Beginning in 2016 Chief Justice John Roberts has slowly, now rapidly, changed the way SCOTUS operates. How? By using the so-called rapid “shadow docket” that bypasses lower court reviews AND extended discussions of cases. Previously, the shadow docket had been used for genuine emergencies, e.g., to halt executions. Now, the Court routinely makes rapid decisions on all levels of cases without significant review!!
“Since then (2016), even as the court’s approval ratings dropped, applications like the one it confronted a decade ago have proliferated, swamping the court’s ordinary work.
This is partly a consequence of a gridlocked Congress and presidents willing to push the boundaries of executive power, particularly Mr. Trump.”
But honestly, mostly because of our feckless, lazy, frightened and corrupt Congress.
