I certainly understand the ruling in favor of the plaintiff: ICE 100% went over the line in this. But, to demand that ICE stop with 2 of the 3 policies? Nah. Complete overreach
Federal judge orders temporary halt to 3 immigration enforcement policies in Baldwin County lawsuit
A federal judge Monday ordered federal law enforcement officers to stop enforcing three immigration policies challenged by a Baldwin County man who claims he was the victim of illegal action.
Leo Venegas, an American citizen born in Florida, cited two different instances when immigration officers detained him at construction sites where he was working in Baldwin County last year. Chief U.S. District Judge Jeffrey Beaverstock largely agreed with Venegas, ruling that federal agents likely violated his constitutional rights.
Venegas sued in Mobile’s federal court, citing three policies:
- Warrantless entry. Venegas alleged that federal policy allowed agents to raid private construction sites without warrants.
- Preemptive detention. Venegas alleged that federal policy allowed agents to detain employees without specific suspicion that they are in the country unlawfully.
- Continued detention. Venegas alleged that federal policy allowed agents to continue holding workers even after they presented REAL ID-compliant driver’s licenses.
The government maintains that none of the three policies actually exist but that granting a preliminary injunction would “curtail Congressionally authorized Federal law enforcement of Executive Branch immigration policies, hinder lawful investigative searches, and chill routine field operations.”
The judge basically says that it should be no problem if the policies do not exist. As to the 1st, raiding, well, yeah, no policy, but, federal law allows this. The 2nd, I fully agree with the judge. If there is no suspicion, let them go. Period. The 3rd? Supposedly an illegal alien, which is the term used in federal code, cannot get a Real ID. However, there is the legal status, such as a green card, valid visa, DACA, or pending asylum, as provided by the Biden regime, which can cause state DMVs to give a real ID to tons and tons of illegal aliens when they really shouldn’t.
The lawsuit against DHS and ICE can continue.
Teach, please explain: “As to the 1st, raiding, well, yeah, no policy, but, federal law allows this.” How could Federal law allow what seems to be a violation of Constitutional rights by allowing da Feds to “raid private construction sites without warrants”? Are State and local agents allowed this as well?
