Blocking Crackdowns and Border Fences

Someone needs a serious dose of Prozac in their liberal lunacy

A federal judge in San Francisco yesterday blocked plans by the Department of Homeland Security and the Social Security Administration to crack down on employers who hire illegal aliens.

U.S. District Judge Charles Breyer issued an order saying the agencies could not go forward with plans announced in August to send letters warning employers they face stiff penalties — including fines of up to $10,000 — if they hire workers whose Social Security numbers do not match their names.

Judge Breyer, appointed by President Clinton in 1997, said the new work-site rules likely would impose hardships on businesses and their workers, adding that the plaintiffs had "demonstrated they will be irreparably harmed" if the rules are enforced.

Fantastic. It would be too onerous for business to comply with making sure their employees are legal residents or legal to work, something that they should have been doing already. I fail to see ho difficult it is to read a letter sent by Homeland Stupidity (woops, sorry, that is the website for Bad Behavior) and follow what it says. It certainly cannot be as difficult as Sarbanes-Oxley, for those who are familiar with it. Or, keeping up with a union contract. FLSA regulations. Certainly a good deal more difficult then following a simple letter, eh?

If you want to stop part of the illegals problem, which is people coming here for a job, as well as overstaying their visa’s to continue to work, then you have to make sure it is fixed on the back end, and that means making sure that businesses will not hire and retain illegals. It doesn’t stop the whole issue, but, it certainly doesn’t hurt.

The judge, the younger brother of Supreme Court Justice Stephen G. Breyer, issued a preliminary injunction that will remain in effect until a pending lawsuit challenging the rules goes to trial sometime next year or until a higher court intervenes. The plaintiffs in the suit include the AFL-CIO, the American Civil Liberties Union, the U.S. Chamber of Commerce and a number of other business, labor and immigration-activist groups.

Figures. And Judge Breyer has a history of imposing his own unique views and rulings. I suppose going strictly by The Law is not fun enough for him. Fun is fine, but, it has to stay within the dictates of The Law. Besides, what more needs to be said then "a federal judge in San Francisco appointed by Slick Clinton."

In August, Homeland Security Secretary Michael Chertoff said the new rules required the verification of documents by employers, adding that they would be reinforced by increased raids on workplaces that employ an estimated 6 million illegal workers.

Companies keep track of hundreds of millions of employees. It certainly cannot be that difficult to read a letter regarding, in most case, no more then a few employees, eh? Combine this with a better migrant worker program, and companies will have workers. Or, better yet, make those on welfare go do those jobs.

Moving to the fence

A federal judge yesterday temporarily delayed construction of a 1.5-mile section of a border fence in a wildlife conservation area on the Arizona-Mexico line.

The Defenders of Wildlife and the Sierra Club had requested a 10-day delay in a motion accusing the Bureau of Land Management and other agencies of failing to conduct a thorough study of the fence’s effect on the environment.

U.S. District Court Judge Ellen Segal Huvelle said she granted the delay in part because the federal government did not explain why it hurried through an environmental assessment and began building the fence in the San Pedro Riparian National Conservation Area.

Woops, there are those liberal groups again, attempting to block the security of the USA, all the while complaining that Bush is not doing enough.

As far as Judge Huvelle goes, um, honey (not too insulting, eh)? They hurried through it so that they could try and stop the illegal aliens who come in to our country, and because those impact statements are enormously burdensome. More so then reading a SS matching letter. She should try slapping an injunction on the illegals who are littering up pristine areas, such as the San Pedro Riparian National Conservation Area.
