Dem Rep Green: Trump Doesn’t Need to Commit a Crime to Be Impeached — 218 House Members Decide

Thursday on “Democracy Now,” Rep. Al Green (D-TX) said President Donald Trump could be impeached without having committed a crime.

Green said, “This is a very sad time in the history of our country. This is not something that I enjoy talking about, nor is it something that I would like to do. But I think it’s becoming increasingly clear that the president will have two options: One, he can resign from office, or, two, he can face impeachment. Impeachment is something that the Framers of the Constitution provided for a time such as this and a president such as Trump. The president does not have to commit a crime to be impeached. In fact, the president is not likely to be indicted, which means he’s not likely to be found guilty of a crime while he’s sitting, which means that if this comes before the House, it won’t come before the House as a president who has been found guilty, but rather as a president who is alleged to have committed certain offenses that are onerous to the Constitution and that harm society. And what this president is doing is harming society.”

Uh huh

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors. (Article II, Section 4)

I missed the part about not having to have committed a crime nor about “harming society.” Democrats like Green should think long and hard about this, because they could set a precedent that comes back and takes a big chomp out of their posteriors, much like with Obama’s pen and phone, and Harry Reid nuking the filibuster.

Anyhow, everyone has to love this

  1. Mangoldielocks says:

It took congress over a year to investigate and try Bill Clinton. Upon clearing him the very next month the Whitewater trial began. Do you see a pattern here>?

The pattern is to paralyze the president with legal maneuvering. Now lets for a moment look at both Andrew Jackson and Bill Clinton. They were both impeached and stood trial. Their deeds were clear as day. Jackson quite clearly broke the law by attempting to remove Stanton from office without consulting congress. A clear crime for the president to violate the law at that time.

Bill Clinton quiet clearly was guilty of violating the law by obstructing justice. Never mind his moral ambiguity.

Neither were impeached but the government was shut down and paralyzed for well over a year because of the political actions of the opposite party.

The resistance will in fact impeach trump on Obstruction of justice. They do not care if they can prove it or not. He asked Comey to ease up on the investigation of his buddy. Its political. With enough votes they could impeach trump even if they did not have evidence.

Only the charge is sufficient. Take for example how many people are in prison for crimes they did not commit? It is only necessary to invoke a charge of crime and then go to trial.

So while you technically make a valid argument as Alan Dershowitz points out repeatedly, Impeachment is political above all.

Trump only has to be charged with a crime and there is no way on earth any democrat would vote non guilty, it all depends on how many never trumpers would vote Guilty to do the deed.

    • Jeffery says:

Both Clinton and Jackson were impeached but not convicted by the Senates.

“The President, Vice President, and all civil Officers of the United States shall be removed from Office on Impeachment for, and conviction of, Treason, Bribery, or other High Crimes and Misdemeanors”

The crimes are what the House and Senate say they are. Trump will end up with a host of charges – obstruction, bribery, money laundering, conspiracy and heaven-forbid, treason. Mr. Mueller is a thorough and careful prosecutor and is turning over his cards one at a time.

Trump’s behavior with Putin and the Russians is inexplicable.

Trump has little choice but to resign after making a deal with the DOJ to keep himself and his family out of prison.

    • McGehee says:

      Not Jackson. Johnson. 1868.

Andrew Jackson had been dead 23 years by then.

    • formwiz says:

Hate to tell you, idiot, but they were impeached. Impeachment is the government equivalent of indictment.

And Willie wasn’t cleared, the Demos just voted the party line.

      Christ, what an ignoramus.

      • Jeffery says:

As I said, they WERE impeached. Can’t read?

President Clinton was not convicted by the Senate, that is, he was acquitted.

the Demos just voted the party line

So you admit it was a political witch hunt to ‘get’ President Clinton.

Do you think President Clinton’s ‘crimes’ were worse than the Orange Sh1tgibbon’s?

        What an ignoramus.

  2. I’m afraid they’re quite correct, given that if the Dems take the House, all they need is a majority vote to impeach, and if they take the House they are by definition the majority, and a “high crime or misdemeanor” will be whatever the majority of the House (the Dems) SAY it is. There is no way to contest their judgment on that matter, however silly it may be.

Of course, then they’ll have put Trump in the same bucket as Clinton–an impeached President. That does nothing unless the Senate votes to convict, by a two-thirds majority.

    –Andrew

    • McGehee says:

This is, pragmatically speaking, correct. There is no judicial review for impeachment, so there is no way to block a foaming-at-the-mouth Congress full of Jefferys from impeaching Trump just for breathing “the people’s” air.

      • Jeffery says:

We assume you opposed the impeachment of President Clinton?

Everyone except the foaming-at-the-mouth tRumpitistas recognize that tRump has multiple past acts that may rise to impeachable offenses.

He may have conspired with Russia to bugger the election. He very likely tried to influence the election by bribing ex-girlfriends, and then tried to cover it up.

While in office, his relationship with Russia and Putin is inexplicable.

The “Witch Hunt” is finding many witches.

The Trump Inc. CFO was just granted immunity, as was the head of the National Enquirer. More “flippers” wanting to stay out of prison.

If Trump has been laundering Russia mob money for decades, as claimed, is that an impeachable offense? Would you be concerned that those acts might compromise the president’s interactions with Russia/Putin?

        • formwiz says:

          Find proof.

And the witch hunt has found a guy exonerated of the charges 8 years ago, a guy who pleaded guilty to a non-charge (see Alan Dershowitz), and a bunch of Russians it has made no effort to interview or extradite.

And most of your flippers, if that they are, are being coerced.

Find somebody who isn’t being threatened with 80 years in prison.

He may have conspired with Russia to bugger the election.

Bugger the election? That’s how you think? And “may” is not good enough. This country runs on evidence.

He very likely tried to influence the election by bribing ex-girlfriends, and then tried to cover it up.

          Not illegal, sweetie.

          • Jeffery says:

It seems the prosecutors are finding sufficient convincing evidence for juries. And Cohen’s lawyers. Do you think Cohen’s lawyers just don’t understand criminal law and that’s why they let him plead and then implicate tRump.

the witch hunt has found a guy exonerated of the charges 8 years ago

I keep hearing that, can you support that claim?

If you haven’t heard yet, the latest right-wing meme is that Cohen is actually a Clinton stooge out to get the Great Trump – after all, Lanny Davis has Clinton connections.

Dershowitz has become an avowed Trump defender. He has previously been involved with the defense of OJ Simpson, Harvey Feinstein, and Trump’s pedophile buddy, Jeffrey Epstein. Most lawyers disagree with his “legal” assessments regarding Trump. The prosecutors do, the judge did, and Cohen’s lawyers do. Rudy agrees with Dershowitz.

We’ll see if trump committed any crimes, sweetie. It doesn’t look good for trump. He’ll resign after arranging a deal. He’s gutless and may throw his own kids under the bus.

        • McGehee says:

Clinton suborned perjury. That actually is a crime.

  3. Mangoldielocks says:

And something I wanted to point out with Trump. The Democrats obsession with blocking everything Trump would negate year three of his administration as the Democrats with control of the house and senate could have dozens upon dozens of investigations, paralyzing congress and negating everything Trump wanted to do. It is their plan. Getting 67 votes might be a stretch but they do not care. Impeachment proceedings themselves would be sufficient for the leftist base and would castigate Trump for most likely the next two years he is in office.

    • formwiz says:

Man? You think you’re a man? Not if you lie like that.

Considering the Mollie Tibbetts case, I don’t think you have to worry about Trump 3.0. It’s going through. People want the illegals gone. 5000 murders a year.

And, oh, yes, Americans don’t elect people to Congress to negate and paralyze things.

Leftists like you might, but Americans don’t.

      • Jeffery says:

People want the illegals gone. 5000 murders a year.

Who commits 5000 murders a year? Let me guess, you got that number from Tucker.

We’re calling bullscheisse on you. Please clarify/present evidence.

Otherwise, we’re calling you out as an ignorant liar. But maybe it’s just a mistake on your part.

        • formwiz says:

Where’s your source? You throw allegations through the air constantly, but never any sources.

And who’s this “we”? You and the mice in Mom’s basement? Do they talk to you?

Try Congressman Steve King, for openers.

And shut your stupid hold. The only ignorant liar is you.

          • Jeffery says:

            Your president-for-now said:

“Sixty-three thousand Americans since 9/11 have been killed by illegal aliens. This isn’t a problem that’s going away, it’s getting bigger.”

So 63,000/16 is about 4,000 per year. But tRump is a known liar, as is Steve King.

            Snopes:

Not only is there no evidence for his claim, it would require a seemingly superhuman murder spree by the nation’s roughly 11 million undocumented immigrants… The bogus figure appears to have originated in a May 2006 post by Republican Rep. Steve King of Iowa complaining about the “Day Without An Immigrant” campaign calling attention to the contributions of immigrants to U.S. community…. King misrepresented a report from the Government Accountability Office, claiming that 25,064 undocumented immigrants had been arrested for homicides between 2004 and 2008. In fact, the statistic covered the time period between August 1955 and April 2010, a difference of nearly 51 years. The first, fraudulent timeframe would work out to about 17 arrests per day; the real timeframe works out to approximately 1.25 arrests of undocumented people for homicide per day, or 456 arrests per year.

456 / 17,000 homicides/yr = less than 3% of all homicides per year. Undocumented immigrants represent just over 3% of the US population in the US.

Don’t you think that if nearly 1/3 of all homicides per year were committed by “illegals” you’d hear more about it? Wouldn’t those murders get the Mollie Tibbetts treatment?

500 is closer to the truth than 5000.

          • Jeffery says:

And can anyone explain the oft repeated claim that Manafort was exonerated of identical charges 8 years ago??

the witch hunt has found a guy exonerated of the charges 8 years ago

    • david7134 says:

What is disgusting is that the Democrats only formulate policy based on a concept of winning or manipulating the U.S. to increase their power and all this has nothing to do with improving the country or actually improving the life and welfare of the average US citizen. Obama could have readily improved the business environment and thus the welfare of everyone by cutting taxes in 2009. Instead he went with a policy of pumping one trillion dollars into the stock market per year simply to make it seem that the market was improving. Economy 101 would have demonstrated that his position was stupid and would not work. But his incompetence, ignorance and world view as well as his inability to work with Republicans made the U.S. Suffer for at least 8 years. And the final bill will be harmful in the future as his 10 trillion behind showing its influence on inflation and monetary valuation.

  4. McGehee says:

“Another article, proposed by Massachusetts representative Benjamin Butler, charged Johnson with making speeches “with a loud voice, certain intemperate, inflammatory, and scandalous harangues” with the intent to disgrace Congress. This article was initially rejected, but later adopted as Article 10.

  5. formwiz says:

    More like Peak Idiot.

I wish a few of these African americans would actually read the Constitution and take a couple of Poli Sci courses to find out what the law is.

Another of those congresscritters who thinks Guam will capsize.

  6. david134 says:

This is my advice to Trump. Don’t fight Mueller, you have not committed any crime. Instead endorse Mueller and instruct DOJ to expand the investigation to include all election irregularities especially those by Obama and Hillary. Then appoint someone to investigate Mueller.

  7. david7134 says:

    Jeff,
You keep going on about Manafort and others as if their activity outside of his influence has something to do with Trump. Now you are in a corporation, should they be responsible for your activity as a pedophile?

    • Jeffery says:

      david7134,

Since TEACH and another commenter identified me on this blog, your calling me a pedophile is defamatory. Care to withdraw your defamation?

  8. Mangoldielocks says:

Trump has been investigated repeatedly since he was 20 years old. Clinton and the DNC tore the world apart looking for CRIMES only to come up with the fact he loves to bang women in and out of wedlock.

I do not think they will find any crimes but that does not matter. To the point of the post. They can take any action of Trumps and turn it into an impeachable offense. The entire point of my post is that if the GOP wishes to avoid a Trump impeachment they need to turn out in numbers unheard of before at the polls.

I do not advocate violence or civil unrest. I advocate the right needs to stand up for themselves and stop being the whipping boy. They have a very real chance of putting the left farther into the trash bin of history if they simply get out and vote.

The latest poll shows Trump with an over 36 percent approval rating by blacks now. Additionally another poll shows the main driver of his growing popularity now: a stunning 10 percent rise in Trump approval among Hispanics.

In fact another poll shows that more Hispanics agree with the GOP on border enforcement than they do with the Dems on the same issue.

In fact, per Zogby Analytics exit polling from 2016, twice as many Hispanics believe immigration enforcement is too lax versus too stringent. Regarding the recent border issues, an Economist/YouGov poll found that only 20 percent of Hispanics support the previous policies of “catch and release”

So I believe despite the lefts belief in a blue wave they are once again going to be disappointed by the ballot box in November IF they turn out and vote.

Lets not forget the walk away movement as well where the left is losing support steadily among young voters who realize that free everything just isnt possible in this world.
