Appeals Court Takes Out NYC Climate Scam Lawfare Suit

NYC could not run without fossil fuels. All the cars, trucks, limos, cabs, and ships. Planes and helicopters. About 47% of its power comes from natural gas. Mayor Mamdani uses lots of fossil fuels to drive around, and take flights back to Africa. It takes lots of fossil fuels to bring in all the food and goods, because NYC really doesn’t produce a whole lot.

NYC climate change suit against Big Oil runs out of gas

An appeals court Thursday swatted down New York City’s latest attempt to hold major energy companies responsible for the costs of climate change, agreeing with a lower court that climate-aware customers of ExxonMobil, Shell and BP weren’t reasonably duped by the “greenwashing” of their fossil fuel products.

As NYC says in its complaint, the primary driver of climate change is “the extraction, refinement and combustion of fossil fuels,” driving people to seek cleaner energy sources.

The energy company defendants, the city claims, deceived consumers by misrepresenting the climate effects of its gasoline, advertising them as “cleaner” and “emissions-reducing,” while failing to disclose their harmful impact.

For instance, ExxonMobil claimed that one of its fuels was “2X cleaner for better gas mileage,” while BP described itself as “working to make all forms of energy cleaner and better” and Shell claimed to be “a bigger player than you might expect in this budding movement to realize a cleaner and more efficient transportation future.”

But a trial court, and now a state appellate court, found ExxonMobil, Shell and BP advertising and promotional statements didn’t violate the city’s consumer protection laws, and held the city took the ads out of context.

The cult has been yammering about how Evil fossil fuels are, but, even in a city that overwhelming votes Democrat and supports climate action (in theory), few actually give up their own use of fossil fuels.

Local and state governments that engage in this kind of lawfare deserve to have their access to fossil fuels and any electrical generation based on natural gas cut off. That includes no vehicle traffic using internal combustion engines. No commercial air service to their airports.

Let them go back to life as it was in the 1870’s, or maybe earlier.

In essence, put these places under siege, forcing them to live up to their own professed moralities.

That will put a swift end to this kind of nonsense.

I keep waiting for truckers and trucking companies to say NY state is no longer worth the aggravation, and stop delivering stuff.
