Judge declares Rubio’s speech-based student deportations violate the Constitution
A federal judge on Friday declared that the Trump administration’s efforts to deport noncitizens for political speech run counter to the Constitution’s First and Fifth Amendments, the latest legal rebuke of the White House’s expansive immigration agenda.
Northern District of California Judge Noël Wise, an appointee of former President Joe Biden, sided with the Stanford Daily, which sued Secretary of State Marco Rubio, arguing that his use of the Immigration and Nationality Act to deport noncitizen students had foreign students refraining from writing opinion pieces critical of the administration.
”In the United States, freedom of speech belongs to the people,” Wise wrote in her opinion. “It is not the government’s to take.”
If someone threatens to kill someone, to blow a building up, well, that is not free speech. Taking the side of Islamic terrorists is not free speech
Another plaintiff was an unnamed woman who is a lawful noncitizen in the U.S. who was previously in the country on a student visa at a school that was not Stanford and “has refrained from publishing and voicing her true opinions regarding Palestine and Israel and has deleted a social media account to guard against retaliation for past expression,” according to court documents.
“Here you can simultaneously hate the content of a person’s speech and love the country that cherishes the freedom to allow it,” Wise wrote. “Zealous protection of our Constitutional right to free speech is a provocative demonstration of our country’s powerful lack of fear.”
Most of these foreigners do not love America. They have no Right to be present in the US.
A State Department spokesperson, given anonymity to discuss internal thought processes within the agency, told POLITICO that the U.S. “is under no obligation to admit or suffer the presence of individuals who subvert our laws and deny our citizens their Constitutional rights.”
“More broadly, the Department of State is committed to protecting our nation and its citizens by upholding the highest standards of national security and public safety through our visa process,” the spokesperson said. “A visa is a privilege, not a right.”
And based on the Supreme Court ruling in Trump v CASA, Wise’s ruling can only apply in her district.

Immigrants do not leave their families and friends and move to my country be because they hate the USA. They move here because they want a better place for themselves and their families to live. Just like immigrants have done for hundreds of years. All 4 of my grandparents immigrated here in the late 2800s 2 spoke little English. They faced heavy discrimination from people just like Teach for many reasons including lack of English, being Catholic and being blessed as criminals.

Laura Berlin, using her background in nonprofit communications, built an interactive Google Map titled, “Who is Profiting from ICE?” It plots the contractors across the country who work with Immigration and Customs Enforcement to carry out the Trump administration’s deportation policies. The Texas mother of two teenagers has been pulled out from behind her laptop into an uncomfortable spotlight.
Activists found her online database and have used it to organize hundreds of protests across the country against these companies, shaming them into cutting ties with ICE.
The U.S. government found her website, too – and labeled it a tool for domestic terrorism, according to a secret intelligence bulletin obtained by USA TODAY. It’s the latest example of the Trump administration cracking down on dissent it says could veer into political violence.
GEO Group and CoreCivic were awarded nearly $1 billion combined by ICE in the first year of the Trump administration’s crackdown in 2025. The two companies provide staff for detention centers, beds to house them, and ankle monitors to surveil those out on bond awaiting their hearings.
She posted her research on boycottcitizens.org, and included a detailed Google Map that shows the nationwide web of companies, law enforcement agencies and politicians with ties to ICE.
CoreCivic announced that it sold two California facilities back to DHS – freeing up more than $1.5 billion to inject into the company.
Berlin didn’t stop there. Her research includes a searchable map of ICE’s contracts with other major U.S. companies that span the nation: AT&T, Comcast, Dell, Deloitte, FedEx, Motorola and Palantir.
And that caught the attention of the Department of Homeland Security.
To DHS, it’s information that could be used by “anarchist extremists.” That’s according to a secret intelligence bulletin DHS sent to local and federal law enforcement in February, specifically targeting Berlin’s website.
The bulletin concedes, in red letters, that “some of this information describes First Amendment-protected activities.”
DHS is targeting “even the mildest anti-ICE dissent as extremism and terrorism,” said Ryan Shapiro, executive director of the open government group Property of the People, which obtained the document. “This has nothing to do with public safety,” Shapiro said. “It’s about deploying law enforcement as a taxpayer-funded security force for ICE’s corporate enablers and profiteers.
Berlin found that more than 450 candidates across the country had taken campaign contributions from some of the three biggest government contractors working with ICE – GEO, CoreCivic and Management and Training Corporation.
In Arizona alone, the companies contributed to nearly 80 candidate campaigns.
In 2025, GEO spent $1.7 million on federal and national candidates and $2.3 million on state and local elections. CoreCivic spent $1.7 million federally and $1.6 million on state and local lobbying.

“This industry is trying to utilize political connections to extract as much as possible from taxpayer coffers,” Tylek said.
Berlin said she’s motivated by changing the nation into a better place for children like hers. And that If the government insists on its bareknuckle approach against political dissent, she has the First Amendment on her side.
