US appeals court voids Biden-era efficiency rule for stoves, ovens
A federal appeals court on Tuesday struck down a Biden administration-era rule setting efficiency standards for gas and electric stoves and ovens, saying the agency ?improperly bypassed public comment procedures.
In a 3-0 decision, the 5th U.S. ?Circuit Court of Appeals in New Orleans ruled in favor of seven Republican-led states — Louisiana, Mississippi, Montana, Nebraska, Tennessee, Texas and Utah — that challenged the Department of Energy’s “direct final rule” for consumer-grade stoves ?and ovens.
The August 2024 rule was intended to limit how much energy consumers ?use in kitchen appliances, and to ban an older technology known ?as linear power supplies.
Circuit Judge Andrew Oldham said the Energy Department should not have fast-tracked ?the rule, knowing that numerous states opposed a 2023 attempt to enact similar efficiency ?standards.
He also dismissed the rule as part of a push by former President Joe Biden’s administration to make home appliances “more expensive and less useful.”

The judge ?said “it cannot be ?contended with a straight face” that those Democratic-led states fairly represented the entire country.
He also said the department failed to consider ?whether making appliances more technologically complex in the name of ?efficiency would ?reduce reliability or increase associated costs.

Your Catholic curmudgeon from Kentucky installed a propane fireplace in 2018, and did not have to vent it. We did add a range hood to vent the propane range we installed, and there was already a vent stack for the propane water heater. But American homes have had primarily gas ranges for pushing a century now, many of them in unvented kitchens, and we haven’t all died.

Banning Linear Power Supplies is a joke for high current / high load situations. While a switching power supply (like those used for laptops and such) are great for sipping power, if you need AMPS, a customized linear power supply is the way to go.

State and Federal regulators are all people who do not have to worry about money, so it’s really nothing to them to add another regulation, for our own good, don’t you know!, that won’t cost them anything more than they can already afford, but raises prices for everyone, not just themselves.
So what if their regulations increase the costs of a new range by $50? People normally do not buy a new range unless they need one, unless of course they are doing it as part of a kitchen remodel, and if they can afford a kitchen remodel, they can afford the added $50!
Federal regulators ordered new efficiency standards for wood burning stoves, which naturally raised manufacturing costs and downstream prices. Didn’t matter: the regulators themselves didn’t use wood burning stoves to heat their homes, so what did they care? The people who did want such stoves, for primary or, in my case, supplemental and emergency heat, tended to be poorer. Fortunately when we did buy one, 2011 or 2012, we were able to get a real deal: 10% military discount plus an additional 10% discount because we bought the floor model at Lowe’s, being the last one they had and out of the box.
Actually, we’ve gotten a lot at Lowe’s due to the discount, scratch-and-dent discounts, and a returned item: Two good refrigerators, the wood stove, and an electric water heater, saving around $3,000 in total. Add to that much of two separate kitchen remodels with the 10% military discount. Sadly, that has been limited to no longer include appliances, wiring, and lumber. 🙁
