It’s a funny thing: people constantly talk about how the government mandates citizens to get vaccines, such as for smallpox, measles, mumps. Except, those mandates are not coming from the federal government, they are primarily from the state governments, because there is no actual law nor constitutional authority to impose vaccines on U.S. civilians. Sure, they could force members of the military who haven’t had them, and probably employees of the executive branch. That’s pretty much it for U.S. citizens. And, the Brandon admin still has to win for the 100+ employee mandate. So, sure, let’s go further

Surgeon General Murthy: Vaccine Mandate for Smaller Businesses Not Off the Table

Surgeon General Vivek Murthy said Sunday on ABC’s “This Week” that President Biden’s administration has not ruled out a federal vaccine requirement for small businesses.

Anchor Martha Raddatz said, “Labor Secretary Marty Walsh defending those new vaccines and testing requirements for companies with 100 or more employees. It comes amid pushback over two dozen states and a new legal challenge in court.”

She added, “Let’s start with those legal challenges. The 5th Circuit Court of Appeals yesterday blocked the mandate citing grave and statutory and constitutional issues. I know you’re not a lawyer, but is the administration confident this can survive the legal challenges?”

Murthy said, “Well, Martha, the president and the administration wouldn’t have put these requirements in place if they didn’t think they were appropriate and necessary….

It may be appropriate and necessary, but, that doesn’t make it legal and Constitutional. Certainly not at the federal level

The administration is certainly prepared to defend them, but let’s step back for a moment and just look at why these are so important. Throughout our history that we have seen, we had to use vaccine requirements to protect the population, starting back with George Washington when he required troops be inoculated for smallpox, and schools started having vaccine requirements.

Yes, troops. We also had no Constitution and no laws during the War for Independence.

If you think about our workplace, it’s important our workplaces are safe, that workers feel safe, and our customers feel safe. We know at this point in the pandemic when we’ve come so far, and we have 75,000 cases a day, it’s important we take every measure possible to make our workplaces safer.”

Same people said there was no way we’d have a vaccine this soon. Nor do they give any legal reason why civilians should be forcibly vaccinated.

Raddatz asked, “If the law survives legal challenges, will the administration be extending the mandate to smaller employers with fewer than 100 employees?”

Murthy said, “Well, Martha, certainly nothing is off the table at this moment, but the focus is implementing the current rule that OSHA put out. Let me just emphasize that what we put out in a report recently is that average businesses that put these requirements in place see a 20% vaccination rate increase, boosting them in the 90s. If vaccines are a key pathway out of the pandemic, this will do a lot to get us toward the finish line.”

Sure, this will cause no problems with small businesses. Further, these same people aren’t requiring illegal aliens to be vaccinated before they cross the border, eh?

    As if the vaccine waters are not muddied enough a Pfizer whistleblower comes out saying that Pfizer did a shoddy job of evaluating their vaccine prior to it being given EUA.

    Now Pfizer and Merck who railed against Hydroxy and Ivermectin have their own Pill form of antiviral they want to sell for billions and billions and billions.

    People are being sickened by these vaccines. Young Athletes are losing their ability to play because of the vaccines and now on top of that, it appears a new super cold is making its way around that might be linked to the vaccines.

    Hospitals are firing doctors and nurses because they refuse to be vaccinated(these people are risking their lives for you and you want to fire them) and yet this is about the science. People as of yet do not know what long-term side effects this might have. Many, especially the young who want to have families were scared away by reports of infertility, which of course is debunked by a bunch of angry white men who want to make billions. Is it true or not. The inventor of the mRNA vaccine went to the EU and told them to stop this vaccine because it might not be safe and might cause infertility. Scary stuff for some people to hear.

    The fact any government on this planet is mandating a vaccine is preposterous. This is being done out of fear for themselves and not fear for the people. H1N1 was bad and the pandemic of 1918 witch killed 1-3 percent of the population did not have any drugs of consequences and it eventually died out. Again this begs the question as to why so many are objecting to people refusing to be vaccinated.

    If the vaccines work, then those that are vaccinated will not catch the virus from those that are not. If wearing a mask is so powerful a tool then if you are vaccinated and wear a mask you should never get sick. So why this massive push to end an endemic that will likely never go away?

    This my friends are why they changed it from Immunizized to Vaccinated. Because these drugs were never going to be 100 percent effective. In fact, they are barely on average over a 6-month course of treatment collectively only about 50 percent effective. The J&J vaccine according to a VA study drops to just 3 percent effective after 6 months. But if you get that almighty booster shot then you are suddenly saved and headed for the promised land.

    None of these drugs were ever 90-95 percent effective. That being said I do believe they prevent you from getting really sick but again. Those on the left are obsessed with everyone getting a shot much like the right used to be obsessed with your bedroom activities. Muddied waters.

      Not sure that Pfizer and Merck “railed against Hydroxy and Ivermectin” but the scientific data showed neither was effective. The new anti-viral meds have successfully completed randomized, placebo controlled, double blinded clinical studies and show effectiveness.

      The side-effect profiles of the vaccines are pretty standard. It is true that “according to the US Centers for Disease Control and Prevention, myocarditis/pericarditis rates are ?12.6 cases per million doses of second-dose mRNA vaccine among individuals 12 to 39 years of age.”

One may have had this “cold” before and just assumed it was a “cold”. Masks and handwashing will reduce your risk! I would usually get 3-5 “colds” a year, but none since the pandemic started. Masking, social distancing and handwashing!

      The inventor of the mRNA vaccine went to the EU and told them to stop this vaccine Dr. Robert Malone claims he invented the mRNA vaccines – he didn’t, but his research DID contribute to the development. Dr. Malone has offered many misleading claims about the mRNA vaccines.

      There is no evidence that the mRNA vaccines cause infertility.

      The 1918 pandemic which “died out” killed some 700,000 Americans, and the young were particularly impacted. Note too that the US population then was less than one-third what it is today.

      “Mortality was high in people younger than 5 years old, 20-40 years old, and 65 years and older. The high mortality in healthy people, including those in the 20-40 year age group, was a unique feature of this pandemic.”

      It is not true that the vaccinated will not catch the disease. For viral diseases this depends on how quickly the viruses replicate in a host. Some viruses are slow replicators, e.g., smallpox. The coronaviruses replicate more rapidly and people can be infected but “kill off” the rapidly replicating virus more slowly.

      Look at it this way, the Covid vaccines transform Covid from a severe disease into just another mild “cold”. That’s a pretty good outcome, don’t you think?

      So why this massive push to end an endemic that will likely never go away?

My understanding is that that would require a patient base of at least 100,000. In other words impossible in the current circumstances. So you make a statement that is of no sense. As usual.

      At least with stupid seat belt laws, they have very small fines, don’t put points against your driver’s license, disobedience is almost invisible, and people don’t lose their jobs for not wearing one.

      Those laws should be repealed. Actually, they should be declared unconstitutional, but no one is going to press a case all the way to the Supreme Court over a $25 fine.

      In the 1970s, a bunch of states passed mandatory helmet laws for riding motorcycles, but many of those have been subsequently repealed, because riders hated them.

          I’m old enough to remember when the mandatory seat belt usage laws were passed. At least at first, they were written so the police could not pull you over for just that; it was a secondary offense.

          But, of course, unless it is icy or snowing, I never wear one; I choose not to do so. In my 2010 F-150, there is a way to reprogram the seat belt alarm to not sound, and that has been done.

        Federal workers are under a different mandate than workers covered by OSHA. It’s the latter that has been temporarily stayed by the federal appeals court. But it’s not stayed because it is beyond the power of the federal government generally, but stayed because it is allegedly beyond the power delegated by Congress under OSHA.

        OSHA is asserting emergency rule-making powers, but the courts will decide if they are working within the statute. Otherwise, OSHA will have to go through the rule-making process as mandated by the Administrative Procedure Act, but that takes time.

    You missed the part where the CDC rent moratorium was challenged and the Supreme Court ruled that not only did the CDC not have the authority to make such a moratorium, but that because of the time frame from the start of COVID to the issuance of the moratorium the rule could not be considered an “emergency.”

    You also have the issue that courts have ruled that vaccinations come under union contracts and must be negotiated and cannot be mandated.

    Secondly, Florida asked for data from the Biden administration on the number of immigrants being flown to Florida under the Biden relocation plan. Florida asked for the data on the number of people that needed to be vaccinated, were vaccinated, and whether they were fully vaccinated.

    The Federal government has as of this date refused to supply that basic data.

    Lastly, you are making the assumption that all of the people that are crossing the border are crossing at monitored points. We know that is not the case. The idea that all immigrants are vaccinated flies in the face of reality.

        While we can discuss whether the statutes are the same, the meaning of the word “emergency” translates across both statutes.

        If they are working legally in the country, they would have met the requirements you believe stop people from entering the country if not vaccinated.

        If they get vaccinated, they create a record of being in the country illegally.

        Once again, the Biden administration is refusing to supply the data for states who will face the brunt of this unvaccinated invasion of people.

        If things were going as you assert, why not supply the data? Why hide it?

        Secondly, in that the people crossing the southern border are mostly Hispanic, this comes into play:
