WTW: No Flag Amendment, Needed One Vote

Hey, y'all Jebediah here on a beautiful White Trash Wednesday. Finally might see some Sun here in the Carolinas. Now y'all in them Blue States in the North East get a taste. Bwahahahahaha!

Anyhow, looks like the Flag Amendment vote failed again, and, of course the Drive By Media shows their true colors

The narrow defeat of a proposal to ban flag desecration marks the second time in a month Senate Republicans have lost bids to amend the Constitution in ways designed to inspire social conservatives to vote in the midterm elections.

The 66-34 tally on the flag amendment Tuesday was one less than the two-thirds, or 67 votes, required to send it to the states for ratification. The House cleared the two-thirds threshold last year, 286-130.

Interestingly, the article fails to mention the 15 Democrats who voted for this Amendment

I think you will find that many Conservatives disagree on this Amendment. Many are for it, many are against it, many could take it or leave it, for a variety of reasons. Like Teach, I could take it or leave it. I'll come back to this line of thought in a bit, I reckon.

Opponents said the amendment would violate the First Amendment right to free speech. And some Democrats complained that majority Republicans were exploiting people's patriotism for political advantage.

Then they are complete idiots and do not understand how the Constitution works. I include anyone who has said something like that, Left or Right.

The flag amendment's cliffhanger defeat a week before Independence Day represented Congress' response to Supreme Court rulings in 1989 and 1990 that burning and other desecration of the flag are protected as free speech by the First Amendment to the Constitution.

Free Speech, huh?

"Our country's unique because our dissidents have a voice," said Sen. Daniel Inouye (D-Hawaii), a World War II veteran who lost an arm in the war and was decorated with the Medal of Honor.

"While I take offense at disrespect to the flag," he said, "I nonetheless believe it is my continued duty as a veteran, as an American citizen, and as a United States senator to defend the constitutional right of protesters to use the flag in nonviolent speech."

Ah, but there is the rub. Yesterday, toutcute made some very good arguments in response to Teach's post on the Flag Amendment, which he used some over the top examples in. But, let's not forget the rest of the 1st Amendment, which we had planned a 2 part post on:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

When you burn one of our national symbols, are you assembling peaceably? I would submit to you that no, you are not. Arson is, in itself, a violent act to start with. Add in that you are burning a United States Flag is worse. You are not protesting your government peaceably. No one, except the Klan, complains when cross burners are stopped. Isn't that Free Speech? Sure. But it is violent free speech, and not very peaceable.

Many Conservatives do not think we need an Amendment, because you cannot force people to be patriotic, especially those lefties who say they love their country, yet fly and portray the Flag upside down, and say they would burn the flag in heartbeat. Instead, why not allow others to register their displeasure with flag burners "free speech" by burning their tie died t-shirt. After you take it off them, of course.
