If Democrats really want this rule, they should attempt to specifically pass it in Congress. That’s where something of this magnitude belongs, not an Executive Branch agency using sorta maybe possibly related in a tiny way language from previous legislation that is really unrelated

Supreme Court may toss an ‘important tool’ for regulating climate change

The Supreme Court is on the verge of restricting the Environmental Protection Agency’s ability to limit carbon dioxide emissions from power plants.

The court’s conservative majority appears likely to side with Republican-controlled states and coal companies in West Virginia v. EPA, for which the court heard oral arguments on Feb. 28 and is expected to issue a ruling in June. Such a ruling could eliminate some of the key methods that the Biden administration can use to accelerate the power sector’s transition to cleaner sources of energy, potentially hamstringing its ability to meet the president’s goal of halving greenhouse gas emissions by 2030.

Experts say the court is virtually guaranteed to side with the petitioners — a coalition of red states and coal companies — but that the still unknown logic and details of the ruling may determine the shape of U.S. climate regulation in the future.

“Taking the case is a very clear sign that they’re going to rule against EPA in some way, but we don’t know how,” David Doniger, senior strategic director of the Climate & Clean Energy Program at the Natural Resources Defense Council, told Yahoo News. “It wasn’t clear from the oral argument what the dominant approach would be.”

Observers do not expect the Supreme Court to overturn previous rulings that give the EPA authority to regulate carbon pollution, but they say it’s possible the court may say the agency cannot use certain tools in doing so.

It all depends on how the ruling goes. It looked like Obama’s Clean Power Plan was on it’s way to getting whacked at the Supreme Court, having almost always lost at the lower court level, until the Trump EPA did away with it. It should cause a lot of apoplexy from Warmists if the Court rules against the EPA. You know, the same Warmists who won’t make their own lives carbon neutral.

    King Coal is back, baby!! The Supreme Court is THE true head of government in the U.S. of A. And we owe it all to King DonJon, the Gift from God that keeps on giving.

    The U.S. has a thousand year supply of coal buried underground in Wyoming, Kentucky, West Virginia and Pennsylvania, where God put it for us to use. If we’re able to remove the commie Obama-era constraints on coal-fired power plants as God intended we can stop all this carbon-free BS!!. Energy prices will plummet. Jobs. Jobs. And more Jobs will be created. Coal miners in WV and eastern KY will be wealthy like they once were and return to the luxurious lifestyles of the past! The U.S. had 883,000 prestigious coal-mining jobs 100 years ago. Now, it’s less than 5% of that! All because of government regulations!

    Conservatives understand that CO2 is good for the Earth. Warmer is better. Cold kills. The anti-progress do-gooders have caused enough damage with their anti-coal hysteria.

    The greatest benefit is that we will no longer depend on Russian and Saudi oil and gas!

    Next, SCOTUS can disarm the acid rain and ozone layer BS!! Freon is back, baby!!

      In the last 15 or so years the USA has shut down 1/2 of their coal fired power plants. Coal is not back and is indeed a dying dinosaur.

      Why?

      Natural gas is much cleaner and it is in amazing abundance in the USA. In fact Coal only fires up 19 percent of the USA’s energy requirements. The same amount as Green Energy. In the next 10-15 years green energy will most likely replace coal to the point the strategy seems to be that these coal plants will be used only for emergiencies during peak power generation times. Dec.-Feb.

      As Ususal Dowd just screams at the USA while Ignoring his home country of CHINA which has turned the daytime skies black across 1/2 of the northern Hemisphere with fumes from Coal and pollution that travels the world.

      But blame the USA…force the USA into bankruptcy for your benefactors. CHINA, RUSSIA, IRAN, SAUDIA ARABIA…

      John-why should we decarbonize? “The USA is decarbonizing…” And China and India are “carbonizing” at such a fast rate that total emissions keep going up. So what Maryland does will be irrelevant, other than costing the tax payers money.

    Jl is is more correct to day that normal rain is acidic at 5.3ph
    “Acid rain” normally refers to ph as low as 3.2
    For those who don’t remember their high school chemistry that means that “avid rain” is about 200 times as acidic as “normal” rain
    Shouldn’t jl have told us that?
