DOJ says states must report all undocumented immigrants — or lose federal funds
The Justice Department has adopted a sweeping new legal interpretation designed to compel states to assist the Trump administration’s immigration crackdowns.
The new opinion from the department’s Office of Legal Counsel — which provides advice to the attorney general — outlines a new path for the federal government to yank federal funding from states that don’t aid the administration’s mass deportation push.
It says any state that draws on massive federal programs to provide financial assistance to low-income residents — which every state does — must report to the Trump administration any immigrant it believes is residing in the country illegally.
Prior administrations concluded that the requirement to report known undocumented immigrants applied only to state agencies implementing those federal programs.
But the new opinion instead determined that the reporting requirement extends to the entire government of a state receiving federal funding through either the Temporary Assistance for Needy Families program or Supplemental Security Income — two enormous safety net programs for low-income families as well as elderly and disabled residents.
“Congress wrote this requirement plainly,” Assistant Attorney General T. Elliot Gaiser said in a statement. “When a state chooses to participate in TANF, it accepts the obligation to report illegal aliens in the United States. Tax dollars intended to help vulnerable Americans should not perversely encourage illegal entry into the United States, but rather should reinforce our laws and our borders.”
Oh, this is going to cause massive teeth gnashing from the moonbats, eh? Of course, yeah, some wacko liberal judge, probably one of the same old same old ones, will rule against this, be reminded they can only speak for their own district, then get reversed on appeal
I doubt they will actually do this, but, I wouldn’t be surprised if ICE agents in full ICE apparel show up around some polling places in the first days of early voting, simply to discourage illegals from showing up. That’s really what this is about.
