also serving in the National Guard to pick up some extra cash. So, when the Guard gets deployed, like during the Rodney King Riots, it actually results in FEWER police on the streets. For that reason, first responders should be forbidden from serving in the National Guard (placed on indefinite leave) so that their body isn’t being counted twice as a resource. As long as the units are drawn from locations farther away from LA, this shouldn’t be a problem, but likely it was from the local armory.
My own read of 10USC shows the California case is meritless on its face, but that won’t stop a loyal democratic party judge from supporting it anyway.
Another useful fact: The national guard is funded 95% by the federal government. They are in no way a “state militia” and the state governments have no ability to veto deployment orders. Some state remedy this by creating an actual state militia. During the Bush administration, some governors tried to halt deployments to the gulf wars and were unsuccessful in court. The president has absolute uncontested authority to mobilize the national guard and call them to federal service. (Hint: It’s in the name NATIONAL Guard).
Trump could easily make this case Moot by using guard units from Nevada and Utah. I suspect he used California troops because they were cheaper and didn’t require travel time and convoys.
The use of Marines is also totally legit since they are being sent to guard a federal building, not assist law enforcement. The Democrats know this. They are just using the situation to gear up for the mid-terms.
