While habeas corpus is a legal term that is invoked to require prosecutors to show a reason why they’re bringing charges against a defendant, it is translated from the Latin which means, “show us the body.” No one has “habeased” (Mitch) McConnell’s “corpus” so far. As such, it is more than reasonable to assume that, whether he has a tube down his throat and a machine is pumping oxygen into his lungs or his body lying in a morgue somewhere, he is dead. (And for those of you who are not in the medical profession, “brain dead” is “dead.”)
McConnell was already retiring from the Senate, and a Senate campaign there is ongoing. However, if McConnell were dead, my understanding is that a fairly recent state law in Kentucky would require the governor to call a special election before that time to install a new senator. To complicate things even further, if such a vacancy occurs less than 56 days before an election, that special election would NOT take place, but the state would wait for the general election. To make it even MORE complicated, I’ve also seen reports that say that, despite all this, Democratic Governor Andy Beshear could still appoint someone to take McConnell’s seat and fill out the rest of his term until January.
Right now, it seems that the Republicans are doing everything they can to “Weekend at Bernie’s” McConnell until September 8, 56 days before the November election.
