NY Times: Overturning Roe Isn’t Conservative Or Something

We’ve had plenty of unhinged Hot Takes over the leaked SCOTUS document on Roe v Wade. Then, we get the folks who are supposed to be allies. Here’s the NY Times’ resident Republican (who’s really a necon and inflicted with Trump Derangement Syndrome)

Overturning Roe Is a Radical, Not Conservative, Choice

Dear Chief Justice Roberts and Justices Barrett, Gorsuch, Kavanaugh and Thomas:

As you’ll no doubt agree, Roe v. Wade was an ill-judged decision when it was handed down on Jan. 22, 1973.

It stood on the legal principle of a right to privacy found, at the time, mainly in the penumbras of the Constitution. It arrogated to the least democratic branch of government the power to settle a question that would have been better decided by Congress or state legislatures. It set off a culture war that polarized the country, radicalized its edges and made compromise more difficult. It helped turn confirmation hearings for the Supreme Court into the unholy death matches they are now. It diminished the standing of the court by turning it into an ever-more political branch of government.

So, it was a horrible, terrible, no good decision? Let’s get rid of it

But a half-century is a long time. America is a different place, with most of its population born after Roe was decided. And a decision to overturn Roe — which the court seems poised to do, according to the leak of a draft of a majority opinion from Justice Samuel Alito — would do more to replicate Roe’s damage than to reverse it.

That means nothing. The Constitution is the Constitution. If you do not like the words, try and change it with a Constitutional convention

It would be a radical, not conservative, choice.

What is conservative? It is, above all, the conviction that abrupt and profound changes to established laws and common expectations are utterly destructive to respect for the law and the institutions established to uphold it — especially when those changes are instigated from above, with neither democratic consent nor broad consensus.

Well, that’s the neocon view. The real view, based on the Classical Liberal/Federalist beliefs is that the Constitution is the Constitution, that the federal government’s powers should be limited to what the Constitution grants them, and everything else is held by the States and The People. Do we care if it can “cause damage”? We either do The Right Thing, the constitutional thing, or, we abandon our beliefs. Stephens continues with his idiotic pandering to the left by claiming keeping Roe would be Conservative for awhile, you’re welcome to read it.

And, then, of course we have Squishy Susan Collins

Sen. Susan Collins, R-Maine, said Tuesday that if a report suggesting that the U.S. Supreme Court is poised to overturn Roe v. Wade is accurate, she was misled in her conversations with two justices who had told her that the landmark 1973 abortion ruling was settled law. (snip)

“If this leaked draft opinion is the final decision and this reporting is accurate, it would be completely inconsistent with what Justice Gorsuch and Justice Kavanaugh said in their hearings and in our meetings in my office,” Collins said in a statement. “Obviously, we won’t know each justice’s decision and reasoning until the Supreme Court officially announces its opinion in this case.”

I highly doubt either said it was settled law, because it is not law. Obviously, the argument made in the case that has SCOTUS considering overturning Roe was better than the argument in favor of keeping Roe. Here’s David Harsanyi

Senator Susan Collins says that Samuel Alito’s draft opinion overturning Roe v. Wade is “completely inconsistent with what Justice Gorsuch and Justice Kavanaugh said in their hearings and in our meetings in my office.” Ramesh and Ed have debunked this claim. Conceding that long-established precedents should be treated with more weight does not preclude the possibility that those decisions were wrongly decided and should be overturned. Plessy was on the books for over 60 years. As Chuck Schumer noted at the time, “this is not as simple as Judge Kavanaugh saying that Roe is settled law. Everything the Supreme Court decides is settled law until it unsettles it. Saying a case is settled law is not the same thing as saying a case was correctly decided.”

With friends like Collins and Stephens, who needs enemies? And, of course

Yup, Trump broke them so much they can’t even stick with American Conservative principles and stand up for doing away with killing the unborn.

    Slavery was settled law, too.

Bill Kristol lost it when Trump decided not to start more wars. The RINO right is apocalyptic over the fact it has been much harder to take under the table kickbacks to favor leftist-run corporations now.

The Lincoln Project reminds me of a bunch of petulant children throwing a temper tantrum, but I will give Kristol one kudo.

The states are set to disentangle themselves one from the other on the merits of their self-interests. IF Roe v WADE is struck down it will simply go to the states and there are 20 plus states, even a couple of red states will most likely keep it legal to seek abortions. This is as it should be.

But even that is not the problem for the left. I was listening to speeches and the left wants your insurance to pay for a dozen, two dozen abortions over and over and over again. FOR FREE!! Just as they want them to pay for sex changes even though they don’t pay for elective plastic surgery they now should pay for sex changes and baby murder.

It goes way beyond the ability to simply get an abortion in this country. Woe is them for having to travel a few hundred miles to get an abortion rather than at their local 7=11.

Just wait ’till they get old and find out insurance only covers basic cataract correction. If you need more than basic, bring money.

First, I’d like to apologize to Teach and all you normal American patriots for my off-the-wall comment to the asshole QdOwd yesterday. Sadly I let the hateful nazi bastard get under my skin and ranted like he does and I’m better than that and so are you guys. I retract nothing I said about him, I am just sorry you good folks saw it and Teach in his fairness printed it.

Once again the left is trying to steal an election. We should have expected it. Frankly I never expected them to undermine the sanctity of the court. I guess one can’t lower the bar enough for leftists. They never fail to amaze at how low and despicable they can go. And then they go lower.

Anyway, Doom and Gloom remarked that “there are 20 plus states, even a couple of red states will most likely keep it legal to seek abortions.” I think almost all states when given the freedom from their democrat/commie oppressors to choose for them selves democratically will opt for some abortions limited as they may be in a few and broad in others.

That’s what our republic is all about and that’s what irks leftists the most. We all know that the blatant racism of the left and the joy of knowing that millions of black babies will die. They never forgave blacks from breaking the chains and love the idea that over 20 million blacks were murdered by abortionists since 1973.

As I’ve pointed out before, every place fascists and communists like what our democrat party has become gains power all they do is leave a pile of bodies. Even Hitler, Stalin and Pol Pot didn’t kill as many as Qdowd and his abortion killing machine and even they didn’t just murder little babies. There is something deeply sick about the democrats.

    FJB and his baby killers.

    • Model 870 P. dOwd says:

White women get more abortions than Black women.

A zygote is not a baby.

If nuCons actually cared about women and children they would work for access to education, empowerment of women, income and wealth equity, free contraception and stop enabling rapist’s parental rights.

But no, they’d much rather control a woman’s sexual behavior. That 12 year old girl who lured uncle david into her bed. The 13 year old who willingly went to Epstein’s Manhattan mansion for a “modeling” gig and was raped by DonJontRumPutin, who is still free to rape again. Never once do nuCons acknowledge that it takes “two to tango”. Why not mandate DNA testing to track down the sperm donor, absent father, rapist or brother/uncle who is equally responsible for the pregnancy?

After all, according to nuCon boys, all women are whores and bitches.

      • Jl says:

Funny-“white women get more abortions than black women”. Gee, could that be because there’s a lot more white women?
Actually, black women abort at a rate 5 times what white women do. This from 2008 but I’d expect it to be about the same today

      • L.G.Brandon!, L.G.Brandon! says:

The idiot states: “A zygote is not a baby.”

A zygote is a fertilized egg cell in the development of humans and other animals. I don’t think anyone here confuses it with a baby. We also don’t confuse it with a Cadillac. A zygote is the first stage of human development. Not a baby but still a human. That only exists till the first week or so of pregnancy then it becomes a blastocyst. By the 4th to 10th week said blastocyst becomes the embryo. Another stage of human development and still a human, QdOwd. Then a fetus and so on. At no stage of human development or birth is the fertilized egg anything but a human being. It will not magically change into a dolphin, a rat or a deer. It is human.

BTW QdOwd, when a woman is pregnant does she say she’s having a baby or a moose?

Your ridiculous attempt at trickery and word abuse (common among fascists) will fool no one here. For determination not to follow the science would be even with that of your same refusal regarding climate change, Covid, and men either menstruating, giving birth or becoming women. All are ignorant and a complete dumbassed position.

We’d have more respect if you just admitted you believe a “woman’s right to kill her kid” is a higher priority to you than her baby’s right to live. At least it would be both biologically correct and truthful. Right now you and those morons who agree with you are just scientifically ignorant and liars.

Abortion ends the life of an unborn human child. We know it. You know it and we know you know it. You’re just too fukin’ evil to admit it.

        FJB and abortionists.

          The Lying Groooomer is panicked!

An unborn child is still unborn. For all the Lying Groooomer knows the gods might have taken the unborn even if the desperate mother had not received an abortion. The Lying Grooomer and his odious ilk would have a woman executed for aborting a potential person that god might have planned to abort anyway!! And what of the millions of zygotes that god flushes down the toilet? Many fertilized eggs never implant in the endometrium by chance. These “babies” end up in the sewer system. Why is their no GOP plan to save THEM?

Female humans are born with about 6 million eggs. By reproductive age (12 for Republicans; 18 for normals) girls have only about 200,000 to 300,000 eggs left. So millions of potential babies are lost. These eggs could be combined with billions of excess spermatozoa and the state could raise them! But no. Cons only care about punishing the potential mothers of potential babies!

The right is heartless death cult of heartless bastards who hate women. Male cons think women owe them sex and want to punish them for having sex with men who are not them! Incels.

Ruh roh… there are more females than males in America. NuCons are fukked and not in the way they want.

  4. Elwood P. dOwd says:

There is a long list of activities and items not enumerated in the Constitution. Abortion, semi-auto rifles, machine guns, EPA, Social Security, Montana, Communism, Covid, clean air, voter ID, marriage, same sex marriage, FBI, CIA, Medicare, F-35s, Islamists, twitter, WWII, Air Force One, Alaska, DonJon tRumPutin, the US flag, unemployment payments, unearned income, contraceptives, pornography, cable television, facebook, etc, etc and etc. The original Constitution doesn’t even promise the “right to vote” a fact conservatives have long used to suppress the votes of “undesirables”, women, the poor, the non-white, the powerless… Amendments specifically addressed women, Blacks, age, poll taxes but that hasn’t stopped Red States from enacting voting regulations favoring conservatives. Even the only intelligent conservative commenter here longs for the days when only adult white men who owned property could vote!

It’s almost as if the Constitution is a framework for conservatives to pick and choose from, sort of like cafeteria christians who want to oppress LBGTQ individuals but won’t give up pork, oysters or working on Sunday.

The American nuRight is a fascist cult using the Constitution, Bible and white nationalism as shillelaghs to bash their supporters into submission.

The American nuRight is a fascist cult intent of destroying then rebuilding America in their image. Welcome to the Republic of Gilead!!

I don’t see the point of DemComs crying about whether a SCOTUS decision is “conservative” or not. Let’s just say it IS. Who cares? Every decision can’t be for the Left. That’s life, guys.

  7. Jl says:

    “Voting regulations supporting conservatives”
Nope-they equally apply to everyone, and there’s no proof that those laws disenfranchise anyone’s vote.

  8. UnkleC says:

Lefties just want to tilt the field to their advantage. The majority of polls have shown that voters have no problem with i.d. laws, etc. Not to mention that the evidence of ‘voter discouragement’ from such laws is usually in the dim, twisted mind of said lefties.
