Biden Promises to Scrap New Devos Rule on College Sexual Assault
Former Vice President Joe Biden is promising to scrap newly proposed guidelines by Secretary of Education Betsy DeVos meant to ensure that individuals being accused of sexual misconduct on college campuses receive due process.
Biden, who most notably led the Obama administration’s “It’s On Us†campaign as vice president, criticized the education secretary on Wednesday for making college campuses “less safe.†In particular, the former vice president claimed DeVos’s “new rule gives colleges a green light to ignore sexual violence and strip survivors of their rights.â€
“Survivors deserve to be treated with dignity and respect, and when they step forward they should be heard, not silenced,†Biden said in a statement.
Hmmm. Nah, moving on
Under prior Obama administration guidelines, colleges were allowed to use a “preponderance of the evidence†standard when determining the guilt of those accused. Such regulations often led to lawsuits alleging the infringement of civil liberties, as many of the accused were not allowed to cross-examine witnesses.
Devos’s new regulations will allow representatives for not only victims but also the accused to call witnesses and challenge evidence. Such hearings, which will be either conducted in-person or virtually, will have to now to rely on a “clear and convincing†standard, rather than just a “preponderance of the evidence.†When investigating complaints, colleges will also have to rely on trained personnel to evaluate evidence and make final decisions.
What Biden wants to do is get rid of Due Process, as required by the US Constitution (as well as state constitutions). Guilty until proven innocent. People’s lives ruined because of accusations that often cannot be proven, that are based on regret over consensual sex, where Feminist friends talk someone into thinking they were assaults. If they really were assaulted, then the complaints need to go through the criminal justice system, not a kangaroo court at a college.
The university policies do not preclude legal proceedings, right? If a young man or woman claims to be sexually assaulted on campus the alleged crime can still proceed through the tortuous legal process. In the meantime, the university has the obligation to protect students from sexual predators in a “target-rich” environment don’t they. The school has no right to lock up the alleged perp but can suspend or expel them.
If your company had a person accused of sexual harassment that was investigated by the company and found to be true, would it be unconstitutional to fire the alleged offender, even without a court trial?
A national study estimates only 37% of reported rapes are prosecuted. 18% of prosecuted rape cases end in a conviction. Do you think 82% of rape accusations are false or does this mean 82% are hard to prove beyond a reasonable doubt?
Your daughter visits a classmate in his dorm room alone. They study, have a drink or two, and he assaults her. It’s her word against his. There is little or no physical evidence of assault since he claimed it was all consensual. Most cons would agree that she “had it coming” for making at least two mistakes.

All sexual assault cases should be handled through law enforcement. College administrators have neither the time nor the training nor the inclination to treat such cases fairly.
The esteemed Mr Dowd seems to believe that the college administrators have to do this to protect the cute, white coeds on campus,m but if these cases are not handled by law enforcement, then perhaps the accused gets expelled and booted off campus, making things safer for the aforementioned cute, white coeds, but still leaves the accused out on the streets. If he really is a rapist, I s’pose that limits his targets to laundresses and convenience store clerks, but, heck, who cares about them?

Do you think these people should be sentenced to prison on the basis of a fukin’ accusation”.
