Mamdani desperately seeking legal loophole to arrest Benjamin Netanyahu when Israel PM visits NYC
Mayor Zohran Mamdani said he’s desperately seeking a legal loophole to arrest Israeli Prime Minister Benjamin Netanyahu for alleged war crimes when he visits in NYC in September.
The Pro-Palestine, Israel-hating, socialist pol said in an interview published Saturday that it’s unclear whether he has the authority to order the NYPD to arrest Netanyahu during the prime minister’s expected trip to the Big Apple for the UN General Assembly – but is in an “active conversation” with the city’s Law Department about the matter.
“I believe that Prime Minister Netanyahu belongs in The Hague,” Mamdani bluntly told The New York Times, referring to the United Nations’ International Court of Justice.
“He’s a war criminal who has been charged by the International Criminal Court. And what you will find is that it is an opinion that is held by many purely because of what his actions have wrought over these last many years.”
Mamdani – who has made accusing Israel of genocide in Gaza a focal point of a far-left ideology that has helped propel him into the national spotlight – vowed during last year’s campaign that, if elected mayor, he’d have Netanyahu arrested if he ever set foot in NYC.
He’s desperately looking for a way to arrest Israel’s PM, who has diplomatic immunity for one thing, and wants to do it because he hates Israel, loves Islamic jihadis, and despises Jews, much like a good majority of those who voted for him.
Netanyahu, however, remains unfazed by Mamdani’s threats.
In a recent radio appearance, he accused Mamdani of supporting Hamas.
“I think he should look at who he’s condemning, who he’s praising. He’s condemning Israel, the one democracy that stands shoulder to shoulder with American values,” the prime minister said during an interview this week with Sid Rosenberg on 77 WABC.
“Who does he champion? Hamas, that calls openly to massacre every Jew on earth, that conducted that horrible massacre [on Oct. 7, 2023], the worst massacre on Jews since the Holocaust.”
He also said Mamdani “doesn’t care” that “those who hate the Jews and Israel ultimately hate America.”

We’re seeing a lot of such posturing these days, including from Governor Andy Beshear (NSDAP-KY), wanting to appoint a replacement Senator for the Bluegrass State even though Senator Mitch McConnell is still alive, and Kentucky law does not allow such appointments for Senate vacancies, but mandates the calling of a special election. Candy Beshear is just setting himself up for his almost certainly failing 2028 presidential campaign.
Mr Beshear claims the authority under the state constitution, which gives him the authority to appoint people to state offices, but is silent on the appointment to a federal one. If he tried, there would be immediate lawsuits filed to prevent the appointee from taking a seat in the United States Senate, lawsuits which would drag on until Me McConnell’s term expired on January 3, 2027.
The Governor cannot simply declare the seat vacant. There are only three ways a senator can leave office early: death, resignation, or expulsion by the Senate. The state government has no authority at all in this matter.
The Mayor cannot arrest Netanyahu.

The International Criminal Court issued arrest warrants in 2024 for Netanyahu and former Defense Minister Yoav Gallant, charging both with war crimes and crimes against humanity, including the use of starvation as a weapon of war and intentionally directing attacks against civilians in Gaza. The ICC’s Pre-Trial Chamber found reasonable grounds to believe that Netanyahu and Gallant bear criminal responsibility for actions during the war in Gaza. All 125 ICC member states are obligated to arrest them and surrender them to the court if they travel to their territories.
Of course, United States is not and never was a member of the ICC and federal law does not recognize the warrant.
Furthermore, the UN Headquarters Agreement and Head-of-State doctrines grant visiting foreign leaders full diplomatic immunity, meaning federal authorities would protect Netanyahu from any local police action.
