The DA has said that the reason he is opting for the 10 year recommendation is that it really does no good to put him in jail for more time than that. The family will have their say at sentencing and the judge will have to option of giving him more (or less) time behind bars, but don't count on it. This county is notorious for liberal judges cutting time off of sentences. The fact that the guy fled the scene and wasn't apprehended for (2) weeks should get him the maximum anyway in my opinion.
