An immigration judge has ordered the deportation of a former New York City Council employee federal officials said in January was an undocumented immigrant with a prior assault arrest.
City Council Speaker Julie Menin announced the deportation ruling on Wednesday, condemning it as a “miscarriage of justice and wholly deplorable” and pledging to fight back by filing an appeal.
Two months ago, Rafael Andres Rubio Bohorquez, 53, was detained during an immigration appointment and was identified by the Department of Homeland Security (DHS) as a Venezuelan “criminal illegal alien” who overstayed his visa.
“This is an affront to justice,” Mamdani added in a post on X. “A dedicated public servant with legal authorization to remain in the country, Rafael showed up for a routine immigration appointment and, despite following the rules, he was detained and has now been held for months.”
Except, he came to the US on a tourist visa in 2017 and never left. His lawyers are claiming he had an asylum. They also claim he was on TPS. Which is it? He was arrested for fighting with his roommate and breaking his nose. The arrest was sealed (because he was an illegal, of course. It wouldn’t have been sealed for an American citizen), and did not disclose this during an asylum application. The judge has ruled for deportation. He went through the system as Dems wanted. Now he gets to leave. And per a Supreme Court ruling, non-immigration, wackadoodle federal judges may not intervene.

Judge orders release of MS-13 gang member who was in ICE custody
The Department of Homeland Security (DHS) this week issued a warning statement after a judge appointed by Barack Obama ordered the release of Carlos Antonio Flores-Miguel, an illegal immigrant with a serious criminal record.
The undocumented immigrant was in the custody of Immigration and Customs Enforcement (ICE) and is a member of the Mara Salvatrucha (MS-13) gang, the release noted.
According to the release, on Jan. 20, 2026, ICE conducted a targeted operation to arrest Flores-Miguel in Minnesota. During the arrest, he resisted violently, punching and kicking security agents. He even snatched a holster from one of the officers.
However, earlier this month, a judge ordered his release. His criminal record in the United States includes rape, resisting arrest and illegal re-entry. According to documents, Flores-Miguel was also arrested in El Salvador for robbery.
First Democrats say only catch the bad ones. When they are caught they want them released. Too bad they can’t force the judge to take the illegal into their own home.

Another right-wing provocateur, a pedophile-hunter, “The Zerggg”, caught Jake in a sting using a purported 15 year old “girl”. Jake, 30, and always a gentleman, told “her” he couldn’t “have her” until she was 16!!
