City Considers Ordinance To Opt-Out Of Being Part Of California’s Sanctuary State Status

It’s interesting that the LA Times pitches California passing a law making them a sanctuary haven for criminal illegal aliens as “resistance” to Trump, rather than simply being illegal alien loving Democrats doing what illegal alien loving Democrats do

In defiance of Trump, California became ‘sanctuary state.’ This Orange County city may want out

Since California became the center of the resistance to President Trump’s crackdown on illegal immigration, so-called sanctuary policies have taken root across the state.

The movement went statewide with Senate Bill 54, an initiative by lawmakers to protect immigrants without legal residency by restricting local law enforcement’s cooperation with federal immigration authorities.

How nice of them to spend all that money on illegals, rather than cleaning the streets and dealing with crime, especially in places like San Francisco.

Now, one Southern California city may want out.

On Monday, the Los Alamitos City Council is set to consider an ordinance that exempts the small Orange County municipality from the state’s sanctuary law, which took effect in January.

A city agenda report argues that the state law is at odds with the U.S. Constitution and “infringes on the rights of the citizens” of Los Alamitos.

“In view of this contradiction, it is impossible to comply with both the Constitution of the United States and the Constitution of the State of California,” the report said. “In this situation, my belief is that the Constitution of the United States has precedence over the Constitution of the State of California.”

What will the leaders of the People’s Republik Of California do if the city passes this? Will they threaten Los Alamitos? Over at The Federalist Rick Moran writes

If the state chose to challenge the ordnance, Los Alamitos would surely lose. There would be chaos if local governments around the state chose which state laws to obey and which not to.

And, in the same way, the state of California would be hypocritical, as they are choosing which federal laws to follow. Jeff Sessions should announce that no immigration enforcement will operate in the capital of California,  Sacramento (and perhaps a few other citizens, such as San Fran, Oakland, Berkeley, etc). Let the state capital deal with the fallout of thousands and thousands of illegals streaming in.

‘Twould be amusing, at the very least, to see the state, which is arguing that it can ignore federal laws, despite the doctrine of federal supremacy and the clear rulings, in the Hazleton and Arizona cases, that it is the federal government which has sole authority over immigration and naturalization, that state supremacy over local ordinances trumps — verb chosen quite deliberately — Los Alamitos’ proposed ordinance.

One of us wonders if Jeffrey Jeffery, who supports the actions of the ‘sanctuary cities’ and states, will agree that if San Francisco has the right to choose to be a sanctuary city, then Los Alamitos has the right to choose not to be one.

Bet Moonbeam won’t consider federalism at the state level legal.

  4. Yeah, you can bet that suddenly Democrats who were finally thinking the 10th Amendment is great will suddenly decide “nope, not for cities.”
